Se’if 1א׳
הטוען שפרע תוך הזמן. ובו ח סעיפים: הקובע זמן לחבירו ותבעו תוך הזמן וא"ל פרעתיך אינו נאמן דחזקה אין אדם פורע בתוך זמנו (וה"ה דלא יכול לומר מחלת לי) (מרדכי ריש ב"ב) ואפי' מיתמי שמת הלוה בתוך הזמן והניח יתומים אפי' קטנים נפרעים מהם בלא שבועה אם היה מלוה בשטר או אפילו מלוה על פה והעמיד אביהם בדין ונתקבל העדות בפניו דבמלוה על פה נמי איתא להאי דינא ובלבד שיש עדים בהלואה ובקביעות הזמן שאם אין עדים נאמן בשבועת היסת במיגו דלא היו דברים מעולם או לא קבעת לי זמן או כבר עבר הזמן ופרעתיך בזמנו אם תבעו תוך זמנו ואמר ליה פרעתיך וחזר ותבעו אחר זמנו וא"ל השתא פרעתיך הוחזק כפרן ואינו נאמן: הגה (הגהת אשר"י ס"פ השואל ובמהרי"ו סימן פ"ט) [י"א דלא אמרינן חזקה זו אלא במלוה אבל אם היו מעות מופקדין בידו ועוסק בהן לצורך אחרים הוי כשאר פקדון ויכול לומר דהחזירן אפי' תוך הזמן שקבע (מהרי"ו סי' פ"ט) ושכירות דינו כהלואה ואינ' משתלמת אלא בסופה ואינו נאמן לומר שפרע תוך הזמן (טור ריש סימן שי"ז ונ"י ריש ב"ב) מיהו אם שכר סופר לכתוב לו כמה קונטריסים כל קונטרס מיד זמנו הוא וה"ה בכל מלאכה המתפרדת בכיוצא בזה (מרדכי ריש ב"ב):
One who pleads that he paid within the term; it contains eight se'ifim. One who set a term for his fellow and claimed from him within the term, and he said to him, "I repaid you" — he is not believed, for there is a presumption that a man does not pay within his term (and the same holds that he cannot say "you forgave me") (Mordechai, beginning of Bava Batra). And even from orphans — if the borrower died within the term and left orphans, even minors — they collect from them without an oath, if it was a loan by document, or even a loan by word of mouth where their father was brought to judgment and the testimony was received in his presence; for with a loan by word of mouth too this law applies — provided that there are witnesses to the loan and to the fixing of the term; for if there are no witnesses, he is believed with the oath of hesset (the oath the Sages imposed on one who denies a claim outright) by a migo (a plea he could have made in which he would have been believed) of "these things never happened", or "you did not set me a term", or "the term has already passed and I repaid you at its time". If he claimed from him within his term and he said to him, "I repaid you", and he claimed from him again after his term and he said to him, "Now I have repaid you", he is established as a denier and is not believed. Hagah [Rema]: (Hagahot Asheri, end of chapter "One who borrows", and Maharyu, siman 89) Some say that we say this presumption only with a loan; but if the money was deposited in his hand and he was dealing with it for the needs of others, it is like any other deposit, and he can say that he returned it even within the term that he set (Maharyu, siman 89). And hire — its law is as a loan, and it is paid only at its end, and he is not believed to say that he paid within the term (Tur, beginning of siman 317, and Nimukei Yosef, beginning of Bava Batra). However, if he hired a scribe to write him several quires, each quire is at once its term; and the same holds for any work that comes apart in pieces, in the like (Mordechai, beginning of Bava Batra).
Se’if 2ב׳
אם מת בתוך זמן ובא לטרוף (מלקוחו') במלוה בשטר להרמב"ם אינו צריך שבועה וי"א שצריך ואם הלוה חי ואמר שפרעו י"א דצריך המלוה לישבע שלא פרעו וגובה וי"א דאינו צריך שבועה (בטור שני הדיעות) וכן עיקר (נ"י פ"ק דב"ב וב"י):
If he died within the term and he comes to seize (from buyers) on a loan by document — according to the Rambam he needs no oath, and some say that he needs one. And if the borrower is alive and said that he repaid him, some say that the lender must swear that he was not repaid, and collects; and some say that he needs no oath (in Tur, the two opinions), and so is the principal view (Nimukei Yosef, chapter 1 of Bava Batra, and Beit Yosef).
Se’if 3ג׳
(וכן משמע מרמב"ם פ"ז משכירות) תבעו ביום שנשלם בו הזמן ואמר ליה פרעתיך היום אם היא מלוה על פה נאמן בשבועת היסת דעביד איניש דפרע ביום משלם זמניה ואם היא מלוה בשטר דינו כמלוה בשטר שלא קבע לו זמן:
(And so it is implied from the Rambam, chapter 7 of the Laws of Hire.) He claimed from him on the day the term was completed, and he said to him, "I repaid you today" — if it is a loan by word of mouth, he is believed with the oath of hesset, for a person does pay on the day his term is completed; and if it is a loan by document, its law is as a loan by document for which he set no term.
