אֵין הַנֶּדֶר וְהַשְּׁבוּעָה נִתָּרִים, אֶלָּא עַל פִּי מֻמְחֶה אוֹ בְּג' הֶדְיוֹטוֹת, שֶׁאֲפִלּוּ פֵּרֵשׁ וְהִתְנָה בִּשְׁעַת הַנֶּדֶר אוֹ הַשְּׁבוּעָה אֵימָתַי שֶׁיִּרְצֶה שֶׁיְּבַטְּלֶנּוּ מֵעִקָּרוֹ, אוֹ שֶׁתּוֹלֶה בְּאַחֵר שֶׁיְּבַטְּלֶנּוּ אֵימָתַי שֶׁיִּרְצֶה, אֵינוֹ כְּלוּם, דְּמִיָּד כְּשֶׁחָל הַנֶּדֶר אֵין לוֹ הַתָּרָה אֶלָּא עַל יְדֵי מֻמְחֶה אוֹ ג' הֶדְיוֹטוֹת וַאֲפִלּוּ אִם תְּלָאוֹ בְּדַעַת אַחֵר וְקִיְּמוֹ וְשׁוּב נִשְׁאַל עַל הַקִּיּוּם אֵינוֹ מוֹעִיל. הַגָּה: אֲבָל אִם לֹא קִיְּמוֹ וּמִיָּד שֶׁשָּׁמְעוּ אָמַר שֶׁלֹּא יִהְיֶה נֶדֶר, הַנֶּדֶר בָּטֵל (כ"מ מִדִּבְרֵי הָרֹא"שׁ כְּלָל י' סִימָן ג' וּמִלְּשׁוֹן הַטּוּר). וְכָל שֶׁכֵּן אִם הִתְנָה בְּפֵרוּשׁ שֶׁחֲבֵרוֹ יוּכַל לְבַטְּלוֹ, דְּיוּכַל חֲבֵרוֹ לְבַטֵּל כָּל זְמַן שֶׁלּא חָל הַנֶּדֶר (ריב"ש סִימָן ת"ז וקפ"ה) וְעַיֵּן לְעֵיל סִימָן רכ"ח סָעִיף ל"ז ול"ח. וּמִיהוּ אִם נָדַר לִזְמַן, אֵין צָרִיךְ הַתָּרָה אֶלָּא כְּשֶׁיַּגִּיעַ הַזְּמַן בָּטֵל מִמֵּילָא.

The vow and the oath are not released save on the word of an expert, or by three ordinary men. For even if he set out and stipulated at the time of the vow or the oath that whenever he wishes he shall nullify it from its root, or made it depend upon another that he should nullify it whenever he wishes — it is nothing; for immediately when the vow took effect it has no release save by way of an expert or three ordinary men. And even if he made it depend upon another's knowledge and upheld it, and afterwards sought release upon the upholding, it is of no avail. Hagah [Rema]: But if he did not uphold it, and immediately when they heard it he said that it should not be a vow, the vow is void (so it is implied from the words of the Rosh, klal 10, siman 3, and from the language of the Tur). And all the more so if he stipulated expressly that his fellow should be able to nullify it, that his fellow is able to nullify it all the time that the vow has not taken effect (Rivash, siman 407 and 185). And see above, siman 228, se'ifim 37 and 38. However, if he vowed for a time, it requires no release; rather, when the time arrives it is void of itself.
