המבקש זמן לפרעון כמה זמן נותנים לו ואם לא בא בזמנו והמסרב צווי בית דין. ובו ג סעיפים: לוה שאמר הריני משלם קבעו לי זמן כדי שאלוה מאחר או אמשכן או אמכור ואביא מעות קובעין לו זמן ל' יום: הגה ואם נראה לדיין שלא יספיק לו ל' יום יוסיף לו ואם אינו צריך כל כך יפחות לו (טור בשם תשובת הרי"ף) ואם אמר התובע שצריך לילך לדרכו ולא יוכל להמתין על הזמן אומרים לו שיעשה שליח שימתין עד הזמן (שם תשובת הרא"ש כלל פ"א סי' ג') ואין מחייבים אותו ליתן משכון שאלו היו שם מטלטלים מיד היו בית דין גובים מהם ואם רצה המלוה להחרים על מי שיש לו מעות או מטלטלים ומפליג אותו בדברים ה"ז מחרים ואין מחייבים הלוה להביא ערב עד שיתן אא"כ נראה לדיין שיש לחוש שמא יבריח או ישמט: הגה ודוקא לפרעון נותנין זמן אבל אין נותנין זמן לשבועה אלא ביום הכניסה הראשון יש לו לישבע (מרדכי פרק בתרא דב"מ) וכן אין נותנין זמן לשאר דברים ששעבד אדם עצמו לעשות דבר לזמן פלוני בקנס מיד שהגיע הזמן נתחייב בקנס או שיעשה מה שנתחייב (תשו' רשב"א אלף תתקל"ג):

One who asks for time to repay — how much time they give him; and if he did not come at his time; and one who refuses the orders of the court; it contains three se'ifim. A borrower who said, "I will pay; fix me a time, so that I may borrow from another, or pledge, or sell, and bring money" — they fix him a time of thirty days. Hagah [Rema]: And if it seems to the judge that thirty days will not suffice him, he adds to it; and if he does not need so much, he reduces it (Tur in the name of a responsum of the Rif). And if the claimant says that he must go on his way and cannot wait for the term, they tell him to appoint an agent who will wait until the term (ibid., responsum of the Rosh, klal 81, siman 3). And they do not oblige him to give a pledge, for if there were movables there, the court would collect from them at once. And if the lender wishes to pronounce a cherem (the severer form of the ban) on whoever has money or movables of his, and the borrower puts him off with words, he may pronounce the cherem. And they do not oblige the borrower to bring a guarantor until he pays, unless it seems to the judge that there is reason to fear that he will put his property beyond reach or slip away. Hagah [Rema]: And it is specifically for repayment that they give time; but they do not give time for an oath — rather, he must swear on the first day of entering the court (Mordechai, the last chapter of Bava Metzia). And likewise they do not give time for other things, where a man bound himself to do a thing by such-and-such a time under a fine; as soon as the time arrived, he is liable for the fine, or to do what he was obliged to do (responsum of the Rashba, siman 1933).

Se’if 2ב׳

יש אומרים שהקובע זמן לפרעון חובו והגיע הזמן אין נותנים לו זמן אחר וי"א שגם לזה נותנים זמן ל' יום: הגה ואפי' בא ותבעו שלשים יום קודם הזמן מ"מ צריכים ליתן לו שלשים מיום הזמן (מרדכי פרק הנ"ל):

Some say that one who fixed a time for the repayment of his debt, and the time arrived, is not given another time; and some say that for this too they give a time of thirty days. Hagah [Rema]: And even if he came and claimed from him thirty days before the time, they must nevertheless give him thirty days from the day of the term (Mordechai, the chapter mentioned above).

שלמו השלשים יום ולא הביא ב"ד כותבין אדרכתא מיד על נכסיו ואם לא ימצאו לו נכסים אין מנדין אותו אבל אם יאמר איני רוצה לשלם כותבין אדרכתא על נכסיו ואם אין מוצאים לו נכסים מתרין בו בה"ב ואח"כ מנדין אותו ועומד [ בנידויו] עד שישלם לו או עד שיטעון שאין לו כלום וישבע על זה ואם עמד בנדוי ל' יום ולא תבעו להתיר נדויו מנדין אותו עוד ל' יום ואם עמד בהם מחרימים אותו ומשפטי הנידוי והחרם נתבאר בטור יורה דעה סי' של"ד:

The thirty days were completed and he did not bring the money: the court writes an adrachta (a court writ empowering the lender to seize the borrower's property) on his property at once; and if they do not find property of his, they do not place him under a ban. But if he says, "I do not wish to pay", they write an adrachta on his property, and if they do not find property of his, they warn him on Monday, Thursday and Monday, and afterwards they place him under a ban; and he remains under his ban until he pays him, or until he pleads that he has nothing and swears to it. And if he remained under the ban thirty days and did not seek to have his ban released, they place him under a ban for another thirty days; and if he remained under them, they place him under a cherem. And the laws of the ban and the cherem are explained in Tur, Yoreh De'ah, siman 334.
