Se’if 1א׳

דין שנים שלוו מאחד ודין שותפין שלוה אחד לבדו. ובו יא סעיפים: שנים שלוו כאחד או שלקחו מקח א' או שקבלו פקדון ביחד (המגיד פכ"ה) בין בשטר בין בעל פה (ב"י) שניהם ערבים זה לזה אע"פ שלא פירשו ואם אין נכסים לאחד מהם גובה מחבירו הכל אבל אם יש לו נכסים לא יתבע הערב תחלה (כי יש לו דין ערב בכל דבר) (ב"י וכן משמע בפוסקים) וגובה מכל א' החצי שהוא מוטל עליו (הרא"ש בתשובה כלל ע"ג סי' י') (אא"כ פירשו בהדיא שהן ערבים קבלנים זה בזה שאז תובע איזה מהם שירצה) (תשובת הרא"ש כלל ע"ג סימן י"ב ומהרי"ק שורש קפ"ב ואם פרע אחד מהם כל החוב חוזר וגובה מחבירו חלקו (ולכן שנים שלוו ופרע א' מהן ודאי פרע בעד חבירו) (מרדכי ר"פ מי שהיה נשוי ומהרי"ק שורש ק"ך):

The law of two who borrowed from one, and the law of partners of whom one borrowed alone; it contains eleven se'ifim. Two who borrowed together, or bought one purchase, or received a deposit jointly (the Maggid, chapter 25) — whether by document or by word of mouth (Beit Yosef) — both of them are guarantors for each other, even though they did not specify. And if one of them has no property, he collects the whole from his fellow; but if he has property, he does not claim from the guarantor first (for he has the law of a guarantor in every respect) (Beit Yosef, and so it is implied in the codifiers), and he collects from each one the half that is laid on him (the Rosh in a responsum, klal 73, siman 10) (unless they specified explicitly that they are kablan guarantors (guarantors from whom the lender may collect directly) for each other, for then he claims from whichever of them he wishes) (responsum of the Rosh, klal 73, siman 12, and Maharik, shoresh 182). And if one of them repaid the whole debt, he goes back and collects his share from his fellow (and therefore, two who borrowed and one of them repaid, he certainly repaid on behalf of his fellow) (Mordechai, beginning of chapter "One who was married", and Maharik, shoresh 120).

Se’if 2ב׳

שותפין שלוה אחד מהם מאחר לצורך השותפות השני משועבד אע"פ שלא היה עמו בקנין בשעת הלואה ודוקא שהוא מודה שמה שלוה שותפו היה לצורך השותפות או שיתברר הדבר בעדים אז דינם כשנים שלוו כאחד: הגה וי"א דאם לא נתברר הדבר בעדים רק שהשותף מודה א"צ לשלם אא"כ היה ממון בשותפות שאז המלוה גובה מחלק [ השני] (ב"י בשם הר"י בי רב לדעת הרא"ש בתשובה כלל כ"ח סי' י"ג שהביאו הטור) וכן נראה לי להורות:

Partners, one of whom borrowed from another for the needs of the partnership — the second is bound, even though he was not with him in the kinyan (a formal act of acquisition) at the time of the loan; and this is only where he admits that what his partner borrowed was for the needs of the partnership, or the matter is made clear by witnesses — then their law is as two who borrowed together. Hagah [Rema]: And some say that if the matter was not made clear by witnesses, but only the partner admits, he need not pay unless there was money in the partnership, for then the lender collects from the share of the second (Beit Yosef in the name of Rabbi Yaakov bei Rav, according to the opinion of the Rosh in a responsum, klal 28, siman 13, which the Tur brought); and so it seems to me to rule.

Se’if 3ג׳

שנים שערבו לאחד כשיבא המלוה ליפרע מן הערב יפרע מאיזה מהם שירצה ואם לא היה לאחד מהם כדי החוב חוזר ותובע לשני משאר החוב ובסימן קל"ב כתוב שיש חולקים בזה ואחד שערב לשנים כשיפרע למלוה יודיעו על חוב איזה משניהם פורע כדי שיחזור עליו (טור שם ס"ה):

Two who became guarantors for one: when the lender comes to be paid from the guarantor, he is paid from whichever of them he wishes; and if one of them did not have enough for the debt, he goes back and claims the rest of the debt from the second; and in siman 132 it is written that there are those who disagree on this. And one who became guarantor for two: when he pays the lender, he should make known on account of which of the two he is paying, so that he may go back against him (Tur, there, se'if 5).
