אם הודה מעצמו מתי יכול לומר משטה אני בך. ובו לב סעיפים: אמר לחבירו מנה לי בידך א"ל בפני עדים הן למחר אמר ליה תנהו לי והשיב משטה הייתי בך נאמן וצריך לישבע שהוא כדבריו שכוונתו להשטות בו ואפילו לא טען משטה הייתי בך אלא לא היו דברים מעולם פטור דמילי דכדי (פי' דברים שאין בהם ממש) לא דכירי אינשי: הגה ולא אמרינן טענת משטה אלא ביחיד המודה אבל לא בציבור המודים דאין דרכן להשטות (ריב"ש סי' שע"ו) מי שאמר לחתנו העשיר תלמוד עם בנך ואני משלם לך פטור כיון דלאו עני הוא ובלא"ה חייב ללמוד עם בנו יכול לומר משטה הייתי בך ואע"ג דלא טעין טענינן ליה אע"ג דלא טענינן ליה בשאר משטה (מרדכי פרק זה בורר ואגודה בתשובת מהר"ם):
If he admitted of his own accord, when he can say "I am jesting with you"; it contains thirty-two se'ifim. He said to his fellow, "You have a maneh (a hundred zuz) of mine"; he said to him in the presence of witnesses, "Yes." The next day he said to him, "Give it to me", and he answered, "I was jesting with you" — he is believed, and he must swear that it is as he says, that his intent was to jest with him. And even if he did not plead "I was jesting with you" but "These things never happened", he is exempt, for idle matters (that is, things that have no substance) people do not remember. Hagah [Rema]: And we say the plea of jesting only of an individual who admits, but not of a community that admits, for it is not their way to jest (Rivash, siman 376). One who said to his rich son-in-law, "Teach your son, and I will pay you" — he is exempt; since he is not poor, and without this he is obliged to teach his son, he can say "I was jesting with you"; and even though he does not plead it, we plead it for him, although we do not plead it for him in other cases of jesting (Mordechai, chapter "This one chooses", and Aguddah, in a responsum of the Maharam).
Se’if 2ב׳
בד"א בבריא אבל שכ"מ שתבעו חבירו והודה אינו יכול לומר משטה הייתי בך שאין אדם משטה בשעת מיתה: הגה וה"ה אחרים שהודו לו או שתקו לצוואתו הוי כהודאה ולא יכולין למימר שעשו שלא להכעיס השכיב מרע (מרדכי פ' ז"ב בשם ראבי"ה):
In what case are these words said? With a healthy man; but a person dangerously ill whose fellow claimed from him and he admitted cannot say "I was jesting with you", for a person does not jest at the hour of death. Hagah [Rema]: And the same holds for others who admitted to him, or were silent at his testament — it is as an admission, and they cannot say that they did so in order not to anger the person dangerously ill (Mordechai, chapter "This one chooses", in the name of Raavyah).

בבריא נמי דוקא איהו גופיה מצי למטען משטה הייתי בך אבל אם לא טעין לא טענינן ליה אנן אבל ליורשיו טענינן שמא לא כוון אביהם אלא להשטות:
With a healthy man too, only he himself can plead "I was jesting with you"; but if he does not plead it, we do not plead it for him. But for his heirs we plead: perhaps their father meant only to jest.
