חנוני נשבע ונוטל ודין פנקסים. ובו ט סעיפים: חנוני נאמן על פנקסו כיצד בעל הבית שאמר לחנוני תן לפועלי סלע והוא מודה שא"ל כן או שיש עדים בדבר והחנוני אומר כבר נתתי להם והפועלים אומרים לא קבלנו ממנו כלום שניהם נשבעין כעין של תורה ונוטלים מבע"ה וצריכים שישבעו כל אחד בפני חבירו חנוני בפני פועלים ופועלים בפני חנוני כדי שיתביישו יותר (ודוקא בדאיתנהו לתרווייהו) (ר"ן פרק הנשבעין) והוא הדין אם א"ל הלויני מנה ופרע לבעל חובי זה אומר נתתי וזה אומר לא קבלתי ישבעו שניהם זה בפני זה ויתן בעה"ב לשניהם (ואין נשבעין ביחד אלא בזה אחר זה) (הגהות שניות דמרדכי ריש ב"מ):
The shopkeeper swears and takes, and the law of ledgers; it contains nine se'ifim. The shopkeeper is believed on his ledger. How so? A householder who said to the shopkeeper, "Give my workers a sela", and he admits that he said so to him, or there are witnesses to the matter; and the shopkeeper says, "I have already given it to them", and the workers say, "We received nothing from him" — both of them swear in the manner of the Torah's oath and take from the householder; and each must swear in the presence of the other, the shopkeeper in the presence of the workers and the workers in the presence of the shopkeeper, so that they will be more ashamed (and this is only where both of them are here) (the Ran, chapter "Those who swear"). And the same holds if he said to him, "Lend me a maneh (a hundred zuz) and pay it to this creditor of mine": this one says, "I gave it", and that one says, "I did not receive it" — both of them swear, this one in the presence of that one, and the householder gives to both of them (and they do not swear together, but one after the other) (Hagahot Sheniyot of Mordechai, beginning of Bava Metzia).

בד"א כששניהם לפנינו ותובעים מבעה"ב אבל אם מת החנוני והפועלים לבדם תובעים או שמתו פועלים והחנוני לבדו תובע נוטל בלא שבועה שהרי אין בעל הבית מפסיד כלום שהרי אינו משלם אלא תשלום אחד: הגה וי"א דדוקא באם מת החנוני ואתו פועלים נוטלין בלא שבועה דהרי ודאי נתחייב להם ולא ידע אי פרע אבל אם מתו הפועלים והחנוני בא לתבוע מה שנתן לא יטול אלא בשבועה דילמא לא נתן כלום (טור בשם הרמ"ה והמגיד פט"ז דמלוה ור"ן פרק הנשבעין ופרק האיש מקדש):
In what case are these words said? When both of them are before us and claiming from the householder; but if the shopkeeper died and the workers alone claim, or the workers died and the shopkeeper alone claims, he takes without an oath, for the householder loses nothing, since he pays only one payment. Hagah [Rema]: And some say that only if the shopkeeper died and the workers come do they take without an oath, for he certainly became obliged to them and does not know whether he paid; but if the workers died and the shopkeeper comes to claim what he gave, he takes only with an oath, for perhaps he gave nothing (Tur in the name of the Ramah, and the Maggid, chapter 16 of the Laws of Lender and Borrower, and the Ran, chapter "Those who swear" and chapter "A man betroths").

בד"א בחנוני המקיף (פי' נותן בהמתנה) לבעל הבית ופורע לו כל חובותיו ואח"כ פורע לו בעל הבית אבל אם הקדים בע"ה מעות לחנוני וא"ל תן לפועלים סלע אם המחם (פי' הישיר ומסר הפועל לחנוני מן ומחה על כתף ים כנרת) אצל חנוני במעמד שלשתם והפועלי' נתרצו אין לפועלים על בעל הבית כלום והחנוני נשבע היסת ונפטר ואם שלא במעמד שלשתם המחם אצל חנוני נשבע חנוני לבעל הבית היסת שעש' שליחותו ונפטר והפועלי' נשבעי' לבעל הבית כעין של תורה שלא נטלו כלום מחנוני ונוטלים מבע"ה וי"א שגם זו היא שבועת היסת: הגה מי שהוציא הוצאות על נכסי חבירו ברשות חבירו ותובע ההוצאות והנתבע אינו יודע (כמה) נשבע התובע ונוטל וה"ה בכל מידי דהאי ידע והאי לא ידע נשבע האי דידע (מהרי"ק שורש י' ותשובת מיימוני ספר קנין סי' ז'):
In what case are these words said? With a shopkeeper who extends credit (that is, gives on deferred payment) to the householder and pays all his debts for him, and afterwards the householder repays him. But if the householder advanced money to the shopkeeper and said to him, "Give the workers a sela" — if he assigned them (that is, directed and handed the worker over to the shopkeeper; from "and shall strike upon the side of the sea of Chinnereth") to the shopkeeper in the presence of the three of them, and the workers agreed, the workers have nothing against the householder, and the shopkeeper swears the oath of hesset (the oath the Sages imposed on one who denies a claim outright) and is exempt. And if he assigned them to the shopkeeper not in the presence of the three of them, the shopkeeper swears the oath of hesset to the householder that he carried out his agency, and is exempt; and the workers swear to the householder, in the manner of the Torah's oath, that they took nothing from the shopkeeper, and take from the householder; and some say that this too is an oath of hesset. Hagah [Rema]: One who laid out expenses on his fellow's property with his fellow's permission and claims the expenses, and the defendant does not know (how much) — the plaintiff swears and takes; and the same holds in any matter where this one knows and that one does not know: the one who knows swears (Maharik, shoresh 10, and Teshuvot Maimoniyot, Sefer Kinyan, siman 7).
