Se’if 1א׳

דין החשוד על השבועה. ובו יד סעיפים: החשוד על השבועה אין משביעים אותו לא שבועת התורה ולא שבועה של דבריהם ואם אמר התובע אקבל שבועתו אע"פ שהוא חשוד אין שומעין לו:

The law of one suspected regarding the oath; it contains fourteen se'ifim. One suspected regarding the oath — they do not make him swear, neither an oath by Torah law nor an oath by their words; and if the plaintiff said, "I will accept his oath even though he is suspected", they do not listen to him.

Se’if 2ב׳

נקרא חשוד מי שנשבע לשקר אחד שבועת העדות ואחד שבועת הפקדון ושבועת שוא וביטוי (טור ס"ג בשם הרא"ש) ואפי' עבר על חרם שהחרימו הקהל (טור בשם רש"י) ויש אומרים דדוקא בשבועה דלשעבר כגון אכלתי ולא אכלתי שבשעה שיצאה שבועה מפיו יצאה לשקר אבל בשבועה דלהבא כגון שלא אוכל ואכל לא:

One is called suspected who swore falsely — whether the oath of testimony, or the oath of deposit, or a vain oath, or an oath of utterance (Tur, se'if 3, in the name of the Rosh); and even if he transgressed a cherem (the severer form of the ban) that the community pronounced (Tur in the name of Rashi). And some say this is only with an oath about the past, such as "I ate" or "I did not eat", where at the moment the oath left his mouth it left it falsely; but with an oath about the future, such as "that I will not eat", and he ate — no.

וכן הפסול לעדות מחמת עבירה בין עבירה של תורה כגון מלוה ברבית או אוכל נבילות וכיוצא בהם בין של דבריהם כגון מפריחי יונים ומשחקים בקוביא נקרא חשוד וכל מי שחשוד ליקח ממון חבירו חשוד על השבועה ודוקא שיש עדים שלקח ממון חבירו אבל בלא עדים אינו חשוד דשמא (ספק) מלוה ישנה יש לו עליו שבשביל כך תפס אותו:

And likewise one disqualified from testimony on account of a transgression — whether a transgression of the Torah, such as one who lends at interest, or eats nevelah (an animal that died without valid slaughter), and the like; or of their words, such as pigeon-racers and dice-players — is called suspected. And whoever is suspected of taking his fellow's money is suspecteded regarding the oath; and this is only where there are witnesses that he took his fellow's money, but without witnesses he is not suspected, for perhaps (doubtful) he has an old loan against him, on account of which he seized it.
