Se’if 1א׳

במה זמן סתם הלואה וכמה פרטי דיני הלוא'. ובו כ סעיפים: המלוה את חבירו סתם ולא קבע לו זמן במקום שאין להם מנהג יש לו זמן שלשים יום שאינו יכול לתבעו קודם בין במלוה בשטר בין במלוה ע"פ בין במשכון בין בלא משכון ואם התנה שיתבע כל זמן שירצה יש לו לתובעו אפי' ביומו אבל שאלה סתם זמנה לאלתר ויכול לתובעו מיד: הגה מיהו אם הלוה מוחה שלא ליתן שטר למלוה והוא מבקש ממנו שטר צריך להחזיר לו מעותיו מיד כי מסתמא לא הלוה לו אלא שיכתוב לו שטר ומאחר שאינו רוצה יחזיר לו מעותיו (טור בשם הרא"ש):

How long is the term of an unspecified loan, and several particular laws of loans; it contains twenty se'ifim. One who lends to his fellow without specifying, and did not fix him a time, in a place where they have no custom — he has a term of thirty days, so that he cannot claim from him before then, whether with a loan by document or a loan by word of mouth, whether upon a pledge or without a pledge. And if he stipulated that he may claim whenever he wishes, he may claim from him even on the same day. But an unspecified loan of an article — its term is immediate, and he can claim it from him at once. Hagah [Rema]: However, if the borrower protests against giving a document to the lender, and he asks a document of him, he must return him his money at once; for presumably he lent to him only so that he would write him a document, and since he does not wish to, he shall return him his money (Tur in the name of the Rosh).

המלוה את חבירו וקבע לו זמן לפורעו אע"פ שלא קנו מידו אינו יכול לתבעו קודם הזמן בין במלוה על פה בין במלוה בשטר בין במשכון בין שלא במשכון בין שמת מלוה בין שמת לוה אם יורשיו אמודים בנכסים כמוהו טען המלוה ואמר היום סוף הזמן שקבעת והלוה אומר עד עשרה ימים קבעת הלוה נשבע היסת ואם היה שם עד אחד שהיום סוף זמנו הרי זה נשבע שבועת התורה:

One who lends to his fellow and fixed him a time to pay it — although they did not make a kinyan (a formal act of acquisition) with him, he cannot claim from him before the time, whether with a loan by word of mouth or a loan by document, whether upon a pledge or without a pledge, whether the lender died or the borrower died, if his heirs are as well-off in property as he. If the lender claimed and said: today is the end of the term that you fixed, and the borrower says: you fixed up to ten days — the borrower swears the oath of hesset (the oath the Sages imposed on one who denies a claim outright). And if there was one witness there that today is the end of his term, this one swears the oath of the Torah.

Se’if 3ג׳

זה אומר חמשה ימים נשאר מהזמן וזה אומר עשרה אומרי' למלוה המתן עוד עד סוף החמשה ואז ישבע היסת שנשאר עוד חמשה ימים:

This one says: five days remain of the term, and that one says: ten — they say to the lender: wait further until the end of the five; and then he swears the oath of hesset that five more days remain.
