דין שטר שאינו מקוים או מקוים שהלוה טוען אמנה או פרוע או רבית ודין תנאי השטר והשבועה. ובו יג סעיפים: מלוה שהוציא שטר שאינו מקוים ואינו מוציא עדים לקיימו והלוה מודה שכתבו אלא שטוען פרעתי נאמן ואפי' אם כתוב בו נאמנות אינו מועיל וה"ה לכל מה שיטעון בו דבר שמבטל השטר כגון אמנה או כתבתי ללות ולא לויתי או על תנאי נעשה ולא נתקיים התנאי (או שאמר קטן הייתי כשנכתב השטר נאמן) (נ"י פ' מי שמת) ואם אח"כ מצא המלוה עדים לקיים השטר בב"ד הרי הוא כשאר השטרות וגובה בו: הגה אמר תחלה מזויף השטר ואחר שהביא עדים לקיימו אמר הלוה פרוע י"א דהוחזק כפרן ואינו נאמן מאחר שאמר מזויף כאלו אמר לא לויתי ואינו נאמן אח"כ לומר פרעתי (נ"י סוף ב"ב) ויש חולקין ואומרים דנאמן הוא דהא לא כפר בהלואה רק שאומר שהשטר מזוייף ורצה לומר שיקיימנו ואח"כ ידין עמו (הרשב"א):
The law of a document that is not confirmed, or confirmed, where the borrower pleads "trust" or "paid" or "interest"; and the law of the conditions of a document, and the oath; it contains thirteen se'ifim. A lender who produced a document that is not confirmed, and does not produce witnesses to confirm it, and the borrower admits that he wrote it but pleads "I repaid" — he is believed; and even if a clause of trust (a clause making the lender believed as to non-payment) is written in it, it does not help. And the same holds for anything he pleads about it that annuls the document — for example, "it is a trust document (one written in trust before any money was given)", or "I wrote it in order to borrow and did not borrow", or "it was made on a condition and the condition was not fulfilled" (or he said, "I was a minor when the document was written" — he is believed) (Nimukei Yosef, chapter "One who died"). And if afterwards the lender found witnesses to confirm the document in court, it is like all other documents and he collects with it. Hagah [Rema]: He said at first, "The document is forged", and after he brought witnesses to confirm it the borrower said, "It is paid" — some say that he is established as a denier and is not believed, for since he said "forged", it is as though he said "I did not borrow", and he is not believed afterwards to say "I repaid" (Nimukei Yosef, end of Bava Batra); and there are those who disagree and say that he is believed, for he did not deny the loan but only says that the document is forged, and meant that he should confirm it and afterwards he would go to law with him (the Rashba).

ואם השטר מקויים וטוען הלוה פרעתי כולו או מקצתו והמלוה אומר לא נפרעתי כלום אם יש בו נאמנות אינו נאמן ואפי' אם אמר השבע לי אין שומעין לו וגובה בלא שבועה (וכ"כ בסי' ע"א סי"ט) ומיהו אם יש ב"ח מאוחר ממנו לא יגבה אלא בשבועה שישבע לבעל חוב המאוחר שלא נפרע מחובו כלום ואין המוקדם יכול לומר למאוחר לא אשבע עד שתשבע שלא נפרעת מחובך אבל מחרים סתם על מי שיודע שהוא פרוע ומשביעו בחנם ואפי' אם יש בו נאמנות מפורש לראשון שהוא מאמינו כנגד בעל חוב מאוחר אעפ"כ צריך לישבע ואם אין בו נאמנות כל זמן שלא יטעון השבע לי שלא פרעתיך אין משביעים למלוה אלא אומרים ללוה שלם ואם טען השבע לי שלא פרעתיך משביעים אותו בנקיטת חפץ ויטול והוא שיטעון הלוה ברי שהוא פרוע אבל אם בא בטענת שמא לא משביעין ליה כלל אפילו אם גם המלוה משיב איני יודע אם הוא פרוע: הגה היה השטר על זמנים ולאחר שעברו מקצת זמנים אמר הלוה פרעתיך הזמנים שעברו והנחתי לך השטר משום הזמנים העתידים והמלוה אומר שלא נפרע כלום המלוה נשבע ונוטל דה"ל לכתוב שובר (תשו' הרשב"א אלף פ"ה):
And if the document is confirmed, and the borrower pleads, "I repaid all of it" or "part of it", and the lender says, "I was not repaid anything" — if there is a clause of trust in it, he is not believed; and even if he said, "Swear to me", they do not listen to him, and he collects without an oath (and so it is written in siman 71, se'if 19). However, if there is a creditor later than him, he collects only with an oath, that he swears to the later creditor that he has not been repaid anything of his debt; and the earlier one cannot say to the later one, "I will not swear until you swear that you have not been repaid from your debt" — but he pronounces a general cherem (the severer form of the ban) on whoever knows that it is paid, and makes him swear for nothing in return. And even if there is in it a clause of trust explicitly for the first, that he believes him against a later creditor, even so he must swear. And if there is no clause of trust in it, so long as he does not plead "Swear to me that I did not repay you", they do not make the lender swear, but they say to the borrower: pay. And if he pleaded, "Swear to me that I did not repay you", they make him swear while holding a sacred object, and he takes — and this is where the borrower pleads with certainty that it is paid; but if he comes with a plea of "perhaps", they do not make him swear at all, even if the lender also answers, "I do not know whether it is paid". Hagah [Rema]: If the document was for instalments, and after some of the instalments had passed the borrower said, "I repaid you the instalments that passed, and I left the document with you on account of the future instalments", and the lender says that nothing was repaid — the lender swears and takes, for he ought to have written a receipt (responsum of the Rashba, 1085).

כשטוען שפרע השטר ואמר ישבע לי המלוה ויטול אומרים לו הבא מעותיו ואחר כך ישבע ויטול ואם טען הלוה שאין לו מה לפרוע ישבע הלוה שאין לו וכשתגיע ידו ישביע למלוה שלא פרעו ואז יתן לו:
When he pleads that he repaid the document, and said, "Let the lender swear to me and take", they say to him: bring his money, and afterwards let him swear and take. And if the borrower pleaded that he has nothing with which to pay, the borrower swears that he has nothing, and when he has the means he makes the lender swear that he did not repay him, and then he gives it to him.
