ראובן נושה בשמעון ושמעון בלוי מוציאין מלוי ונותנין לראובן. ובו ט סעיפים: ראובן שנושה ק' בשמעון ושמעון בלוי מוציאין מלוי ונותנין לראובן ל"ש אם נתחייב לו כבר לשמעון בשעה שלוה מראובן ל"ש נתחייב לו אח"כ ואין חילוק בזה בין מלוה בשטר למלו' על פה כיון ששני הלווים מודים כל אחד למלוה שלו מוציאין מלוי ונותנים לראובן בכל ענין שיתחייב לוי לשמעון בין דרך הלואה שהלוה לו בין דרך מקח וממכר בין דרך שכירות: הגה ראובן שיש לו משכון מן העכו"ם והעכו"ם חייב לשמעון י"א דיוכל שמעון לפדות המשכון מראובן ונותן לו קרן ורבית שעלה עליו וגובה חובו מן המותר (תשו' מהרי"ל סי' קפ"ח) וכן נ"ל מאחר שאין לעכו"ם לפרוע בענין אחר שמעון יש לו כל זכות העכו"ם ואע"פ שיש מי שחולק בזה (ב"י סי' ע"ד) נראה לדון כמו שכתבתי:

Reuven is a creditor of Shimon, and Shimon of Levi: they take it from Levi and give it to Reuven; it contains nine se'ifim. Reuven is a creditor of Shimon for a hundred, and Shimon of Levi — they take it from Levi and give it to Reuven; no matter whether Levi was already obliged to Shimon at the time Shimon borrowed from Reuven, no matter whether he became obliged to him afterwards. And there is no distinction in this between a loan by document and a loan by word of mouth; since the two borrowers each admit to his own lender, they take it from Levi and give it to Reuven, in whatever way Levi became obliged to Shimon — whether by way of a loan that he lent him, or by way of buying and selling, or by way of hire. Hagah [Rema]: Reuven who has a pledge from a gentile, and the gentile owes Shimon — some say that Shimon can redeem the pledge from Reuven, giving him the principal and the interest that has accrued on it, and collect his debt from the excess (responsum of Maharil, siman 188); and so it seems to me, since the gentile has nothing else to pay with, Shimon has every right of the gentile; and even though there is one who disagrees on this (Beit Yosef, siman 74), it seems right to judge as I have written.

Se’if 2ב׳

בד"א כשאין לשמעון נכסים ליפרע ממנו שסידרו לו ב"ד והשביעוהו ולא מצאו לו אלא חוב זה (אע"פ שיש לו נכסים במדינה אחרת) (ריב"ש סי' שנ"ג) אבל אם יש לו במדינה זו נכסים אין ב"ד נזקקים להוציא מזה ולתת לזה:

In what case are these words said? When Shimon has no property from which to be repaid — the court having made the arrangement (the necessities the court sets aside for a debtor) for him and made him swear, and they found for him nothing but this debt (even though he has property in another country) (Rivash, siman 353); but if he has property in this country, the court does not undertake to take from this one and give to that one.

Se’if 3ג׳

אף בזמן שאין לשמעון נכסים אין ראובן יכול לכופו שיתבע מלוי ויפרענו שאין מוטל עליו זה הטורח אלא על ראובן לטרוח ולהוציא מלוי:

Even when Shimon has no property, Reuven cannot compel him to claim from Levi and repay him, for this trouble is not laid on him; rather it is on Reuven to take the trouble and get it out of Levi.
