דין שבועת ספק ושבועת השותפין. ובו יח סעיפים: אלו נשבעים בטענת שמא השותפים והאריסים והאפוטרופסים שמינו אותם ב"ד על היתומים והאשה שהיא נושאת ונותנת בתוך הבית או שהושיבה בעלה חנונית ובן הבית שהוא נושא ונותן בענייני בעל הבית כל אחד מאלו נשבע מדבריהם בנקיטת חפץ בטענת ספק שמא גזל חבירו במשא ומתן או שמא לא דקדק בחשבון שביניהם ואין כל אחד מאלו נשבע בטענת ספק עד שיחשוד המשביע אותן בשתי מעין כסף: הגה בין בקרן בין בריוח (הגהות מרדכי פ' כל הנשבעין) וכל אלו יכולין להשביע אימת שירצה ואינן צריכין להמתין עד שיחלוקו וישביעם לבסוף (הרא"ש פ' אלמנה ניזונית):

The law of the oath on doubt and the oath of partners; it contains eighteen se'ifim. These swear on a claim of "perhaps": partners, and sharecroppers, and guardians whom the court appointed over orphans, and the wife who conducts the business within the house or whom her husband set up as a shopkeeper, and the member of the household who conducts the householder's affairs. Each one of these swears by their words, while holding a sacred object, on a claim of doubt — "perhaps he robbed his fellow in the dealings", or "perhaps he was not exact in the account between them". And none of these swears on a claim of doubt until the one making them swear suspects them of two silver ma'ot. Hagah [Rema]: Whether in principal or in profit (Hagahot Mordechai, chapter "All who swear"). And all these can be made to swear whenever he wishes, and he need not wait until they divide and make them swear at the end (the Rosh, chapter "A widow is maintained").

Se’if 2ב׳

אע"פ שאין עדים שזה שותפו או אריסו (עיין לקמן סי' קמ"ט) אלא הוא מודה בפני עצמו ואומר שותפו אני או אריסו או בן ביתו אבל לא גזלתי כלום הרי זה נשבע (דאין אומרים) מיגו ליפטר מן השבועה (טור בשם הרמב"ם והר"י הלוי פ' הנשבעין):

Even though there are no witnesses that this one is his partner or his sharecropper (see below, siman 149), but he admits on his own and says, "I am his partner", or "his sharecropper", or "a member of his household, but I robbed nothing" — he swears, (for we do not say) a migo (a plea he could have made in which he would have been believed) to be exempted from the oath (Tur in the name of the Rambam and Rabbi Yosef haLevi, chapter "Those who swear").
