באיזה מקום ניתנה מלוה לפרוע וסדד הפרעון. ובו ז סעיפים: (המלוה ניתן לתבוע בכל מקום) (טור) אפי' הלוהו בישוב יכול לתובעו במדבר ולכופו שיפרענו שם אם יש לו כדי סיפוקו עד שיגיע לישוב וכדי לפרעו ואם המלוה טוען ברי לי שיש לו כדי סיפוקו וכדי לפרעו והלוה טוען שאין לו אלא כדי סיפוקו ישבע היסת אבל אם הלוה רוצה לפורעו במדבר אם ירצה המלוה לא יקבל ממנו עד שיגיע לישוב מאחר שהלוהו בישוב ומיהו בכל מקום ישוב יכול לכופו לקבל אפי' אינו מקום המלוה ולא מקום הלוה ולא מקום שהלוהו אפי' יש כמה מדברות קודם שיגיע למקומו ושיירא חשובה מקום ישוב: הגה הלוהו במדבר יכול לכופו לקבל פרעונו במדבר אפי' הלוהו בישוב וא"ל הלוה אני רוצה לצאת למדבר וא"ל המלוה גם אני רוצה לצאת למדבר הוי כאלו הלוהו במדבר וצריך לקבל במדבר (טור):

In what place a loan is given to be paid, and the order of payment; it contains seven se'ifim. (A loan is given to be claimed in any place) (Tur). Even if he lent to him in a settled place, he can claim from him in the wilderness and compel him to pay it there, if he has enough for his provision until he reaches a settled place and enough to pay him. And if the lender claims: I am certain that he has enough for his provision and enough to pay, and the borrower claims that he has only enough for his provision — he swears the oath of hesset (the oath the Sages imposed on one who denies a claim outright). But if the borrower wishes to pay him in the wilderness, the lender, if he wishes, need not accept it from him until he reaches a settled place, since he lent to him in a settled place. However, in any settled place he can compel him to accept, even if it is not the lender's place nor the borrower's place nor the place where he lent to him, even if there are several wildernesses before he reaches his place; and a caravan of importance counts as a settled place. Hagah [Rema]: If he lent to him in the wilderness, he can compel him to accept his payment in the wilderness. Even if he lent to him in a settled place, and the borrower said to him: I wish to go out to the wilderness, and the lender said to him: I too wish to go out to the wilderness — it is as though he lent to him in the wilderness, and he must accept in the wilderness (Tur).

קבע המלו' ללו' זמן ורוצ' הלוה לפורעו כדי שלא יעמוד הממון באחריותו עד הזמן והמלוה אינו רוצה לקבלו אם הגיע הזמן אע"פ שהלוה ממהר לפרוע חובו כדי להציל עצמו מהאונסים העתידים לבוא כמו חלוף המטבע וגזירת המסים והתשחורת (פי' עבודת של מלך כענין לא חמרא דחד מנהון שחרית) הדין עמו שאין עתה הקלקלה נראית אע"פ שעתידה לבא למחר או בו ביום לאחר הפרעון ואין לו להשגיח על תקלת חבירו אבל אם לא הגיע הזמן אם מצוי וניכר לעינים חילוף המטבע מיד וגזירת המסים והתשחורת אינו יכול לכופו לקבל חובו קודם זמנו אבל אם אין שם אחת מכל החששות האלה וכיוצא בו אע"פ שאין המלו' רוצה לקבל חובו קודם הזמן כדי שלא יהיו באחריותו עד שיגיע הזמן אין שומעין לו מפני שקביעות הזמן לתקנת הלוה היא:

If the lender fixed the borrower a time, and the borrower wishes to pay him so that the money should not stand at his risk until the time, and the lender does not wish to accept it: if the time has arrived — even though the borrower hurries to pay his debt so as to save himself from the mishaps that are about to come, such as a change of the coinage, and the decree of taxes, and the tashchoret (that is, forced service for the king, as in: not one ass of theirs have I commandeered) — the law is with him, for now the damage is not seen, even though it is about to come tomorrow, or on that very day after the payment, and he need not pay attention to his fellow's trouble. But if the time has not arrived: if a change of the coinage is imminent and apparent to the eyes, and the decree of taxes and the tashchoret, he cannot compel him to accept his debt before its time. But if there is none of all these concerns, or the like, even though the lender does not wish to accept his debt before the time, so that it should not be at his risk until the time arrives — they do not listen to him, because the fixing of the time is for the borrower's benefit.

Se’if 3ג׳

חוב דמשכונא דקא אכיל מיניה פירות באתרא דלא מסלקי עד שיגיע הזמן כמו שלוקח פירות עד זמן דמי ואם רצה אינו מקבל המעות קודם הזמן אא"כ מניח לו הפירות לאכול: הגה לוה שאמר למלוה טול מעותיך והוא בזמן והמלוה אינו רוצה לקבלם והם צרורים ומונחים ביד לוה ונגנבו או נאנסו הלוה חייב לשלם אבל בפקדון בכי האי גווני פטור (ב"י מ"כ):

A debt of a mashkanta (a mortgage in which the lender eats the produce of the land) from which he eats produce, in a place where they do not remove him until the time arrives — it is like one who buys produce until a time; and if he wishes, he does not accept the money before the time, unless he leaves him the produce to eat. Hagah [Rema]: A borrower who said to the lender: take your money — and it is at the time — and the lender does not wish to accept it, and it is tied up and lying in the borrower's hand, and it was stolen or lost by mishap — the borrower is liable to pay; but with a deposit in such a case he is exempt (Beit Yosef, Matza Katuv).
