Se’if 1א׳
דין האומר לא לויתי והחילוק שבין צא תן לו או חייב אתה ליתן לו. ובו יד סעיפים: טענו מנה הלויתיך וכפר בב"ד ואמר לא היו דברים מעולם ובאו שני עדים שלוה ממנו מנה ופרעו והמלוה אומר לא נתפרעתי ה"ז חייב לשלם: הגה דכל האומר לא לויתי כאלו אומר לא פרעתי דמי ונאמן על עצמו יותר מק' עדים ומה שאומר לא לוה הרי הוכחש בעדים (טור) ואין המלו' חייב שבועה שהרי הוחזק זה כפרן ואם לאחר שפרעו חזר ותבעו ואמר פרעתיך שני פעמים אין משביעין אותו היסת על טענה זו וכן אם הוציא עליו כתב ידו שהוא חייב לו וא"ל להד"מ וזה אינו כתב ידי אם הוחזק כתב ידו בב"ד או שבאו עדים שהוא כתב ידו ה"ז הוחזק כפרן ומשלם:
The law of one who says "I did not borrow", and the distinction between "go, give him" and "you are obliged to give him"; it contains fourteen se'ifim. He claimed from him, "I lent you a maneh (a hundred zuz)", and he denied in court and said, "These things never happened", and two witnesses came that he borrowed a maneh from him and repaid him, and the lender says, "I was not repaid" — he must pay. Hagah [Rema]: For whoever says "I did not borrow" is as one who says "I did not repay", and a man is believed about himself more than a hundred witnesses, and what he says, that he did not borrow, has been contradicted by witnesses (Tur). And the lender is not obliged to swear, for this one has been established as a denier. And if, after he paid him, he went back and claimed from him and said, "I have paid you twice", they do not make him swear the oath of hesset (the oath the Sages imposed on one who denies a claim outright) on this claim. And likewise if he produced against him his handwriting that he owes him, and he said to him, "These things never happened, and this is not my handwriting" — if his handwriting was established in court, or witnesses came that it is his handwriting, he is established as a denier and pays.
Se’if 2ב׳
התובע מחבירו מנה והשיב לו יתכן שאתה חייב לי כמו המעות שאתה תובע ממני יש מי שאומר דהוי כאומר יתכן שאתה חייב לי ואיני חייב לך והרי כפר וכאומר לא פרעתי דמי: הגה ועיין לקמן סי' פ"א סעיף כ"ג אם יוכל לומר טעיתי בהודאה במקום מיגו:
One who claims a maneh from his fellow, and he answered him, "It may be that you owe me as much as the money you claim from me" — there is one who says that it is as one who says, "It may be that you owe me, and I do not owe you", and so he has denied, and it is as one who says "I did not repay". Hagah [Rema]: And see below, siman 81, se'if 23, whether he can say "I erred in the admission" where there is a migo (a plea he could have made in which he would have been believed).

מי שהודה בב"ד שחייב לזה התובע מנה ואח"כ אמר נזכרתי שפרעתי לו חובו זה שהודיתי בו והרי עדים ה"ז עדות מועלת ועושים על פיהם שהרי לא הכחיש עדות ואינו כאומר לא לויתי מעולם הגה ודוקא שטען שפרעו קודם שבאו העדים אבל אם באו העדים תחלה אינו נאמן (נ"י פ"ק דב"מ):
One who admitted in court that he owes this plaintiff a maneh, and afterwards said, "I remembered that I repaid him this debt that I admitted, and here are witnesses" — this is effective testimony, and they act upon it, for he did not contradict testimony, and he is not as one who says "I never borrowed". Hagah [Rema]: And this is only where he pleaded that he repaid him before the witnesses came; but if the witnesses came first, he is not believed (Nimukei Yosef, chapter 1 of Bava Metzia).
