מַתִּירִין שְׁבוּעוֹת וּנְדָרִים, אֲפִלּוּ נִשְׁבַּע בְּהַזְכָּרַת הַשֵּׁם. (כֵּן נָהֲגוּ עַל פִּי ש"ס וּפוֹסְקִים עַיֵּן בֵּית יוֹסֵף). הַגָּה: וּמִכָּל מָקוֹם לֹא יִשְׁאַל עָלָיו לְכַתְּחִלָּה, אֶלָּא מִדֹּחַק. וְעַיֵּן לְעֵיל סִימָן ר"ג (הַגְּאוֹנִים וְעוֹד פּוֹסְקִים) כָּל נֶדֶר שֶׁיֵּשׁ בְּהַתָּרָתוֹ נִדְנוּד עֲבֵרָה אֵין לְהַתִּירוֹ (הר"ד כֹּהֵן וריב"ש סי' תל"ב). יֵשׁ אוֹמְרִים כָּל מִי שֶׁנִּשְׁבַּע שֶׁלֹּא לַעֲשׂוֹת אֵיזֶה דָּבָר, כְּגוֹן שֶׁנִּשְׁבַּע שֶׁלֹּא לִמְכֹּר חֵפֶץ פְּלוֹנִי, וְעָבַר וּמְכָרוֹ, אֵין בִּמְכִירָתוֹ כְּלוּם, הוֹאִיל וְעָבַר עַל שְׁבוּעָתוֹ. (בְּמָרְדְּכַי הַגָּהוֹת דִּשְׁבוּעוֹת).
They release oaths and vows, even if he swore with the mention of the Name (so they were accustomed, on the authority of the Talmud and the poskim — see the Beit Yosef). Hagah [Rema]: And in any case he shall not seek release upon it at the outset, save out of pressing need. And see above, siman 203 (the Geonim and further poskim). Every vow in whose release there is a trace of transgression is not to be released (Rabbi David Kohen, and Rivash, siman 432). There are those who say that anyone who swore not to do some thing — such as where he swore not to sell a certain object, and he transgressed and sold it — there is nothing in his sale, since he transgressed his oath (in Mordechai, Hagahot on Shevuot).
