How the borrower is made to swear whether he has anything, and a cherem is pronounced on whoever knows of property of his; and whether he is honest or a cheat; and whether he gave what is his as a gift; it contains eight se'ifim. If he had no plea at all against the document, but said that he has nothing to pay with — if nothing is found belonging to the borrower beyond the arrangement (the necessities the court sets aside for a debtor) they make for him, the Geonim enacted that the borrower is made to swear, in the manner of the Torah's oath, holding a sacred object, that he has nothing beyond the arrangement made for him, and that he has not hidden anything in the hands of others, and that he has not given a gift on condition that it be returned. And he includes in this oath that of everything he earns, and everything that comes into his hand or into his possession, of whatever his hand can reach, he will not feed from it his wife or his children, nor clothe them, nor provide for them, nor give a gift to any person in the world; rather, out of all that his hand can reach he will lay out food for thirty days and clothing for twelve months — food fit for him and clothing fit for him, not the eating of gluttons and drunkards or of the sons of kings, nor the garments of governors and officers, but according to his own way — and all that is over his need he will give to his creditors, each in his turn, until each has collected all his debt. Hagah [Rema]: If he did not swear for the future to give him whatever his hand can reach, he can make him swear every thirty days that he has nothing (Tur, se'if 2). And first they pronounce a cherem (the severer form of the ban) on whoever knows of property of so-and-so's, revealed or hidden, and does not inform the court. And if he has many creditors, he need not swear this oath to each and every one; rather, he swears an oath once, for all of them. And if money is seen with him (before he swore, or) (Tur, se'if 9) after he swore this oath (or documents of debt written in his name were in his hand) (responsum of the Rashba in Beit Yosef, beginning of siman 98), and he said, "It belongs to others" (or he said, "I set it aside for others to whom I owe") (responsum of the Rosh, klal 79, siman 11), or "It is an iska (a venture in which the investor shares the gain and the loss) in my hand", they do not listen to him until he brings proof. Hagah [Rema]: And even though he has a migo (a plea he could have made in which he would have been believed), for he could have returned them, or said "These things never happened", he is not believed, for it is a migo against a presumption, since whatever is found in a man's hand is presumed to be his (the Maggid, chapter 1 of the Laws of Lender and Borrower, law 4). And some disagree about this (responsum of the Rosh, klal 79, siman 11; and so it is implied from the responsum of the Rashba which Beit Yosef wrote at the end of siman 47; and see se'if katan 6). However, if it is known that he holds an iska from others, he is believed to say of money in his hand, "These are of so-and-so's iska", by a migo, since he could have given them to him.

ראובן השביע לשמעון שבועה זו כתקנת הגאונים ולא השביעו להבא ואחר כך תבעו לוי ששטרו מאוחר והשביעו להבא מה שירויח יותר על הוצאתו שיתן לו אם לא שנשבע היו חולקים וכיון שנשבע לתתו ללוי צריך לקיים שבועתו כך כתב (הטור) בשם הרא"ש ולי נראה שבית דין יכופו ללוי ליתן החצי לראובן (וע"ל סי' ק"ד סעיף א' כתבתי כסברת הרא"ש):

Reuven made Shimon swear this oath according to the enactment of the Geonim, but did not make him swear for the future; and afterwards Levi, whose document is later, claimed from him and made him swear for the future that whatever he earns beyond his expenses he will give to him. Had he not sworn, they would divide; and since he swore to give it to Levi, he must fulfil his oath — so wrote (the Tur) in the name of the Rosh. And it seems to me that the court should compel Levi to give half to Reuven (and see below, siman 104, se'if 1, where I wrote according to the reasoning of the Rosh).

ראובן נתן חפץ לשמעון למכור ובא לוי בעל חוב של שמעון ולקחו בחובו אם ידוע בעדים שחפץ זה של ראובן צריך להחזיר לו אבל אם אינו ידוע בעדים אע"פ ששמעון מודה שהוא של ראובן אין מוציאין מלוי ואם יטעון ראובן ללוי אתה יודע שזה החפץ שלי צריך לישבע היסת (תשו' הרא"ש מצאתיה בכלל ק"ה ס"ס ב') ואם שמעון הוא סרסור החפצים הנמצאים בביתו שהוא רגיל למכרם אינם בחזקת שלו שימשכנם בעל חובו (והסרסור או בעל החפץ נאמנים בשבועה) (טור והוא בתשובת הרא"ש שם) וכן אם מצא בבית בעל חובו דברים העשוים להשאיל ולהשכיר ובא אחד ואמר שהשאילם או השכירם לו ויש לו שני עדים שהיו שלו נאמן ולא יוכל בעל חובו למשכנם בחובו:

Reuven gave an article to Shimon to sell, and Levi, a creditor of Shimon, came and took it for his debt: if it is known through witnesses that this article is Reuven's, he must return it to him; but if it is not known through witnesses, even though Shimon admits that it is Reuven's, they do not take it out of Levi's hand. And if Reuven pleads to Levi, "You know that this article is mine", he must swear the oath of hesset (the oath the Sages imposed on one who denies a claim outright) (responsum of the Rosh — I found it in klal 105, end of siman 2). And if Shimon is a broker, the articles found in his house which he is accustomed to sell are not presumed to be his, so that his creditor may take them as a pledge (and the broker or the owner of the article are believed with an oath) (Tur, and it is in the responsum of the Rosh there). And likewise, if he found in his debtor's house things made for lending and for hiring out, and someone came and said that he had lent them or hired them out to him, and he has two witnesses that they were his, he is believed, and the creditor cannot take them as a pledge for his debt.
