המלוה על המשכון והרבה דיני משכונות. ובו מה סעיפים: המלוה על המשכון צריך ליזהר שלא ישתמש בו מפני שהוא כמו ריבית ואם הלוה לעני על מרא וקרדום וכיוצא בו ששכרו מרובה ואינו נפחת אלא מעט יכול להשכירו שלא ברשות בעלים ולגבות לו דמי השכירות בחובו ויש מי שאומר דדוקא לאחרים יכול להשכירם אבל לא לעצמו משום חשדא: הגה ודוקא שלא התנה עמו מתחילה אבל אם התנה עם הלוה מתחילה שרי (ב"י) וע' בי"ד סימן קע"ב וקס"ו י"א דאין חילוק בין ספרים לשאר דברים ואם למד בספרים שהלוה עליהם מקרי שולח יד בפקדון ויש מחלקים משום דקסבר מצוה קעביד (מרדכי פ' אלו מציאות שתי הדעות) וע' בי"ד סי' קע"ב:

One who lends upon a pledge, and many laws of pledges; it contains forty-five se'ifim. One who lends upon a pledge must take care not to use it, because it is like interest. And if he lent to a poor man upon a spade or an axe and the like, whose hire is great and which are diminished only a little, he may hire it out without the owner's permission and collect the rent for him against his debt. And there is one who says that he may hire them out specifically to others, but not to himself, on account of suspicion. Hagah [Rema]: And specifically where he did not stipulate with him at the outset; but if he stipulated with the borrower at the outset, it is permitted (Beit Yosef); and see in Yoreh De'ah, siman 172 and 166. Some say that there is no distinction between books and other things, and if he studied in books on which he lent, he is called one who puts forth his hand to a deposit; and there are those who distinguish, because he holds that he is doing a mitzvah (Mordechai, chapter "These are the found objects", the two views); and see in Yoreh De'ah, siman 172.

המלוה את חבירו על המשכון בין שהלוהו מעות בין שהלוהו פירות בין שמשכנו בשעת הלואתו בין שמשכנו אחר שהלוהו הרי זה שומר שכר: הגה ואין חילוק בין אם פירש שקבלו למשכון בכדי שויו בין קבלו סתם טור לפיכך אם אבד המשכון או נגנב חייב בדמיו ואם היה שוה המשכון כדי דמי החוב אין לאחד על חבירו כלום ואם החוב יותר על המשכון משלם הלוה היתרון: הגה וי"א דאם פירש ואמר בשעת הלואה שמקבל המשכון בכל החוב אפי' אם קבל קתא דמגלא באלפא זוזי אבד המשכון אבד הכל (טור) ואם דמי המשכון יתרים על החוב נותן המלוה ללוה היתרון ואם נאנס המשכון כגון שנלקח בלסטים מזויין וכיוצא בו משאר אונסים ישבע המלוה שנאנס וישלם לו בעל המשכון את חובו עד פרוטה אחרונה: הגה וי"א דמלוה על המשכון לא הוי אלא שומר חנם לענין זה שאם דמי המשכון יתירים על החוב אין המלוה נותן ללוה היתרון אלא אבד מעותיו ולא יותר (טור בשם ר' ירוחם והרא"ש) וכן מוכח באמת דעת הרא"ש בכמה דוכתי ובפרט בסוף פ' שבועת הדיינים כתב ומכל אלו הראיות ברורות נראה דהלכה כרבה ולא כב"י לדעת הרא"ש וכ"כ עוד הרא"ש להדיא בפ' יש נוחלין גבי קנין עד אימתי חוזר ע"ש ומספיקא לא מפקינן ממונא (מרדכי ס"פ האומנין) ואם נאבד או נגנב בפשיעה חייב לשלם לדברי הכל (טור):

One who lends to his fellow upon a pledge — whether he lent him money or lent him produce, whether he took the pledge at the time of his loan or took the pledge after he lent to him — this one is a paid bailee. Hagah [Rema]: And there is no distinction whether he specified that he received it as a pledge to the extent of its value, or received it without specifying (Tur). Therefore, if the pledge was lost or stolen, he is liable for its value. And if the pledge was worth the amount of the debt, the one has nothing against the other; and if the debt is more than the pledge, the borrower pays the excess. Hagah [Rema]: And some say that if he specified and said at the time of the loan that he receives the pledge for the whole debt — even if he received the handle of a sickle for a thousand zuz — if the pledge is lost, all is lost (Tur). And if the value of the pledge exceeds the debt, the lender gives the borrower the excess. And if the pledge was lost by mishap — for instance, it was taken by an armed robber, or by the like of the other mishaps — the lender swears that it was lost by mishap, and the owner of the pledge pays him his debt to the last perutah. Hagah [Rema]: And some say that one who lends upon a pledge is only an unpaid bailee as to this, that if the value of the pledge exceeds the debt, the lender does not give the borrower the excess, but he has lost his money and no more (Tur in the name of Rabbeinu Yerucham and the Rosh). And so indeed the view of the Rosh is shown in several places, and in particular at the end of chapter "The oath of the judges" he wrote: and from all these clear proofs it appears that the halachah is as Rabbah and not as Rav Yosef — according to the view of the Rosh. And the Rosh further wrote so explicitly in chapter "There are those who inherit", concerning a kinyan (a formal act of acquisition): until when can he retract — see there. And out of doubt we do not take money out (Mordechai, the end of chapter "The craftsmen"). And if it was lost or stolen through negligence, he is liable to pay according to all opinions (Tur).

המלו' על המשכון וחזר המלוה והפקידו ללוה ונגנב או נאבד חייב המלוה אע"פ שביד הלוה אבד כיון דבתורת פקדון נתנו לו אכתי ברשותא דמלו' קאי ומזה הטעם אם ראובן לוה מעות משמעון על בגדי אשתו וחזר והשאילן לו עד לאחר המועד ומת במועד ומאימת המושל מסרה את אשר לה לשמעון וגם הבגדים ההם ואח"כ החזיר לה שמעון הכל חוץ מאותם בגדים הדין עם שמעון כיון שבתורת שאלה באו ליד ראובן עדיין הם ברשות שמעון: הגה ראובן שנתן לשמעון משכון למשכנו אצל עכו"ם ושמעון נתן משכון אחר לעכו"ם ועכב משכון של ראובן בידו נעשה עליו שומר כאלו הלוהו עליו (מהר"ם פאדוואה סי' נ"ט):

One who lent upon a pledge, and the lender went back and deposited it with the borrower, and it was stolen or lost — the lender is liable; although it was lost in the borrower's hand, since he gave it to him as a deposit, it still stands in the lender's domain. And for this reason, if Reuven borrowed money from Shimon upon his wife's garments, and he lent them back to him until after the festival, and he died during the festival, and out of fear of the ruler she handed over what was hers to Shimon, and those garments as well, and afterwards Shimon returned everything to her except those garments — the law is with Shimon; since they came into Reuven's hand as a loan, they are still in Shimon's domain. Hagah [Rema]: Reuven, who gave Shimon a pledge to pledge it with a gentile, and Shimon gave another pledge to the gentile and kept Reuven's pledge in his hand — he has become a bailee over it, as though he had lent to him upon it (Maharam Padua, siman 59).
