Se’if 1א׳
הוציא שטר חוב והלה טוען שמכר לו שדהו. ובו ז סעיפים: ראובן שהוציא שטר חוב על שמעון ושמעון הוציא שטר שראובן מכר לו שדהו אחר שהגיע זמן שטרו ואומר אלו חייב הייתי לך היה לך ליפרע ממני ולא למכור לי שדך אם הוא במקום שנוהגין שמי שקונה שדה נותן מעות ואח"כ כותבין לו שטר טענתו טענה שלא היה לו לכתוב שטר המכירה אחר שקבל המעות ונאמן הלוה לומר פרעתי ושובר היה לי ואבד ואפי' שיש בו נאמנות ואם אומר מזוייף הוא יש מי שאומר שאינו נאמן כיון שהוא מקויים וי"א שהוא נאמן ואם עדיין לא הגיע זמן שטרו אין טענתו טענה ואם הוא במקום שכותבין שטר ואח"כ נותנים מעות אע"פ שהגיע זמנו אין טענתו טענה שזה יאמר לא מכרתי לך השדה אלא כדי שיהיה לי ממה לגבות חובי:
One produced a document of debt, and the other pleads that he sold him his field; it contains seven se'ifim. Reuven produced a document of debt against Shimon, and Shimon produced a document that Reuven sold him his field after the term of his document had come, and he says, "Had I owed you, you should have been repaid from me and not sold me your field" — if it is in a place where the custom is that one who buys a field gives the money and afterwards they write him the document, his plea is a plea, for he should not have written the document of sale after he received the money; and the borrower is believed to say, "I repaid, and I had a receipt and it was lost", even if there is a clause of trust (a clause making the lender believed as to non-payment) in it. And if he says, "It is forged", there is one who says that he is not believed, since it is confirmed; and some say that he is believed. And if the term of his document had not yet come, his plea is not a plea. And if it is in a place where they write the document and afterwards give the money, even though its term had come his plea is not a plea, for this one will say, "I sold you the field only so that I would have something from which to collect my debt."

אם הלוה מכר קרקע למלוה אחר שהגיע זמן פריעת שטרו אפי' במקום שנותנים מעות ואח"כ כותבים שטר יכול לומר לו אלו חייב הייתי לך היה לך לטרוף השדה כשמכרתיו לך: הגה אבל אם מכר לו מטלטלין לא יכול לומר אלו הייתי חייב למה לא תבעת ממני בחובך דזה יוכל לו' אילו תבעתי יראתי שלא תמכור לי כלל (תשו' מיימוני ספר משפטים):
If the borrower sold land to the lender after the term of repayment of his document had come — even in a place where they give the money and afterwards write the document — he can say to him, "Had I owed you, you should have seized the field when I sold it to you." Hagah [Rema]: But if he sold him movables, he cannot say, "Had I owed you, why did you not claim your debt from me?", for this one can say, "Had I claimed, I was afraid that you would not sell to me at all" (Teshuvot Maimoniyot, Sefer Mishpatim).

ראובן הוציא שטר על שמעון ושמעון על ראובן מאוחר לשטרו של ראובן והגיע זמן הפרעון של ראובן קודם שלוה משמעון יכול שמעון לומר לראובן אלו הייתי חייב לך לא הי' לך ללות ממני אלא היה לך ליפרע מחובך: הגה ודוקא שהשטר ברור אבל אם יש טענה על השטר כגון שיש בו חשש אסמכתא או כדומה יכול לומר הייתי מתיירא שא"א לי לגבות בשטרי מכח אסמכתא על כן הוצרכתי ללות כי לא היה לי פנאי לדון לנגוש אותך (תשו' הרא"ש כלל מ"ב סי' ב') ויש מי שאומר דלא שנא באתרא דיהבי זוזי והדר כתבי שטרא ול"ש באתרא דכתבי שטרא והדר יהבי זוזי וי"א דה"מ באתרא דיהבי זוזי והדר כתבי שטרא ואפי' אם יש לראובן זבורית ולשמעון עידית אינו יכול לומר לויתי ממך כדי שאגבה ממך עידית ואגבה אותך הזבורית ואם הוא באתרא דכתבי שטרא והדר יהבי זוזי אינו יכול לומר לו היה לך ליפרע מחובך אלא כל אחד גובה חובו ומיהו אם יש לשניהם עידית או בינונית או זיבורית או שיש לאחד עידית או בינונית ולשני זיבורית עומד כל אחד בשלו וכן אם יש לזה בינונית וזיבורית ולזה זיבורית עומד כל אחד בשלו אבל אם יש לזה עידית ובינונית ולזה זבורית זה גובה וזה גובה ואם זמן השטר שמוציא שמעון על ראובן היה קודם שהגיע זמנו של שטר של ראובן אז בכל ענין יעמוד כל אחד בשלו שאין יכול לומר היה לך ליפרע מחובך שהרי עדיין לא הגיע זמנו אפי' היה ביום אחרון כגון שראובן הלוה לשמעון בשטר לחמשה שנים וביום שנשלמו הה' שנים בא ראובן