Se’if 1א׳
בְּהֵמָה, חַיָּה וָעוֹף טְעוּנִין שְׁחִיטָה; דָּגִים וַחֲגָבִים אֵין טְעוּנִין שְׁחִיטָה. הַגָּה: וּמֻתָּר לְאָכְלָם מֵתִים אוֹ לַחְתֹּךְ מֵהֵם אֵבֶר וּלְאָכְלוֹ, אֲבָל אָסוּר לְאָכְלָן חַיִּים מִשּׁוּם: בַּל תְּשַׁקְּצוּ (הַגָּהוֹת מַיְמוֹנִי פֶּרֶק א' הַגָּהוֹת מָרְדְּכַי ותוס').
Domesticated animals, wild animals, and birds require ritual slaughter [to be permitted to eat]; fish and grasshoppers do not require ritual slaughter. Rama: And it is permitted to eat them dead or to cut off a limb from them and eat it, but it is forbidden to eat them alive because of the prohibition against being disgusting.
Se’if 2ב׳
הַשּׁוֹחֵט אֶת הַבְּהֵמָה וְנִמְצֵאת כְּשֵׁרָה, וּמָצָא בָּהּ עֻבָּר בֶּן ח' בֵּין חַי בֵּין מֵת, אוֹ בֶּן ט' מֵת, מֻתָּר בַּאֲכִילָה וְאֵינוֹ טָעוּן שְׁחִיטָה; וְאִם מָצָא בָּהּ בֶּן ט' חַי, אִם הִפְרִיס עַל גַּבֵּי קַרְקַע, טָעוּן שְׁחִיטָה, אֲבָל שְׁאָר טְרֵפוֹת אֵינוֹ אוֹסֵר אוֹתוֹ; וְאִם לֹא הִפְרִיס עַל גַּבֵּי קַרְקַע, אֵינוֹ טָעוּן שְׁחִיטָה; וְאִם פַּרְסוֹתָיו קְלוּטוֹת (פי' שֶׁפַּרְסָתוֹ כֻּלָּהּ אַחַת וְאֵינָהּ סְדוּקָה), אוֹ שֶׁהָיָה בּוֹ שׁוּם שְׁאָר דָּבָר תָּמוּהַּ, (הַגָּהוֹת אֲשֵׁרִי), אַף עַל פִּי שֶׁהִפְרִיס עַל גַּבֵּי קַרְקַע אֵינוֹ טָעוּן שְׁחִיטָה; וְיֵשׁ מְגַמְגְּמִין בַּדָּבָר.
One who slaughters the animal and it was found to be valid, and he found in it a foetus born at eight months, whether alive or dead, or one born at nine months that is dead — it is permitted to be eaten and does not require slaughter. And if he found in it one born at nine months that is alive: if it set its hooves upon the ground, it requires slaughter, but the other defects of a tereifah (an animal with a fatal defect) do not render it forbidden; and if it did not set its hooves upon the ground, it does not require slaughter. And if its hooves are closed (that is, that its hoof is all one and is not cloven), or there was in it any other matter that is a wonder, (Hagahot Asheri) even though it set its hooves upon the ground it does not require slaughter; and there are some who waver on the matter.
Se’if 3ג׳
אִם לֹא שָׁחַט הָאֵם, אֶלָּא קְרָעָהּ, וְכֵן אִם שְׁחָטָהּ וְנִתְנַבְּלָה בְּיָדוֹ אוֹ שֶׁנִּמְצֵאת טְרֵפָה, אִם הָעֻבָּר הַנִּמְצָא בָּהּ בֶּן ט' חַי, טָעוּן שְׁחִיטָה לְעַצְמוֹ וְנִתָּר בָּהּ; וְאִם הוּא בֶּן ט' מֵת אוֹ בֶּן ח' אֲפִלּוּ חַי, הֲרֵי זֶה אָסוּר. הַגָּה: וְעַכְשָׁו אֵין לְהַתִּיר שׁוּם וָלָד הַנִּמְצָא בִּבְהֵמָה, אִם הָאֵם טְרֵפָה, (הַגָּהוֹת מַיְמוֹנִי בְּשֵׁם סְמַ"ג סוֹף לָאוִין קל"ו ואו"ה סוֹף כְּלָל נ"ה), וְלֹא מְהַנֵּי לוֹ שְׁחִיטַת עַצְמוֹ דְּחַיְשִׁינָן שֶׁמָּא אֵינוֹ בֶּן ט'.
If he did not slaughter the mother but tore her open, and likewise if he slaughtered her and she became carrion (nevelah — an animal that died without valid slaughter) at his hand, or she was found to be a tereifah: if the foetus found in her is one born at nine months that is alive, it requires slaughter of its own and it is permitted thereby; and if it is one born at nine months that is dead, or one born at eight months even alive, this one is forbidden. Hagah [Rema]: And nowadays one is not to permit any young found in an animal if the mother is a tereifah, (Hagahot Maimoni in the name of the Semag, end of negative commandment 136, and Issur ve-Heter, end of kelal 55) and its own slaughter does not avail it, for we take account of the possibility that it is not one born at nine months.
