Se’if 1א׳
הפוגם או פוחת שטרו או עד אחר מעיד שהוא פרוע. ובו ה סעיפים: הפוגם שטרו לא יפרע אלא בשבועה אע"פ שלא טען הלוה השבע לי כיצד הרי ששטרו אלף זוז וטען הלוה פרוע כולו ומלוה אומר לא נפרעתי אלא מקצתו לא יפרע את השאר אלא בשבועה כעין של תורה אפי' היו עדים בשעת הפרעון או שכתב לו שובר במה שפרע ולא אמרינן אם איתא דפרע טפי בעדים הוה פרע ליה כדפרעיה מעיקרא או היה כותב לו שובר ואפי' דקדק לצרף בחשבונו אפי' פחות משוה פרוטה לא אמרינן כיון שדקדק כל כך קושטא קאמר ואם יש בו נאמנות אע"פ שלא פירש בין בכולו בין במקצתו נוטל בלא שבועה:
One who impairs his document, or reduces his document, or one witness testifies that it is paid; it contains five se'ifim. One who impairs his document is paid only with an oath, even though the borrower did not plead "Swear to me". How so? His document was for a thousand zuz, and the borrower pleaded, "All of it is paid", and the lender says, "I was repaid only part of it" — he is paid the rest only with an oath in the manner of the Torah's, even if there were witnesses at the time of the repayment, or he wrote him a receipt for what he paid; and we do not say, "If it were so that he paid more, he would have paid it before witnesses, as he paid it at the start, or he would have written him a receipt". And even if he was exact in adding up his account to less than a perutah's worth, we do not say, "Since he was so exact, he is telling the truth". And if there is a clause of trust (a clause making the lender believed as to non-payment) in it, even though he did not specify whether for all of it or for part of it, he takes without an oath.
Se’if 2ב׳
בד"א כשעבר זמנו אבל אם הוא תוך זמנו אע"פ שפגם שטרו יפרע שלא בשבועה אא"כ טען הלוה ישבע לי:
In what case are these words said? When its term has passed; but if it is within its term, even though he impaired his document he is paid without an oath, unless the borrower pleaded, "Let him swear to me."
Se’if 3ג׳
כתוב בו פרעון ביני שיטי לא חשוב כפוגם שטרו לחייבו שבועה (וע"ל סי' מ"ד ס"ו וסוף סי' מ"ה) שטר שכתוב בו פרעון ביני שיטי ת' זהובים על הגרר וטוען הלוה שפרע יותר והמלוה גרר מקום הפרעון וחזר וכתב מה שרצה אם כתב הפרעון הוא כתב יד הלוה הדין עם המלוה:
If repayment is written in it between the lines, he is not counted as one who impairs his document so as to oblige him to an oath (and see above, siman 44, se'if 6, and the end of siman 45). A document in which is written between the lines a repayment of four hundred gold pieces over an erasure, and the borrower pleads that he paid more, and that the lender scraped out the place of the repayment and wrote over it what he wished — if the writing of the repayment is the borrower's handwriting, the law is with the lender.
