Se’if 1א׳
דין איזה שבועה נשבעין על קרקעות ודין הקדש בזמן הזה. ובו ו סעיפים: אלו דברים שאין נשבעין עליהם מן התורה קרקעות אפי' של ח"ל ועבדים ושטרות והקדשות וכן נכסי עכו"ם לא שנא מודה מקצת לא שנא כופר בכל ועד אחד מכחישו לא שנא שבועת השומרים ואפי' אם פשעו בהם ונאבדו פטורים מלשלם לא שנא שומר חנם או שומר שכר ושואל ואם התנה לשלם הכל לפי תנאו (מיימוני פ' ב' משכירות) (וע"ל סימן ס"ו סעיף מ') אבל שבועת היסת נשבעין אפילו על דברים אלו וכן ע"י גלגול נשבעין עליהן והקדשות שאמרו דוקא הקדש גבוה אבל הקדש לעניים או לבהכ"נ או לספר תורה וכיוצא בזה נשבעין עליהם כמו שנשבעין על נכסי הדיוט: הגה וי"א דתלוש ולבסוף חברו בקרקע לאו כקרקע דמי (טור בשם עיטור) ויש חולקין ולכן אם שאל בית ונשרף פטור מלשלם (מרדכי פרק הדיינים וע' לקמן סי' ש"א):
The law of which oath is sworn concerning land, and the law of consecrated property nowadays; it contains six se'ifim. These are the things on which they do not swear by Torah law: land, even outside the Land, and slaves, and documents, and consecrated property; and likewise the property of gentiles — no matter whether one admits part, no matter whether he denies everything and one witness contradicts him, no matter whether it is the oath of the bailees; and even if they were negligent with them and they were lost, they are exempt from paying, whether an unpaid bailee, or a paid bailee, or one who borrows the article; and if he stipulated to pay everything, it follows his stipulation (Maimoni, chapter 2 of the Laws of Hire) (and see above, siman 66, se'if 40). But the oath of hesset (the oath the Sages imposed on one who denies a claim outright) they swear even on these things; and likewise by way of gilgul (the rolling of a further claim into an oath already owed) they swear on them. And the consecrated property of which they spoke is specifically property consecrated to the Most High; but property consecrated for the poor, or for the synagogue, or for a Torah scroll, and the like — they swear on them as they swear on an ordinary person's property. Hagah [Rema]: And some say that what was detached and afterwards attached to the ground is not as land (Tur in the name of the Ittur); and there are those who disagree; and therefore, if he borrowed a house and it burned, he is exempt from paying (Mordechai, chapter "The judges"; and see below, siman 301).

טענו ענבים העומדים ליבצר ותבואה יבשה העומדת ליקצר והודה במקצתן וכפר במקצתן ה"ז נשבע עליהם כשאר המטלטלים והוא שאינם צריכים לקרקע שכל העומד ליבצר הרי הוא כבצור לענין כפירה והודאה אבל אם היו צריכים לקרקע הרי הם כקרקע לכל דבר: הגה י"א דמיירי שתבעו המעות של ענבים אבל אי תבעו ענבים והודה במקצתן אפי' עומדות ליבצר מיקרי הילך (ר"ן שם) ויש חולקין וס"ל דאם תבעו מעות הענבים בכל ענין מיקרי מטלטלין אלא מיירי שתבעו הענבים ומודה במקצתן ואומר שבצרן ואכלן דלא הוי הילך (שם בשם הרשב"א) וע"ל סי' זה ס"ו:
He claimed from him grapes ready to be harvested and dry grain ready to be reaped, and he admitted part of them and denied part of them — he swears on them as on other movables; and this is where they no longer need the ground, for whatever stands ready to be harvested is as harvested with regard to denial and admission; but if they still needed the ground, they are as land in every respect. Hagah [Rema]: Some say that it deals with where he claimed the money for the grapes; but if he claimed the grapes and he admitted part of them, even if they stand ready to be harvested it is called "here it is" (the Ran, there); and there are those who disagree and hold that if he claimed the money for the grapes it is called movables in every case, but it deals with where he claimed the grapes and he admits part of them and says that he harvested them and ate them, which is not "here it is" (there, in the name of the Rashba). Se’if 3ג׳
טענו ב' חדשים שכנת בחצרי ואתה חייב לי שכר ב' חדשים והוא אומר לא שכנתי אלא חדש אחד הרי זה מודה מקצת ואם היה שכר החדש שכפר בו שוה שני כסף נשבע שאין הטענה בגוף הקרקע אלא בשכרה שהוא מטלטלין: הגה וה"ה אם תבעו דמי הקרקע שמכר לו והוא מודה לו במקצת דמים כתבעו ממון הואיל ואינן חלוקים כמה קרקע מכר לו רק על הדמים (המגיד פ"ה מה' טוען) וכן אם תבעו דמי נייר השטרות הוי ממון (שם דין א' בשם רבינו האי):
He claimed from him: "You lived in my courtyard two months, and you owe me the rent of two months", and he says, "I lived only one month" — this one admits part; and if the rent of the month that he denied is worth two silver ma'ot, he swears, for the claim is not on the body of the land but on its rent, which is movables. Hagah [Rema]: And the same holds if he claimed from him the price of the land that he sold him, and he admits part of the price to him — it is as a claim of money, since they do not disagree about how much land he sold him, only about the price (the Maggid, chapter 5 of the Laws of Claimant and Defendant); and likewise if he claimed from him the value of the paper of the documents, it is money (there, law 1, in the name of Rabbeinu Hai).
