דין שטרות העשויות בערכאות עכו"ם. ובו ב סעיפים: שטר שכתוב בכל לשון ובכל כתב אם היה עשוי כתיקון שטרי ישראל שאינם יכולים להזדייף ולא להוסיף ולא לגרוע והיו עדיו ישראל ויודעין לקרותו הרי הוא כשר וגובה בו מהמשועבדים אבל כל השטרות שחותמים עכו"ם פסולים חוץ משטרי מו"מ ושטרי חובות והוא שיתן המעות בפניהם ויכתבו בשטר לפנינו מנה פלוני לפלוני כך וכך דמי המכר או המעות החוב והוא שיהיו עשויים בערכאות שלהם אבל במקום קיבוץ פליליהם בלא קיום השופט שלהם לא יועילו כלום (ואפי' דנו כבר הערכאו' ע"פ אותו השטר והחזיקו הקונה במקחו אינו כלום) (א"ז פ"ק דגיטין) וכן צריכים עידי ישראל שיעידו על אלו העכו"ם שהם עידי השטר ועל זה השופט שלהם שקיים עדותן שאינם ידועים בקבלת שוחד ואז גובים מבני חורין ואם חסרו שטרי העכו"ם דבר מכל אלו הרי הם כחרס: הגה וספר שכותבין בו הערכאות הוי כשטר שלהם (נ"י בשם הרשב"א) וי"א דסתם ערכאות לא מקבלי שוחדא וכיון שנעשה בפניהם גובין אפילו ממשעבדי אפי' בלא עידי מסירה ישראל ואפי' אין השופט חתום לקיים העדים אלא כל שנעשה בפני הערכאות לא מרעי נפשייהו לשקורי ואפי' נפק עלייהו קלא דמקבלי שוחדא להטות משפט מ"מ לעדות שקר לא מרעי נפשייהו וא"צ שיהא כתוב בו שראו נתינת המעות אלא שאנו סומכין שראו בודאי (הרא"ש פ"ק דגיטין וטור) ואין חילוק בין חתום עליו עד אחד עכו"ם או שנים (ב"י בשם הרשב"א) כל שנעשה לפני השופט אבל אם כתב סופר הממונה מפי השופט שלא בפני השופט אינו כלום (טור ומהר"ם פאדוואה סי' נ"ו) מיהו במקום שיש דינא דמלכותא להכשיר שטר שנעשה ע"י סופר המלך כשר (טור בשם הרמב"ן) אבל שטרי מתנות כגון שדי נתונה לך שעיקר הקנין נעשה ע"י השטר והם חתומים בו וכן שטרי הודאות שפלוני הודה לפלוני שהוא חייב לו ופשרות שהם בעדים שלהם או שטרי (מחילות) (טור) אע"פ שיש בהם כל הדברי' שמנינו (ונמסרו לפני עידי ישראל) (טור) הרי הם כחרס: הגה וי"א דשטרי הודאות כשטרי הלואות (ב"י בשם הרשב"א והר"ן בפ"ק דגיטין) וכן שטרי מחילות כשרים בערכאות (ריב"ש סי' קמ"ב) וכן מתנה הנקנית בקנין או בחזקה (ב"י) רק שהודה בערכאות דכל השטר אינו אלא ראייה בעלמא כשר מה שנעשה לפניהם (ר"ן פ"ק דגיטין) ולכן שכיב מרע שעשה צוואה לפני ערכאות של עכו"ם קיים כל מה שצוה (ריב"ש סי' נ"א) וכמו שיתבאר לקמן סימן רנ"ג סעיף ל"ב ובכל מקום שמשפט המלך לכתוב כל הדברים בערכאות כל השטרות העשויין לפניהם כשרים אפי' שטרי מתנות מכח דינא דמלכותא (הרא"ש פ"ק דגיטין וטור) וכל שכן במקום שכבר נהגו להכשירם כשרים (ריב"ש סי' תצ"ג ותע"ח ובה"ת וב"י בשם רשב"א והמגיד פכ"ז מה' מלוה) וע' לקמן סי' שס"ט בדין דינא דמלכותא וכל שטר שמכשירין משום דינא דמלכותא אם לא נכתב כהוגן לפי דיניהם אע"פ שנכתב כהוגן לפי דינינו פסול דלא נכשיר יותר מהם (ריב"ש סי' נ"א) וכן להפך אם פסול לפי דינינו וכשר לפי דיניהם (מהרי"ק שורש קפ"ח) ויש חולקין בזה (תשובת הרא"ש כלל י"ח):

