Se’if 1א׳

שהשכיר נשבע ונוטל. ובו ו סעיפים: כל הנשבעין שבתורה נשבעין ולא משלמין ואלו נשבעין ונוטלים השכיר והנגזל והנחבל והחנוני על פנקסו ושכנגדו חשוד על השבועה:

That the hired worker swears and takes; it contains six se'ifim. All who swear under the Torah swear and do not pay; and these swear and take: the hired worker, and the one robbed, and the one wounded, and the shopkeeper on his ledger, and one whose opponent is suspecteded regarding the oath.

השכיר כיצד השכיר שעושה מלאכה אצל בע"ה ותבע שכרו ואמר ליה בעה"ב פרעתיך כל שכרך או קצתו אפי' היה שכרו פרוטה ובעל הבית אומר נתתיה נשבע השכיר בנק"ח כעין של תורה ונוטל אפי' היה השכיר תובע את הקטן הרי זה נשבע ונוטל: הגה היה השכיר קטן או עבד או חשוד נשבע בעל הבית ונפטר (טור בשם הראב"ד ור"ן פרק הנשבעים) השכיר נשבע ונוטל מיורשי בעה"ב אם תבעו בזמנו אבל אין יורשי השכיר נשבעין ונוטלין (ב"י בשם הרשב"א):

The hired worker — how so? A hired worker who does work for a householder and claimed his wage, and the householder said to him, "I have paid you all your wage", or part of it — even if his wage was a perutah, and the householder says, "I gave it" — the hired worker swears while holding a sacred object, in the manner of the Torah's oath, and takes; even if the hired worker is claiming from a minor, he swears and takes. Hagah [Rema]: If the hired worker was a minor, or a slave, or suspected, the householder swears and is exempt (Tur in the name of the Raavad, and the Ran, chapter "Those who swear"). The hired worker swears and takes from the householder's heirs, if he claimed within his time; but the hired worker's heirs do not swear and take (Beit Yosef in the name of the Rashba).

בד"א כשיש עדים ששכרו ושעשה עמו מלאכה אבל אם לא היו שם שני עדים מתוך שיכול לומר לא שכרתיך נאמן לומר שכרתיך ונתתי לך שכרך וישבע בעל הבית היסת (רמב"ם מביאו הטור) ואם הודה מקצת ישבע שבועת התורה: הגה וי"א דאפי' כופר כולו ושכרו בעד אחד בעל הבית ישבע שבועה דאורייתא (טור והרמ"ה) וכן אם תבעו אחר זמנו אע"פ ששכרו בעדים המוציא מחבירו עליו הראיה ואם לא הביא ראיה ישבע בעל הבית היסת וכמה הוא זמנו שכיר יום כל הלילה שלאחריו ושכיר לילה כל היום שלאחריו הביא ראיה שתבעו כל זמנו ה"ז נשבע ונוטל כל אותו יום של תביעה כיצד היה עושה עמו ביום שני עד הערב זמנו כל ליל שלישי וביום שלישי אינו נשבע ונוטל ואם הביא עדים שהיה תובע כל ליל שלישי הרי זה נשבע ונוטל כל יום שלישי אבל מליל רביעי ואילך המוציא מחבירו עליו הראיה (שם ברמב"ם ומביאו הטור) וכן אם הביא עדים שהיה תובע והולך עד יום חמישי ה"ז נשבע ונוטל כל יום חמישי:

In what case are these words said? When there are witnesses that he hired him and that he did work with him; but if there were no two witnesses there, since he can say, "I did not hire you", he is believed to say, "I hired you and gave you your wage", and the householder swears the oath of hesset (the oath the Sages imposed on one who denies a claim outright) (the Rambam; the Tur brings it). And if he admitted part, he swears the oath by Torah law. Hagah [Rema]: And some say that even if he denies all of it, and he hired him before one witness, the householder swears an oath by Torah law (Tur and the Ramah). And likewise if he claimed from him after his time, even though he hired him before witnesses, the one who takes from his fellow bears the burden of proof; and if he did not bring proof, the householder swears the oath of hesset. And how long is his time? A day-worker — the whole night after it; and a night-worker — the whole day after it. If he brought proof that he claimed from him all his time, he swears and takes the whole of that day of the claim. How so? He was working with him on the second day until evening — his time is the whole of the third night, and on the third day he does not swear and take; and if he brought witnesses that he was claiming the whole third night, he swears and takes the whole third day; but from the fourth night on, the one who takes from his fellow bears the burden of proof (there, in the Rambam, and the Tur brings it). And likewise if he brought witnesses that he went on claiming until the fifth day, he swears and takes the whole fifth day.
