Se’if 1א׳
הניזקין נשבעין ונוטלין כגון הנגזל והנחבל ודין המביא כלים מבית בעה"ב והוא אומר שאולים הם. ובו טז סעיפים: הנגזל כיצד ראוהו עדים שנכנס לתוך ביתו של חבירו למשכנו שלא ברשות ולא היה (לו) כלום תחת כנפיו וכשיוצא ראוהו שהיו כלים תחת כנפיו ואינם יודעים מה הם ובעל הבית תובע תן לי כך וכך שגזלתני בין אם יאמר כן נכנסתי למשכנך אבל לא נטלתי כלום והכלים שהוצאתי תחת כנפי שלי הם בין אם יאמר מעולם לא נכנסתי לביתך ליטול ממך כלום בין אם יאמר לא נטלתי אלא כלי זה ובע"ה אומר נטלת עוד אחרים אפי' העדים מכירים קצת הכלים ובעל הבית טוען שהטמין יותר ממה שראו העדים בכל אלו ב"ה נשבע בנקיטת חפץ ונוטל כל מה שיטעון והוא שיטענו דברים שהוא אמוד בהם או שהוא אמוד שמפקידים אצלו אותן דברים שטען ויהיו אותן דברים שטען דברים שאיפשר שינטל תחת הכנפים: הגה ויש אומרים דבעינן נמי שטוען מידי דאורחיה לאנוחי במקום שנכנס לשם (טור בשם הרמ"ה) והכי מסתברא ואם טענו דברים שאינו אמוד בהם או דברים שאינם נטלים תחת הכנפים יש מי שאומר שהנתבע נשבע היסת ונפטר ויש מי שאומר שאינו נשבע אלא מחרימים על מי שכופר ממון חבירו ואינו משלם לו:
The injured swear and take, such as the one robbed and the one wounded; and the law of one who brings out vessels from a householder's house and says they are borrowed; it contains sixteen se'ifim. The one robbed — how so? Witnesses saw him enter his fellow's house to take a pledge from him without permission, and (he) had nothing under his garment; and when he came out they saw that there were vessels under his garment, and they do not know what they are; and the householder claims, "Give me such-and-such that you robbed from me" — whether he says, "Yes, I entered to take a pledge from you, but I took nothing, and the vessels I brought out under my garment are mine"; whether he says, "I never entered your house to take anything of yours"; whether he says, "I took only this vessel", and the householder says, "You took others too" — even if the witnesses recognize some of the vessels, and the householder pleads that he hid more than the witnesses saw — in all these the householder swears while holding a sacred object and takes whatever he pleads; and this is where he pleads things he is reckoned to own, or he is reckoned to be one with whom the things he pleaded are deposited, and the things he pleaded are things that could be taken under the garment. Hagah [Rema]: And some say that we also require that he plead something whose way is to be kept in the place he entered (Tur in the name of the Ramah), and so it stands to reason. And if he pleaded things he is not reckoned to own, or things that are not taken under the garment, there is one who says that the defendant swears the oath of hesset (the oath the Sages imposed on one who denies a claim outright) and is exempt; and there is one who says that he does not swear, but they pronounce a cherem (the severer form of the ban) on whoever denies his fellow's money and does not pay him.
Se’if 2ב׳
ראוהו עדים שנכנס למשכן את חבירו ולא ראוהו בעת שיצא או שיצא ולא נראה תחת כנפיו כלום ובעל הבית טוען ואומר כך וכך אפי' אמר מעולם לא נכנסתי שהרי מכחיש את העדים הרי זה פטור שאם אמר נכנסתי ולא נטלתי נשבע היסת שלא נטל כלום והולך שאפשר שנכנס לגזול ולא גזל (וי"א כיון שהעדים מכחישין אותו שאינו נאמן בשבועה דהוי מיגו במקום עדים שאינו נאמן אלא ב"ה נשבע ונוטל) (טור):
Witnesses saw him enter to take a pledge from his fellow, and did not see him at the time he came out, or he came out and nothing was seen under his garment, and the householder pleads and says "such-and-such" — even if he said, "I never entered", for he contradicts the witnesses, he is exempt; for had he said, "I entered and took nothing", he would swear the oath of hesset that he took nothing, and go, since it is possible that he entered to rob and did not rob (and some say that since the witnesses contradict him he is not believed with an oath, for it is a migo (a plea he could have made in which he would have been believed) in the face of witnesses, where he is not believed; rather, the householder swears and takes) (Tur).
Se’if 3ג׳
היה עד אחד מעידו שנכנס למשכנו ונטל כלים תחת כנפיו ואינו יודע מה הם והוא אומר לא גזלתי כלום או שאמר בחובי נטלתי הואיל ואין העד יודע מהו תחת כנפיו ה"ז נשבע שלא גזל (וע"ל סי' ע"ה סעיף י"ג וסי' שס"ד ס"ג):
If one witness testifies that he entered to take a pledge from him and took vessels under his garment, and he does not know what they are, and he says, "I robbed nothing", or said, "I took them for my debt" — since the witness does not know what is under his garment, he swears that he did not rob (and see above, siman 75, se'if 13, and below, siman 364, se'if 3).