The law of documents made in the courts of the gentiles; it contains two se'ifim. A document written in any language and in any script, if it was made according to the procedure of the documents of Israelites, so that they cannot be forged, nor added to nor taken from, and its witnesses were Israelites and know how to read it — it is valid, and he collects with it from encumbered property. But all documents that gentiles sign are invalid, except documents of trade and documents of debt; provided that he give the money before them and they write in the document: before us so-and-so counted out to so-and-so such-and-such, the price of the sale or the money of the debt; and provided that they are made in their courts. But in a place of assembly of their magistrates, without the confirmation of their judge, they avail nothing (and even if the courts have already judged according to that document and the buyer has taken possession of his purchase, it is nothing) (Or Zarua, the first chapter of Gittin). And likewise Israelite witnesses are needed, who testify concerning these gentiles that they are the witnesses of the document, and concerning this judge of theirs who confirmed their testimony, that they are not known for taking bribes; and then they collect from unencumbered property. And if the documents of the gentiles lacked anything of all these, they are as a potsherd. Hagah [Rema]: And a book in which the courts write is as their document (Nimukei Yosef in the name of the Rashba). And some say that ordinary courts do not take bribes, and since it was made before them, they collect even from encumbered property, even without Israelite witnesses of delivery, and even if the judge is not signed to confirm the witnesses; rather, whatever is done before the courts, they would not damage themselves by lying. And even if a report went out about them that they take bribes to pervert judgment, in any case for false testimony they would not damage themselves. And it need not be written in it that they saw the giving of the money, but we rely on it that they certainly saw (the Rosh, the first chapter of Gittin, and Tur). And there is no difference whether one gentile witness is signed on it or two (Beit Yosef in the name of the Rashba), wherever it was done before the judge; but if a scribe appointed at the dictation of the judge wrote it not in the judge's presence, it is nothing (Tur, and Maharam Padua, siman 56). However, in a place where there is a law of the kingdom validating a document made through the king's scribe, it is valid (Tur in the name of the Ramban). But documents of gift — as: my field is given to you — where the essence of the kinyan (a formal act of acquisition) is done through the document and they are signed on it; and likewise documents of admission, that so-and-so admitted to so-and-so that he owes him; and compromises that are by their witnesses; or documents of (waiver) (Tur) — even though they have in them all the things that we enumerated (and were delivered before Israelite witnesses) (Tur), they are as a potsherd. Hagah [Rema]: And some say that documents of admission are as documents of loans (Beit Yosef in the name of the Rashba, and the Ran in the first chapter of Gittin); and likewise documents of waiver are valid in the courts (Rivash, siman 142); and likewise a gift acquired by a kinyan or by taking possession (Beit Yosef), only that he admitted in the courts — since the whole document is mere evidence, what was done before them is valid (the Ran, the first chapter of Gittin). And therefore a person dangerously ill who made a will before the courts of the gentiles — all that he commanded stands (Rivash, siman 51), and as will be explained below, siman 253, se'if 32. And in every place where the law of the king is to write all matters in the courts, all the documents made before them are valid, even documents of gift, by force of the law of the kingdom (the Rosh, the first chapter of Gittin, and Tur); and all the more so, in a place where they are already accustomed to validate them, they are valid (Rivash, siman 493 and 478, and Baal haTerumot, and Beit Yosef in the name of the Rashba, and the Maggid, chapter 27 of the Laws of Lender and Borrower). And see below, siman 369, on the law that the law of the kingdom is law. And every document that they validate on account of the law of the kingdom — if it was not properly written according to their laws, although it was properly written according to our laws, it is invalid, for we do not validate more than they do (Rivash, siman 51); and likewise the reverse, if it is invalid according to our laws and valid according to their laws (Maharik, shoresh 188); and there are those who disagree in this (a responsum of the Rosh, klal 18).

אם לא ידעו דייני ישראל לקרות שטר זה הנעשה בערכאות של עכו"ם נותנים לשני עכו"ם זה שלא בפני זה וקורים אותו שנמצא כל א' כמסיח לפי תומו וגובה בו מבני חורין שטר שעידיו עכו"ם שמסרו הלוה ליד המלוה או המוכר ליד הלוקח בפני שני עדים מישראל אע"פ שאינו עשוי בערכאות של עכו"ם ואין בו כל הדברים שמנינו הרי זה גובה מבני חורין והוא שיהיו העדים שמסר בפניהם יודעים לקרותו וקראוהו כשמסרו בפניהם (הרא"ש) ויהיו כתיקון שטר ישראל שאינו יכול להזדייף לא להוסיף ולא לגרוע ויש מי שאומר דה"מ ששמות העדים החתומים בו שמות מובהקים בעכו"ם שאין דרך ישראל לקרות באותן שמות או במקום שאין ישראל רגילים לחתום בשטרות כלל: הגה שטר העשוי בערכאות והלוה כופר בו נאמן הסופר להעיד שהוא כתבו (תשו' רמב"ן סי' ע"ח ותשו' רשב"א סי' תתקפ"ו) שטר העשוי לפני עכו"ם והלוה בעצמו חתום עליו אע"פ שאינו יודע לקרות חייב בכל מ"ש בו דהרי גמר בדעתו להתחייב ולכן חתם עצמו ובודאי קראוהו לפניו והאמין לקורא ההוא: (תשו' רשב"א סימן תתקפ"ה) וע' לעיל סי' מ"ה סעיף ג':

If the Israelite judges do not know how to read this document made in the courts of the gentiles, they give it to two gentiles, the one not in the presence of the other, and they read it, so that each one is found to be speaking in innocence; and he collects with it from unencumbered property. A document whose witnesses are gentiles, which the borrower delivered into the lender's hand, or the seller into the buyer's hand, before two Israelite witnesses — although it is not made in the courts of the gentiles, and does not have in it all the things that we enumerated — he collects with it from unencumbered property; provided that the witnesses before whom he delivered it know how to read it and read it when he delivered it before them (the Rosh), and it is according to the procedure of the document of an Israelite, so that it cannot be forged, nor added to nor taken from. And there is one who says that these words apply where the names of the witnesses signed on it are names distinctive among gentiles, by which Israelites are not accustomed to be called, or in a place where Israelites are not accustomed to sign documents at all. Hagah [Rema]: A document made in the courts, and the borrower denies it — the scribe is believed to testify that he wrote it (a responsum of the Ramban, siman 78, and a responsum of the Rashba, siman 986). A document made before gentiles, on which the borrower himself signed — although he does not know how to read, he is liable in all that is written in it, for he resolved in his mind to bind himself and therefore signed himself, and they certainly read it before him and he trusted that reader (a responsum of the Rashba, siman 985).
