Se’if 1א׳

לוה שהאמין למלוה בעל פה למה מועיל נאמנות. ובו כג סעיפים: התנה המלוה עם הלוה שיהא נאמן בכל עת שיאמר שלא פרעו הרי זה נוטל בלא שבועה אע"פ שטוען שפרעו אפילו היא מלוה על פה: הגה ודוקא בדאיכא עדים שהאמינו עליו אבל אי ליכא עדים והלוה אומר שהאמינו ופרעו נאמן במיגו וע' לעיל סי' ס"ט ס"ב אבל אם הביא עדים שפרעו אינו נוטל כלום ואם התנה עמו שיהא המלוה נאמן כשני עדים אף על פי שהביא עדים שפרעו ה"ז גובה ממנו בלא שבועה ואפי' הביא מאה עדים שפרעו בפניהם שהשנים כמאה: הגה ואפילו היה ללוה מיגו והיה אפשר למיפטר עצמו בטענה אחרת לא מהימנינן ליה במיגו נגד הנאמנות שהאמין עליו (ב"י בשם הרשב"א) אבל אם אמר לו הרי אתה נאמן עלי כשלשה הואיל וירד למנין אם פרעו בפני ארבעה הרי זה פרוע:

A borrower who trusted the lender orally, and for what trust (a clause making the lender believed as to non-payment) avails; it contains twenty-three se'ifim. If the lender stipulated with the borrower that he would be believed whenever he says that he has not paid him, he takes without an oath, even though he claims that he paid him — even if it is a loan by word of mouth. Hagah [Rema]: And specifically where there are witnesses that he trusted him; but if there are no witnesses, and the borrower says that he trusted him and he paid him, he is believed by a migo (a plea he could have made in which he would have been believed); and see above, siman 69, se'if 2. But if he brought witnesses that he paid him, he takes nothing. And if he stipulated with him that the lender would be believed as two witnesses, even though he brought witnesses that he paid him, this one collects from him without an oath; and even if he brought a hundred witnesses that he paid him before them, for two are as a hundred. Hagah [Rema]: And even if the borrower had a migo and could have exempted himself by another claim, we do not believe him by a migo against the trust with which he trusted him (Beit Yosef in the name of the Rashba). But if he said to him: you are hereby believed over me as three — since he went down to a number, if he paid him before four, it is paid.

הא דמהני נאמנות בלא קנין דוקא בשעת הלואה אבל לאחר הלואה ולא קנו מיניה לא משתעבד:

This, that trust avails without a kinyan (a formal act of acquisition), is specifically at the time of the loan; but after the loan, if they did not make a kinyan with him, he is not bound.

הא דמהני נאמנות כנגד עדים הני מילי כשמעידים בפנינו פרעו אבל אם העידו בפנינו הודה שפרעו נאמני' שלא פסלם אלא לפרעון אבל הודאה מילתא אחריתי היא ובזה לא פסלם וכן אם העידו שמחל לו החוב נאמנים: הגה וכן כל כיוצא בזה דאין הנאמנות אלא למה שהאמינו עליו ולא יותר (טור סי"ד בשם תשו' הרא"ש) כגון מי שקבל מעות בעסקא והאמין לנותן עליו ועל יורשיו לומר שלא אירע הפסד באותו ממון ובכל אשר יאמר בעיקר הממון ואח"כ נפטר המקבל והניח ממון ביד אחר והנותן אומר שהוא מעסק השותפות אינו נאמן בזה אפילו היה המקבל [חי] הואיל ולא נכלל בלשון הנאמנות (תשו' הרא"ש כלל א"א והביאו הטור) אבל כל מה שכתב עליו נאמנות מהני כגון אם כתב לו שיהא נאמן כמה הוציא הוצאות ושחדים מהני כמו שמהני לעיקר הקרן דכל תנאי שבממון קיים (כלל הנ"ל סי' ח' והביאו הטור):

This, that trust avails against witnesses — these words apply when they testify before us: he paid him; but if they testified before us: he admitted that he was paid — they are believed, for he disqualified them only as to payment, but admission is another matter, and in this he did not disqualify them. And likewise, if they testified that he waived the debt to him, they are believed. Hagah [Rema]: And likewise with everything similar to this, that the trust extends only to what he trusted him about, and no more (Tur, se'if 14, in the name of a responsum of the Rosh). For instance, one who received money in iska (a venture in which the investor shares the gain and the loss) and trusted the giver, as to himself and as to his heirs, to say that no loss occurred in that money, and in all that he says concerning the principal of the money; and afterwards the recipient died and left money in the hand of another, and the giver says that it is from the business of the partnership — he is not believed in this, even if the recipient were alive, since it was not included in the language of the trust (a responsum of the Rosh, klal 1, siman 1, and the Tur brought it). But whatever he wrote him trust about avails — for instance, if he wrote him that he would be believed as to how much he laid out in expenses and in bribes, it avails, just as it avails for the principal itself, for every condition concerning money stands (the aforementioned klal, siman 8, and the Tur brought it).
