Se’if 1א׳

דין גלגול שבועה. ובו ט סעיפים: כל מי שנתחייב שבועה בב"ד אפי' היסת יכול בעל דינו לגלגל עליו כל תביעה שיש לו עליו שאם היה מודה בו היה מתחייב בו ממון (ויש מי שכתב דאם בא לו שבועה ע"י הפוכו שאמר לו הנתבע השבע וטול אין מגלגלין עליו) (ת"ה סי' שכ"ז) ואם אפי' היה מודה בו לא היה מתחייב ממון אלא שבועה אינו יכול לגלגל אבל שכיר שנשבע ונוטל אין מגלגלין עליו אפילו לא תבע התובע לגלגל ב"ד מעצמם מגלגלין:

The law of gilgul (the rolling of a further claim into an oath already owed) of an oath; it contains nine se'ifim. Whoever became obliged to an oath in court, even the oath of hesset (the oath the Sages imposed on one who denies a claim outright), his opponent can roll onto him any claim he has against him which, had he admitted it, would have made him liable for money (and there is one who wrote that if the oath came to him by its being turned over, the defendant having said to him "Swear and take", they do not roll onto him) (Terumat haDeshen, siman 327). And if even had he admitted it he would not have become liable for money but only for an oath, he cannot roll it on. But a hired worker who swears and takes — they do not roll onto him. Even if the plaintiff did not claim to roll it on, the court rolls it on of its own accord.

Se’if 2ב׳

אין מגלגלין אלא כשהנתבע טוען ודאי ונתחייב שבועה אבל אם טוען טענת ספק ונתחייב שבועה אין מגלגלין עליו אבל על טענת ספק של התובע מגלגלין ובלבד שיהיה רגלים לדבר כמו בשבועת השותפים:

They roll on only when the defendant pleads with certainty and became obliged to an oath; but if he pleads a claim of doubt and became obliged to an oath, they do not roll onto him. But on the plaintiff's claim of doubt they do roll on, provided there are grounds for the matter, as with the oath of partners.

Se’if 3ג׳

מי שנתחייב שבועה והתחיל התובע לגלגל עליו דברים אחרים שלא טען אותם וראה הנתבע כך ואמר איני רוצה להשבע אלא הריני משלם הטענה הראשונ' שנתחייבתי על כפירתה שבועה אין שומעין לו אלא אומרים לנתבע או תן לו כל מה שגלגל עליך מהטענות הודאיות או השבע (ואפי' רוצה ליתן לו דמי הגלגולים והתובע רוצה הדברים עצמן שתובע) (נ"י פ' המפקיד) אבל אם טען עליו התובע טענת ספק ורצה הלה לשלם עיקר תביעתו אינו חייב על הגלגולין לשלם:

One who became obliged to an oath, and the plaintiff began to roll onto him other matters that he had not pleaded, and the defendant saw this and said, "I do not want to swear; rather, I will pay the first plea, on whose denial I became obliged to an oath" — they do not listen to him; but they say to the defendant: either give him everything he rolled onto you of the certain pleas, or swear (and even if he wants to give him the value of the rolled-on claims, and the plaintiff wants the very things that he claims) (Nimukei Yosef, chapter "One who deposits"). But if the plaintiff pleaded against him a claim of doubt, and this one wanted to pay the principal of his claim, he is not obliged to pay the rolled-on claims.
