Se’if 1א׳
באיזו ענין טוען וחוזר וטוען. ובו ב סעיפים: מי שטוען בב"ד טענה א' ונתחייב בה אינו יכול לטעון טענה אחרת שסותרת הראשונה (ואפי' יש עדים על טענה שניה לא מהני) (נ"י פ' ח"ה וע"פ) (כדלעיל ריש סי' ע"ט) אבל אם בא לתקן טענה ראשונה ולומר כך נתכוונתי ויש במשמעותה לשון שסובל זה התיקון שומעין לו בד"א שלא יצא מב"ד אבל אם יצא מב"ד אין שומעין לו דשמא למדוהו לטעון שקר אבל כל מה שטוען חוץ לב"ד יכול לחזור ולטעון אפי' לסתור טענתו הראשונה לפי שאין אדם מגלה טענותיו אלא לבית דין בד"א שאינו טוען וחוזר וטוען לסתור טענתו הראשונה כשנתחייב בדין בטענה ראשונה אבל אם יכול לזכות בדין גם בטענה הראשונה יכול לחזור ולטעון ולזכות בטענה האחרת ואע"פ שלא נתן אמתלאה לטענה הראשונה (טור בשם ר"י מיג"ש ורמב"ם והוא בסוף פ"ז מהלכות טוען) ואע"פ שיצא מב"ד וחזר יש לו לחזור ולטעון ולהפך כל הטענות שירצה מפטור לפטור עד שיבואו עדים (וע' לעיל סי' ע"ט ס"ט) אבל מאחר שיבואו עדים ויכחישו טענתו (הראשונה) שסמך עליה אינו יכול להשיאו לטענה אחרת אא"כ נתן אמתלא' לטענה שסמך עליה ויש במשמעה כמו שהשיא בזאת הטענ' האחרת והוא שלא יצא מב"ד: הגה וכל זה דוקא לאחר כדי דיבור אבל תוך כדי דיבור יכול לחזור ולסתור טענתו הראשונה (טור) (ד"מ בשם מהרי"ו סי' ט"ו) ובכל זה אין חילוק בין אם טען בראשונה ובא אח"כ לטעון טענה אחרת או אם שתק תחלה ובא לטעון אח"כ אא"כ נתן טעם למה שתק בתחלה (תשובת הרא"ש כלל ס"ד סי' ג' ומהרי"ו סי' ע"ז) ודלא כיש חולקין דאם שתק יכול לחזור ולטעון (הגהות מיימוני פ"ז דטוען בשם מוהר"מ):
In what case one pleads and pleads again; it contains two se'ifim. One who pleads one plea in court and was found liable on it cannot plead another plea that contradicts the first (and even if there are witnesses to the second plea, it does not help) (Nimukei Yosef, chapter "The presumption of houses", and see the codifiers) (as above, beginning of siman 79). But if he comes to mend his first plea and say, "This is what I meant", and there is in its meaning a wording that bears this mending, they listen to him. In what case are these words said? When he has not gone out of the court; but if he has gone out of the court, they do not listen to him, for perhaps they taught him to plead falsely. But anything he pleads outside the court he can go back and plead, even to contradict his first plea, because a person does not reveal his pleas except to the court. In what case are these words said, that he does not plead and plead again to contradict his first plea? When he was found liable in judgment on the first plea; but if he could win in judgment also with the first plea, he can go back and plead and win with the other plea, even though he did not give an explanation for the first plea (Tur in the name of Rabbi Yosef ibn Migash and the Rambam, and it is at the end of chapter 7 of the Laws of Claimant and Defendant). And even though he went out of the court and came back, he may go back and plead and turn over all the pleas he wishes, from exemption to exemption, until witnesses come (and see above, siman 79, se'if 9). But once witnesses come and contradict his (first) plea on which he relied, he cannot shift it to another plea unless he gave an explanation for the plea on which he relied, and there is in its meaning what he shifted it to in this other plea — and this is where he has not gone out of the court. Hagah [Rema]: And all this is only after the span of an utterance; but within the span of an utterance he can go back and contradict his first plea (Tur) (Darchei Moshe in the name of Maharyu, siman 15). And in all this there is no distinction whether he pleaded at first and came afterwards to plead another plea, or was silent at first and came to plead afterwards — unless he gave a reason why he was silent at first (responsum of the Rosh, klal 64, siman 3, and Maharyu, siman 77); and not like those who disagree, that if he was silent he can go back and plead (Hagahot Maimoni, chapter 7 of the Laws of Claimant and Defendant, in the name of the Maharam).

Some say that after he has written his plea in a document he cannot go back and plead, even when he gives an explanation, and even if he was not contradicted (and some say that the court should write down the pleas so that he cannot go back and plead) (Rivash, siman 298).
