Se’if 1א׳

דין מלוה על פה ואם א"ל אל תפרעני אלא בעדים. ובו ו סעיפים: אסור להלוות בלא עדים ואפי' לתלמיד חכם אלא א"כ הלוהו על המשכון והמלוה בשטר משובח יותר וכל המלוה בלא עדים עובר משום לפני עור לא תתן מכשול וגורם קללה לעצמו המלוה את חבירו בעדים בלא קנין ובלא שטר אין צריך לפרעו בעדים אלא נאמן בשבועת היסת לומר פרעתיך: הגה אבל אם קבל קנין אפי' בלא שטר לא יוכל לומר פרעתי דהוי כשטר דכל קנין לכתיבה עומד (ב"י בשם התרומות בשער כ"ה ומרדכי פ"ק דכתובות) ויש חולקין (שם במרדכי) וע"ל סי' ל"ט סעיף ה' וכ"מ שנאמן לומר פרעתי נאמן לו' מחלת לי אע"פ שמחילה טענה גרועה היא (מרדכי פ' השותפין וכ"כ לק' סי' פ"ב):

The law of a loan by word of mouth, and where he said to him: do not pay me except before witnesses; it contains six se'ifim. It is forbidden to lend without witnesses, even to a Torah scholar, unless he lent to him upon a pledge; and one who lends by document is more praiseworthy. And whoever lends without witnesses transgresses on account of "you shall not put a stumbling-block before the blind", and brings a curse upon himself. One who lends to his fellow before witnesses, without a kinyan (a formal act of acquisition) and without a document, need not pay him before witnesses, but he is believed with the oath of hesset (the oath the Sages imposed on one who denies a claim outright) to say: I paid you. Hagah [Rema]: But if he accepted a kinyan, even without a document, he cannot say: I paid, for it is as a document, since every kinyan stands to be written (Beit Yosef in the name of the Terumot, in gate 25, and Mordechai, the first chapter of Ketubot); and there are those who disagree (there, in the Mordechai). And see above, siman 39, se'if 5. And wherever he is believed to say: I paid, he is believed to say: you waived it to me, although a waiver is a weak claim (Mordechai, chapter "The partners"; and so it is written below, siman 82).

Se’if 2ב׳

אמר פרעתיך בפני פלוני ופלוני אומרים ללוה הביאם והפטר (שצריך לברר דבריו) (טור) לא באו ואפי' באו והכחישוהו ואמרו לא היו דברים מעולם ישבע היסת ויפטר ואם אומר שהזמינם לעדים כשפרעו אם הכחישוהו חייב לשלם: הגה (ע' סק"ו) וי"א דאין חילוק בין הזמינם או לא וכל שבאו עדים והכחישוהו חייב לשלם אלא שא"צ לברר דבריו (הרא"ש פ' גט פשוט והמגיד פ"ו מה' טוען אליבא דהרמב"ם) ואם לא יוכל להביא העדים לית לן בה וע' לקמן ריש סי' ע"ה:

If he said: I paid you before so-and-so and so-and-so — they say to the borrower: bring them and be exempt (for he must clarify his words) (Tur). If they did not come, and even if they came and contradicted him and said: those things never happened — he swears the oath of hesset and is exempt. And if he says that he appointed them as witnesses when he paid him, if they contradicted him he is liable to pay. Hagah [Rema]: (see se'if katan 6) And some say that there is no distinction whether he appointed them or not, and wherever witnesses came and contradicted him he is liable to pay; only that he need not clarify his words (the Rosh, chapter "A plain bill of divorce", and the Maggid, chapter 6 of the Laws of Claimant and Defendant, according to the Rambam); and if he cannot bring the witnesses, it does not matter to us. And see below, the beginning of siman 75.

אמר לו אל תפרעני אלא בעדים בין שאמר לו בשעת הלואה בין שאמר לו אחר שהלוהו צריך לפרעו בעדים ואם אמר שפרעו שלא בעדים אינו נאמן (טור והוא מהרא"ש) והמלוה גובה ממנו בלא שבועה טען ואמר כן עשיתי ופרעתיך בפני פלוני ופלוני והלכו למדינת הים או מתו הרי זה נאמן ונשבע שבועת היסת ונפטר וכן אם אמר אל תפרעני אלא בפני ת"ח או בפני רופאים ואמר בפניהם פרעתיך ואותם עדים שפרעתיך בפניהם מתו או הלכו למדינת הים הרי זה נאמן ונשבע היסת ונפטר:

If he said to him: do not pay me except before witnesses — whether he said it to him at the time of the loan or whether he said it to him after he lent to him — he must pay him before witnesses; and if he said that he paid him without witnesses, he is not believed (Tur, and it is from the Rosh), and the lender collects from him without an oath. If he claimed and said: so I did, and I paid you before so-and-so and so-and-so, and they went overseas or died — he is believed, and swears the oath of hesset and is exempt. And likewise, if he said: do not pay me except before Torah scholars, or before physicians, and he said: I paid you before them, and those witnesses before whom I paid you died or went overseas — he is believed, and swears the oath of hesset and is exempt.
