Se’if 1א׳
הַמַּקְשָׁה לֵילֵד וְהוֹצִיא הָעֻבָּר אֶת רֹאשׁוֹ, אַף עַל פִּי שֶׁהֶחֱזִירוֹ, הֲרֵי הוּא כְּיָלוּד וְאֵינוֹ נִתָּר בִּשְׁחִיטַת אִמּוֹ; לְפִיכָךְ, אִם הוּא בֶּן ח' חַי אוֹ מֵת, אוֹ בֶּן ט' מֵת, אָסוּר; וְאִם הוּא בֶּן ט' חַי, נִתָּר בִּשְׁחִיטַת עַצְמוֹ.
An animal that is in hard labour to give birth and the foetus put out its head — even though it drew it back in, this one is as one born, and it is not permitted by the slaughter of its mother. Therefore, if it is one born at eight months, whether alive or dead, or one born at nine months that is dead, it is forbidden; and if it is one born at nine months that is alive, it is permitted by its own slaughter.
Se’if 2ב׳
הוֹצִיא יָדוֹ וְהֶחֱזִירָהּ פי' קֹדֶם שְׁחִיטָה, מַה שֶּׁיָּצָא מִן הָאֵבֶר לַחוּץ, אָסוּר; אֲבָל מַה שֶּׁנִּשְׁאַר מִמֶּנּוּ בִּפְנִים, וּמְקוֹם חֲתָךְ, מֻתָּר; לֹא הֶחֱזִירָהּ קֹדֶם שְׁחִיטָה, גַּם מְקוֹם הַחֲתָךְ אָסוּר, אֲבָל מַה שֶּׁבִּפְנִים, מֻתָּר אֲפִלּוּ הוּא מִעוּטוֹ. הַגָּה: וְכָל זֶה לֹא אַיְרִי אֶלָּא לְעִנְיַן שֶׁיְּהֵא נִתָּר בִּשְׁחִיטַת אִמּוֹ, כִּשְׁאָר עֻבָּר הַנִּמְצָא בָּהּ. אֲבָל אִם יָלְדָה אוֹתָהּ הַבְּהֵמָה אַחַר כָּךְ, גַּם הָאֵבָר שֶׁיָּצָא וְהֶחֱזִירוֹ, שָׁרֵי, דִּשְׁחִיטַת עַצְמוֹ מַתִּיר הַכֹּל. (כָּךְ הֶעֱלָה הַבֵּית יוֹסֵף וְר"י ן' חָבִיב וְכָל בּוֹ בְּשֵׁם י"א וְכֵן הוֹכִיחַ מַהַרְשַׁ"ל פֶּרֶק הַמַּקְשָׁה סי' א' וְכֵן מַשְמָעוּת הַפּוֹסְקִים וְהוּא פָּשׁוּט).
He extended his hand and retracted it (meaning before the slaughtering): what emerged from the limb outside is forbidden. But what remained inside and the place of the cut is permitted. If he did not retract it before the slaughtering, even the place of the cut is forbidden, but what is inside is permitted, even if it is a minority. Gloss: All this refers only to the matter of it being permitted by the slaughtering of its mother like any other fetus found within it. However, if the animal later gave birth, even the limb that emerged and was retracted is permitted, because its own slaughtering permits everything. This is the conclusion of the Beit Yosef and Rabbi Yosef Ibn Habib, and Kol Bo in the name of some authorities, and this is also proven by the Maharshal in Perek Behemah Hamakshah, Siman 1, and this is the implication of the poskim, and it is obvious.
Se’if 3ג׳
אִם יָצָא רֹב הָעֻבָּר, הֲרֵי הוּא כְּיָלוּד. וְאִם יָצָא חֶצְיוֹ בְּרֹב אֵבֶר, אוֹ שֶׁיָּצָא רֻבּוֹ בְּמִעוּט אֵבֶר, הֲרֵי הוּא כְּיָלוּד.
If the greater part of the foetus came out, this one is as one born. And if half of it came out with the greater part of a limb, or the greater part of it came out with the lesser part of a limb, this one is as one born.