ולוה משמעון לעשר שנים אין שמעון יכול לומר לראובן אלו חייב הייתי לך למה שעבדת עצמך בשביל יום אחד וגובה זה שלו לסוף חמש שנים וזה שלו לסוף י' שנים: הגה ראובן שתובע משמעון לשלם לו והשיב לו שמעון הלא אתה פרעת לי זה השבוע ולמה לא עכבת בחובך וראובן אומר האמנתיך נאמן במיגו דיוכל לומר לא פרעתיך או עדיין לא הגיע זמני אז שתפרעני (מרדכי פ' ב' דייני גזירות) אשה שהקדישה נכסיה וצותה שידורו בנותיה בבתים ויתנו שכירות ואח"כ הביאה בת אחת שטר מתנה מוקדם לשטר מתנה של הקדש ושאר היורשים אומרים אילו היה שטרך אמת למה נתת שכירות אם הבת נותנת אמתלא על השכירות הדין עמה ואם לאו הדין עם היורשין (תשו' הרא"ש כלל ע' סי' ב'):
Reuven produced a document against Shimon, and Shimon against Reuven, later than Reuven's document, and the term of repayment of Reuven's had come before he borrowed from Shimon — Shimon can say to Reuven, "Had I owed you, you should not have borrowed from me, but should have been repaid from your debt." Hagah [Rema]: And this is only where the document is clear; but if there is a claim against the document — for example, there is in it a concern of asmachta (an undertaking made to hang on a condition), or the like — he can say, "I was afraid that I could not collect with my document because of asmachta; therefore I needed to borrow, for I did not have leisure to go to law to press you" (responsum of the Rosh, klal 42, siman 2). And there is one who says there is no difference between a place where they give the money and then write the document and a place where they write the document and then give the money. And some say this applies only in a place where they give the money and then write the document; and even if Reuven has the poorest land and Shimon choice land, he cannot say, "I borrowed from you so that I could collect choice land from you while you would collect the poorest land from me". And if it is in a place where they write the document and then give the money, he cannot say to him, "You should have been repaid from your debt", but each one collects his debt. However, if both have choice land, or middling, or the poorest; or one has choice or middling and the other the poorest — each one stands on his own; and likewise if this one has middling and the poorest and that one the poorest, each one stands on his own; but if this one has choice and middling and that one the poorest, this one collects and that one collects. And if the date of the document that Shimon produces against Reuven was before the term of Reuven's document had come, then in every case each one stands on his own, for he cannot say, "You should have been repaid from your debt", since its term had not yet come — even if it was on the last day. For example, Reuven lent to Shimon by document for five years, and on the day the five years were completed Reuven came and borrowed from Shimon for ten years — Shimon cannot say to Reuven, "Had I owed you, why did you bind yourself for the sake of one day?", and this one collects his at the end of five years and that one his at the end of ten years. Hagah [Rema]: Reuven who claims from Shimon that he should pay him, and Shimon answered him, "But you paid me this week — why did you not hold it back for your debt?", and Reuven says, "I trusted you" — he is believed by a migo (a plea he could have made in which he would have been believed), for he could say, "I did not repay you", or "my term to repay you had not yet come then" (Mordechai, chapter "Two judges of decrees"). A woman who consecrated her property and instructed that her daughters should live in the houses and pay rent, and afterwards one daughter brought a document of gift dated earlier than the document of gift of the consecration, and the other heirs say, "Had your document been true, why did you pay rent?" — if the daughter gives an explanation for the rent, the law is with her; and if not, the law is with the heirs (responsum of the Rosh, klal 70, siman 2).
