סדר גביית החוב והמבקש זמן לפסול שטרו אם לא בא בזמנו. ובו יא סעיפים: סדר גביית החוב כך הוא כשהמלוה מוציא שטר חוב מקוים אומרים ללוה שלם אפי' שהה כמה שנים ולא תבעו אין אומרים מחל לו כיון ששהה כל כך שנים ולא תבעו ואפי' שמענו שנתייאש (פי' תרגום ונואש ממני שאול וזה כי מי שלבו הומה על דבר מה ואח"כ נח ואינו חושב עוד בדבר ההוא יאמר עליו ל' יאוש) מהחוב לגמרי ואמר וי לחסרון כיס אינו יאוש (ואפילו ראה המלוה שכתב כל נכסיו לבניו ולא כתב למלוה רק קרקע כל שהוא ושתק אפ"ה לא אמרי' דמחל) (טור) ואפי' אין שטר חובו יוצא מתחת ידו אם החייב מודה:
The order of collecting a debt, and one who asks for time to invalidate his document if he does not come at his time; it contains eleven se'ifim. The order of collecting a debt is thus: when the lender produces a confirmed document of debt, they say to the borrower: pay. Even if he waited several years and did not claim from him, we do not say that he forgave him since he waited so many years and did not claim from him; and even if we heard that he despaired (that is, the Targum of "and Saul shall despair of me"; and this is because one whose heart is stirred over some matter and afterwards is at rest and thinks no more about that matter — the term "despair" is said of him) of the debt entirely and said, "Woe for the loss of money", it is not despair (and even if the lender saw that he wrote all his property over to his sons, and wrote over to the lender only some small piece of land, and was silent — even so we do not say that he forgave) (Tur); and even if his document of debt does not come out from under his hand, if the debtor admits.
Se’if 2ב׳
צריך לעשות הדיין דרישה וחקירה בשטרות ישנים שמוציאים אותם למה לא תבעו עד עתה אם יראה לו צד רמאות כדי להוציא הדין לאמיתו:
The judge must make inquiry and examination into old documents that are produced — why he did not claim until now — if he sees a side of deceit, in order to bring the judgment out to its truth.
Se’if 3ג׳
אין יורדים לנכסיו עד שיודיעוהו תחלה אם הוא כאן או במקום קרוב ואם טעה הדיין והוריד לנכסיו קודם שיודיעוהו מסלקים אותו:
They do not go down to his property until they first inform him, if he is here or in a nearby place; and if the judge erred and brought him down to his property before they informed him, they remove him.
Se’if 4ד׳
טען הלוה ואמר שטר זה שנתקיים בפניכם מזויף הוא אני אביא ראיה ואבטלנו ועדים במקום פלו' והם פלו' ופלו' אם נראה לדיינים שיש ממש בדבריו קובעים לו זמן להביא עידיו ואם נראה להם שאינו בא אלא בעלילות דברים ובטענות של דופי אומרים לו שלם ואחר כך אם יש לו ראיה יחזיר ואם היה המלוה אלם (פי' תקיף תרגום חזקו ואמצו תקיפו ואלימו) ושמא אינו יכול להוציא מידו מניחים ע"י שליש (ומן הסתם נותנין לו זמן שלשים יום) (טור):
The borrower pleaded and said, "This document which was confirmed before you is forged; I will bring proof and annul it, and there are witnesses in such-and-such a place, and they are So-and-so and So-and-so" — if it appears to the judges that there is substance in his words, they fix a time for him to bring his witnesses; and if it appears to them that he comes only with pretexts and with pleas of subterfuge, they say to him: pay, and afterwards, if he has proof, he gets it back. And if the lender was a strongman (that is, forceful; the Targum of "be strong and of good courage" is "be forceful and strong"), and perhaps he could not get it out of his hand, they leave it with a trustee (and without specification they give him a time of thirty days) (Tur).
Se’if 5ה׳
קבעו לו זמן להביא ראייה לבטל השטר והגיע הזמן ולא בא ממתינין לו שני וחמישי ושני לא בא כותבין עליו פתיחה ומשמתין אותו והוא בנידויו צ' יום שלמו צ' יום ולא בא בית דין כותבים לו אדרכתא (פי' שטר שב"ד כותבים למלוה ומדריכין אותו שיפרע מחובו על נכסי הלוה) על נכסיו ומתירין לו נידויו ואין כותבים אדרכתא עד ששולחים ומודיעים לו והוא שיהא קרוב לב"ד יום אחד ויש מי שאומר שני ימים ואם היה רחוק יתר על זה אין צריכין להודיעו.
They fixed a time for him to bring proof to annul the document, and the time came and he did not come — they wait for him Monday, Thursday and Monday. If he did not come, they write a petichah (a writ issued against one who will not obey a summons) against him and place him under a ban, and he is in his ban ninety days. If ninety days are completed and he did not come, the court writes for him an adrachta (that is, a document the court writes for the lender, and they direct him to be repaid his debt from the borrower's property) on his property, and they release his ban. And they do not write an adrachta until they send and inform him — and this is where he is one day from the court; and there is one who says two days; and if he was farther than this, they need not inform him.
