Se’if 1א׳
הָאוֹמֵר לְאִשָּׁה: הֲרֵי אַתְּ מְקֻדֶּשֶׁת לִי בְּדִינָר זֶה עַל מְנָת שֶׁתַּחֲזִירֵהוּ לִי, אֵינָהּ מְקֻדֶּשֶׁת. הַגָּה: אֲבָל הָאִשָּׁה שֶׁנָּתְנָה לְאֶחָד מַתָּנָה עַל מְנָת לְהַחֲזִיר לָהּ לְאַחַר שְׁלֹשִים יוֹם, כְּדֵי לְקַדְּשָׁהּ בָּהּ תּוֹךְ ל', וְנָתַן לָהּ תּוֹךְ שְׁלֹשִים לְקִדּוּשִׁין, הָוֵי מְקֻדֶּשֶׁת (תְּשׁוּבַת הָרֹא"שׁ כְּלָל ל"ה). יֵשׁ אוֹמְרִים דְּאִם נָתַן לָהּ מַתָּנָה עַל מְנָת לְהַחֲזִיר וְאָמַר לָהּ: בַּהֲנָאָה זוֹ שֶׁאַתְּ נֶהֱנֵית תּוֹךְ הַזְּמַן הֲרֵי אַתְּ מְקֻדֶּשֶׁת לִי, הָוֵי קִדּוּשִׁין (רַבֵּנוּ יְרוּחָם):
The one who says to a woman: behold you are betrothed to me with this dinar on condition that you will return them to me, she is not betrothed. Ram''a: But the woman that gives a gift to one on condition to return it to her after thirty days, in order that he will betroth her with it within thirty days, and he gave it to her within thirty days for kiddushin, she is betrothed. There are those who say that if he gave her a gift on condition to return it and he said to her: With the enjoyment that you are enjoying [from the gift] while [saying] behold you are betrothed to me, it is kiddushin.
Se’if 2ב׳
אָמְרָה לוֹ: תֵּן מָנֶה לִפְלוֹנִי וְאֶתְקַדֵּשׁ אֲנִי לְךָ, וְנָתַן לוֹ, וְאָמַר לָהּ: הֲרֵי אַתְּ מְקֻדֶּשֶׁת לִי בַּהֲנָאַת מַתָּנָה זוֹ שֶׁנָּתַתִּי עַל פִּיךְ, הֲרֵי זוֹ מְקֻדֶּשֶׁת. הַגָּה: וְאִם הָיוּ עֲסוּקִים בְּאוֹתוֹ עִנְיָן, אַף עַל פִּי שֶׁנָּתַן סְתָם בְּצִוּוּיָהּ הֲרֵי זוֹ מְקֻדֶּשֶׁת (ב"י בְּשֵׁם ר"י). וְכָל זֶה דַּוְקָא שֶׁהִיא הִתְחִילָה לוֹמַר: תֵּן מָנֶה לִפְלוֹנִי. אֲבָל אָמַר לָהּ הוּא תְּחִלָּה, וְהִיא אוֹמֶרֶת: תֵּן לִפְלוֹנִי, עַיֵּן לְקַמָּן סִימָן ל' סָעִיף ח'. אָמְרָה לוֹ: הַלְוֵה מָנֶה לִפְלוֹנִי וְאֶתְקַדֵּשׁ אֲנִי לְךְ, וְהִלְוָה לִפְלוֹנִי, וְאָמַר לָהּ: הֲרֵי אַתְּ מְקֻדֶּשֶׁת בּוֹ, הָוֵי קִדּוּשִׁין, כְּמוֹ בְּמַתָּנָה. אֲבָל אִם הִרְוִיחַ זְמַן מִלְוֶה עַל פִּיהָ וְקִדְּשָׁה בּוֹ, אֵינָהּ מְקֻדֶּשֶׁת (בֵּית יוֹסֵף בְּשֵׁם הָרַשְׁבָּ"א):
She said to him: Give a maneh (a hundred zuz) to so-and-so and I will be betrothed to you; and he gave it to him, and said to her: Behold, you are betrothed to me by the benefit of this gift that I gave at your word — she is betrothed. Hagah [Rema]: And if they were occupied with that very matter, even though he gave without specifying, at her bidding, she is betrothed (Beit Yosef in the name of the Ri). And all this is specifically where she began by saying: Give a maneh to so-and-so. But if he said it to her first, and she says: Give to so-and-so — see below, siman 30, se'if 8. She said to him: Lend a maneh to so-and-so and I will be betrothed to you; and he lent to so-and-so, and said to her: Behold, you are betrothed by it — it is a betrothal, as with a gift. But if he extended the term of a loan at her word and betrothed her with that, she is not betrothed (Beit Yosef in the name of the Rashba).
Se’if 3ג׳
אָמְרָה לוֹ: תֵּן דִּינָר לִפְלוֹנִי וְאֶתְקַדֵּשׁ אֲנִי לוֹ, וְנָתַן לוֹ, וְקִדְּשָׁהּ אוֹתוֹ פְּלוֹנִי, וְאָמַר לָהּ: הֲרֵי אַתְּ מְקֻדֶּשֶׁת לִי בַּהֲנָאַת מַתָּנָה זוֹ שֶׁקִּבַּלְתִּי בִּרְצוֹנֵךְ, הֲרֵי זוֹ מְקֻדֶּשֶׁת:
If she said to him, "Give a dinar to so-and-so, and I will be betrothed to him (to so-and-so), and he gave [the dinar] to that man, and that man betrothed her and said to her, "You are hereby married to me by dint of the benefit accrued to you from my acceptance [of the dinar] at your behest, she is betrothed.
