אחד שלוה משנים בעל פה מזה ק' ומזה ר' וכל אחד תובע ק"ק. ובו ג סעיפים: אחד שלוה משנים בבת אחת מזה מנה ומזה ק"ק והודיעוהו משל מי היה המנה ומשל מי היה הק"ק וכשבאים לתובעו אומר כל א' שלי הם הק"ק והוא אינו יודע איזהו בעל המנה ואיזהו בעל הק"ק צריך ליתן לכל אחד ק"ק (טור לדעת הרא"ש) אחר שישבע כל א' אבל אם היה מלוה בשטר שעשו שטר עליו מחזיק ש' והודיעוהו שלאחד מנה ולאחד ק"ק נותן לזה מנה ולזה מנה והשאר יהא מונח עד שיבא אליהו: הגה דכיון שנעשו שותפין בהלואה אחת ויכול אותו שהשטר יוצא מתחת ידו לגבות בו בלא הרשאה הרי לא פשע הלוה בכלום דלא הוי ליה למידק (טור) (וע' לקמן סי' ע"ז סעיף ט' מאלו הדינין) ויש מי שאומר דבמלוה ע"פ אי לא תבעו ליה חייב בבא לצאת ידי שמים:

One who borrowed from two by word of mouth, from this one a hundred and from that one two hundred, and each claims two hundred; it contains three se'ifim. One who borrowed from two at once, from this one a maneh (a hundred zuz) and from that one two hundred, and they informed him whose was the maneh and whose were the two hundred, and when they come to claim from him each one says, "Mine are the two hundred", and he does not know which is the owner of the maneh and which the owner of the two hundred — he must give each one two hundred (Tur, according to the opinion of the Rosh), after each one swears. But if it was a loan by document, where they made a document against him containing three hundred, and they informed him that one has a maneh and one two hundred, he gives this one a maneh and that one a maneh, and the rest is left lying until Eliyahu comes. Hagah [Rema]: For since they became partners in one loan, and the one from under whose hand the document comes out can collect with it without a power of attorney, the borrower was not negligent in anything, for he had no need to be exact (Tur) (and see below, siman 77, se'if 9, of these laws). And there is one who says that with a loan by word of mouth, if they did not claim from him, he is obliged when he comes to fulfil his duty to Heaven.

Se’if 2ב׳

היו שנים תובעים אותו כל א' אומר הלויתיך מנה והוא אומר לויתי מנה מאחד מכם ואיני יודע מאיזה מכם צריך ליתן לכל אחד מנה.

If two were claiming from him, each saying, "I lent you a maneh", and he says, "I borrowed a maneh from one of you, and I do not know from which of you" — he must give each one a maneh.

Se’if 3ג׳

ואי לא תבעי ליה אלא הוא מעצמו אומר א' מכם הלוה לי מנה ואיני יודע איזהו פטור אף מלצאת ידי שמים וי"א שלצאת ידי שמים צריך לתת לכל אחד (וכן נראה מדברי התוס' פ' המפקיד (בבא מציעא דף ל"ז ע"א) ע"ש ודו"ק):

And if they were not claiming from him, but he of his own accord says, "One of you lent me a maneh, and I do not know which" — he is exempt even as to fulfilling his duty to Heaven. And some say that to fulfil his duty to Heaven he must give to each one (and so it appears from the words of the Tosafot, chapter "One who deposits" (Bava Metzia folio 37a); see there and consider it carefully).
