מִי שֶׁהִתְפַּלֵּל תְּפִלַּת הַמִּנְחָה לְאַחַר ו' שָׁעוֹת וּמֶחֱצָה וּלְמַעְלָה, יָצָא. וְעִקַּר זְמַנָּהּ מִט' שָׁעוֹת וּמֶחֱצָה וּלְמַעְלָה עַד הַלַּיְלָה לְרַבָּנָן, וּלְרַבִּי יְהוּדָה עַד פְּלַג הַמִּנְחָה שֶׁהוּא עַד סוֹף י" א שָׁעוֹת חָסֵר רָבִיעַ. הַגָּה: וּמְשַׁעֲרִינָן שָׁעוֹת אֵלּוּ לְפִי עִנְיַן הַיּוֹם, וְאַף אִם הַיּוֹם אָרֹךְ מְשַׁעֲרִינַן לְי"ב שָׁעוֹת וְהֵם נִקְרָאִים שָׁעוֹת זְמַנִּיּוֹת, וְכֵן כָּל מָקוֹם שֶׁשִּׁעֲרוּ חֲכָמִים בְּשָׁעוֹת, מְשַׁעֲרִינַן לְשָׁעוֹת אֵלּוּ (רַמְבַּ"ם בְּפי' הַמִּשְׁנָה בְּפ"ק דִּבְרָכוֹת), וְאַסִיקְנָא, דְּעָבַד כְּמַר, עָבַד; וּדְעָבַד כְּמַר, עָבַד; וְהוּא שֶׁיַּעֲשֶׂה לְעוֹלָם כְּחַד מִינַיְיהוּ, שֶׁאִם עוֹשֶׂה כְּרַבָּנָן וּמִתְפַּלֵּל מִנְחָה עַד הַלַּיְלָה, שׁוּב אֵינוֹ יָכוֹל לְהִתְפַּלֵּל עַרְבִית מִפְּלַג הַמִּנְחָה וּלְמַעְלָה; וְאִם עוֹשֶׂה כְּר' יְהוּדָה וּמִתְפַּלֵּל עַרְבִית מִפְּלַג הַמִּנְחָה וּלְמַעְלָה, צָרִיךְ לִזָּהֵר שֶׁלֹּא יִתְפַּלֵּל מִנְחָה בְּאוֹתָהּ שָׁעָה; וְעַכְשָׁו שֶׁנָּהֲגוּ לְהִתְפַּלֵּל תְּפִלַּת מִנְחָה עַד הַלַּיְלָה, אֵין לְהִתְפַּלֵּל תְּפִלַּת עַרְבִית קֹדֶם שְׁקִיעַת הַחַמָּה; וְאִם בְּדִיעֲבַד הִתְפַּלֵּל תְּפִלַּת עַרְבִית מִפְּלַג הַמִּנְחָה וּלְמַעְלָה, יָצָא. וּבִשְׁעַת הַדַּחַק, יָכוֹל לְהִתְפַּלֵּל תְּפִלַּת עַרְבִית מִפְּלַג הַמִּנְחָה וּלְמַעְלָה. הַגָּה: וּלְדִידָן בִּמְדִינוֹת אֵלּוּ שֶׁנּוֹהֲגִין לְהִתְפַּלֵּל עַרְבִית מִפְּלַג הַמִּנְחָה, אֵין לוֹ לְהִתְפַּלֵּל מִנְחָה אַחַר כָּךְ; וּבְדִיעֲבַד אוֹ בִּשְׁעַת הַדַּחַק, יָצָא אִם מִתְפַּלֵּל מִנְחָה עַד הַלַּיְלָה, דְּהַיְנוּ צֵאת הַכּוֹכָבִים (בֵּית יוֹסֵף בְּשֵׁם אֹהֶל מוֹעֵד וְרַשְׁבָּ"א).
One who prayed the afternoon prayer from six and a half hours onward has fulfilled his obligation. And its principal time is from nine and a half hours onward until nightfall according to the Rabbis, and according to Rabbi Yehuda until pelag ha-minchah (the midpoint of the closing stretch of the afternoon), which is until the end of eleven hours less a quarter. Hagah [Rema]: And these hours are reckoned according to the length of the day; and even if the day is long, one reckons it as twelve hours, and these are called proportional hours; and likewise every place where the Sages reckoned in hours, one reckons by these hours (the Rambam in his commentary on the Mishnah, first chapter of Berakhot). And we concluded: whoever has acted as this master has acted, and whoever has acted as that master has acted; provided that he always acts as one of them. For if he acts as the Rabbis and prays the afternoon prayer until nightfall, he can no longer pray the evening prayer from pelag ha-minchah onward; and if he acts as Rabbi Yehuda and prays the evening prayer from pelag ha-minchah onward, he must take care not to pray the afternoon prayer at that hour. And now that it has become the custom to pray the afternoon prayer until nightfall, one should not pray the evening prayer before sunset; and if after the fact he prayed the evening prayer from pelag ha-minchah onward, he has fulfilled his obligation. And in a time of pressing need he may pray the evening prayer from pelag ha-minchah onward. Hagah [Rema]: And for us, in these countries where it is the custom to pray the evening prayer from pelag ha-minchah, one should not pray the afternoon prayer after it; and after the fact, or in a time of pressing need, he has fulfilled his obligation if he prays the afternoon prayer until nightfall, that is, the emergence of the stars (Beit Yosef in the name of Ohel Moed and the Rashba).
Se’if 2ב׳
אִם יֵשׁ לוֹ מַיִם, צָרִיךְ לִטֹּל יָדָיו כְּדֵי לְהִתְפַּלֵּל, אַף עַל פִּי שֶׁאֵינוֹ יוֹדֵעַ לָהֶם שׁוּם לִכְלוּךְ, וְלֹא יְבָרֵךְ. וְעַיֵּן לְעֵיל סִימָן צ"ב סָעִיף ה'. הַגָּה: וַאֲפִלּוּ עוֹמֵד מִלִּמּוּדוֹ, יִטֹּל יָדָיו לִתְפִלָּה (מִנְהָגִים); וְאִם אֵין לוֹ מַיִם מְזֻמָּנִים, אֵינוֹ צָרִיךְ לִטֹּל.
One must wash his hands prior to praying, if he has water [available], even if they had not become dirty. He does not make a blessing [for washing]. Gloss: Even one who was [in the midst of Torah] study when he got up [to pray], should wash his hands for prayer.If one does not have water prepared, he need not wash.
