חרש שוטה וקטן איזה שבועה נשבעים וגם אשת איש. ובו ו סעיפים: אין נשבעין על טענת חרש שוטה וקטן אחד הבא בטענת עצמו או בטענת אביו לפי שזה המקצת שהודה בו לקטן אינו אלא כמשיב אבידה וכן אם כפר בכל ובא עד אחד והעיד לקטן אינו נשבע שזה עד א' ואין שם תובע שתביעת הקטן אינה תביעה גמורה (וי"א דצריך לישבע על פי העד) (טור ומרדכי פרק הדיינים) נמצאת אומר קטן שאמר לגדול מנה לי בידך או אבא היה לו בידך והלה אומר אין לך בידי אלא חמשים או אין לך בידי כלום ועד אחד מעידו שיש לו ה"ז פטור משבועת התורה אבל אם שמר לקטן וטוען שאבד ה"ז נשבע שבועת השומרים לפי שאינו נשבע מחמת טענה: הגה וי"א דאין נשבעין לו שבועת שומרים שהיא שבועת התורה (טור בשם הרמב"ן והרא"ש והראב"ד שם בפ"ב משכירות בהשגתו) ואע"פ שתבעו כשהוא גדול רק שהנתינה היתה כשהיה קטן (שם בהשגות הראב"ד) וכן נ"ל עיקר: וכן אם הודה שהיה שותף לקטן או אפוטרופס עליו יעמידו ב"ד אפוטרופס לקטן וישבע השותף וכיוצא בו טענת שמא:

A deaf-mute, one who is not of sound mind, and a minor — which oath is sworn; and also a married woman; it contains six se'ifim. They do not swear on the claim of a deaf-mute, one who is not of sound mind, or a minor — whether he comes with his own claim or with his father's claim — because this part that he admitted to the minor is only as one who returns a lost object. And likewise if he denied everything, and one witness came and testified for the minor, he does not swear, for this is one witness and there is no plaintiff there, since the claim of a minor is not a full claim (and some say that he must swear on the word of the witness) (Tur, and Mordechai, chapter "The judges"). It follows that a minor who said to an adult, "You have a maneh (a hundred zuz) of mine", or "Father had it in your hand", and the other says, "You have only fifty in my hand", or "You have nothing in my hand", and one witness testifies that he has it — he is exempt from the oath by Torah law. But if he was a bailee for the minor and pleads that it was lost, he swears the oath of the bailees, because he does not swear on account of a claim. Hagah [Rema]: And some say that they do not swear to him the oath of the bailees, which is an oath by Torah law (Tur in the name of the Ramban and the Rosh, and the Raavad there, chapter 2 of the Laws of Hire, in his glosses), even though he claimed from him when he was an adult, only the giving was when he was a minor (there, in the glosses of the Raavad); and so it seems to me the principal view. And likewise if he admitted that he was a partner of the minor, or a guardian over him, the court sets up a guardian for the minor, and the partner, and the like, swears on a claim of "perhaps".

אע"פ שאין נשבעין על טענת קטן שבועת התורה אבל שבועת היסת נשבעין ואפי' היה קטן שאינו חריף לענין משא ומתן נשבעין היסת על טענתו נמצאת למד שהקטן שטען על הגדול בין שהודה מקצת בין שכפר בכל בין שהיה שם עד בין שלא היה שם עד ה"ז נשבע היסת ואינו יכול להפך על הקטן שאין משביעין את הקטן כלל ואפילו חרם סתם אינו מקבל לפי שאינו יודע עונש השבועה (וי"א דאין נשבעין על טענתו אא"כ הגיע לעונת הפעוטות) (טור בשם הרמב"ן והרא"ש ור"ן פרק הדיינים):

Even though they do not swear the oath by Torah law on a minor's claim, they do swear the oath of hesset (the oath the Sages imposed on one who denies a claim outright); and even if he was a minor who is not sharp in matters of business, they swear the oath of hesset on his claim. It follows that a minor who pleaded against an adult — whether he admitted part or denied everything, whether there was a witness there or there was no witness there — he swears the oath of hesset and cannot turn it over onto the minor, for they do not make a minor swear at all; and he does not accept even a general cherem (the severer form of the ban), because he does not know the punishment of the oath (and some say that they do not swear on his claim unless he has reached the age of the pe'utot (young children whose dealings are valid)) (Tur in the name of the Ramban and the Rosh, and the Ran, chapter "The judges").

יש מי שאומר שאע"פ שנשבעים שבועת היסת לקטן על השטרות אין נשבעין לו כלל קטן שטענו הגדול אם טענו בדבר שיש לו הנאה לקטן כגון עסק משא ומתן לאחר שהגיע לעונת הפעוטות והודה הקטן נפרעים מנכסיו ואם אין לו ימתין עד שיהיה לו וישלם ואם כפר הקטן ממתינים עד שיגדל וישבע היסת ואם טענו בדבר שאין לקטן הנאה כגון נזקים וחבלות אף ע"פ שמודה ואע"פ שיש לו ממה לשלם פטור ואפילו לאחר שהגדיל (טור סי' פ"ט ס"ד וסי' צ"א ס"י) ואם היה התובע מהנשבעים ונוטלים כגון השכיר וכיוצא בו שיש הנאה לקטן שישתכר לו שכיר הרי זה נשבע ונוטל מהקטן אבל חנוני שנשבע על פנקסו אינו נשבע ונוטל מהקטן שאין לקטן בזה הנאה שהרי הוא חייב לפועליו ונשבעין ונוטלין ממנו וזה החנוני הפסיד על עצמו שנתן ממונו על פי הקטן:

There is one who says that even though they swear the oath of hesset to a minor, on documents they do not swear to him at all. A minor whom an adult claimed from: if he claimed from him on a matter from which the minor has benefit — for example, dealings of business after he has reached the age of the pe'utot — and the minor admitted, they are repaid from his property; and if he has none, he waits until he has, and he pays. And if the minor denied, they wait until he grows up, and he swears the oath of hesset. And if he claimed from him on a matter from which the minor has no benefit — for example, damages and wounds — even though he admits, and even though he has something from which to pay, he is exempt, even after he has grown up (Tur, siman 89, se'if 4, and siman 91, se'if 10). And if the plaintiff was among those who swear and take — for example, the hired worker and the like, where there is benefit to the minor that a hired worker should work for him — he swears and takes from the minor. But a shopkeeper who swears on his ledger does not swear and take from the minor, for the minor has no benefit in this, since he is obliged to his workers and they swear and take from him; and this shopkeeper brought the loss on himself, for he gave his money on the minor's word.
