דין שמיטה ופרוזבול. ובו לח סעיפים: אין שמיטת כספים נוהגת מן התורה אלא בזמן שהיובל נוהג ומדברי סופרים שתהא שמיטת כספים נוהגת בזמן הזה בכל מקום: הגה (רמב"ם פ"ט מה' שמטה שער מ"ה והר"ן בשם י"א) כן הוא הסכמת הפוסקים אבל י"א דאין שמטה נוהגת בזמן הזה ונרא' שעליהם סמכו במדינות אלו שאין נוהגין דין שמטה כלל בזמן הזה והמנהג היו נוהגין עדיין בזמן הרא"ש כמו שכתב בתשוב' (הטור ס"ה הביאו) שהיה צווח ככרוכיא לבטל המנהג ולא אשגחו ביה וכבר כתבו ג"כ האחרונים ז"ל (בד"מ ס"ה הביאו) טעם למנהג שאין נוהגין שמטה כמבואר בדברי מהרי"ק שורש צ"ב ומהר"ר איסרלן בת"ה סימן ד"ש ובמהרי"ל ואין לדקדק אחריהם ובחשבון שנת השמיטה נפלה מחלוקת והעיקר ששנת ש"כ ושנת שכ"ז היתה שמטה וא"כ יהי' שנת של"ד הבע"ל שמטה יה"ר שיבנ' בהמ"ק ויחזרו אז למנות שמיטין ויובלות כי יבא של"ה לפרט:

The law of the release and of the prozbul (the declaration delivered to the court so that the seventh year does not release the debt); it contains thirty-eight se'ifim. The release of debts is in force by the Torah only at a time when the Jubilee is in force; and it is from the words of the Scribes that the release of debts should be in force at the present time in every place. Hagah [Rema]: (the Rambam, chapter 9 of the Laws of the Release, gate 45, and the Ran in the name of some) So is the consensus of the poskim. But some say that the release is not in force at the present time; and it appears that on them they relied in these countries, where they do not practise the law of the release at all at the present time. And the custom was already practised in the time of the Rosh, as he wrote in a responsum (the Tur, se'if 5, brought it), that he cried out like a crane to abolish the custom and they paid no attention to him. And the later authorities, of blessed memory, have also already written (Darchei Moshe, se'if 5, brought it) a reason for the custom of not practising the release, as is set out in the words of Maharik, shoresh 92, and Maharar Isserlein in Terumat haDeshen, siman 304, and in the Maharil; and one need not scrutinise after them. And in the reckoning of the sabbatical year a dispute arose; and the main view is that the year 320 and the year 327 were sabbatical years, and if so, the year 334, which is coming upon us for good, will be a sabbatical year. May it be His will that the Holy Temple be built, and they will then return to counting sabbatical years and Jubilees, when the year 335 of the minor reckoning comes.

שביעית משמטת את המלוה ואפי' מלוה שבשטר שיש בו אחריות נכסים והמשכנתא במקום שדרכם לסלק המלוה בכל עת שיביא מעותיו שביעית משמטתה ומקום שא"י לסלקו עד סוף זמנו אין שביעית משמטתה ואם אינה משכנתא אלא שסיים לו שדה בהלואתו אינו משמט וי"א דהני מילי באתרא דלא מסלקי ליה וכל שא"י לסלקו אפי' יום א' מקרי אתרא דלא מסלקי ליה:

The seventh year releases the loan, and even a loan by document in which there is a guarantee on property. And a mashkanta (a mortgage in which the lender eats the produce of the land): in a place where it is their way to remove the lender whenever he brings his money, the seventh year releases it; and in a place where he cannot remove him until the end of its term, the seventh year does not release it. And if it is not a mashkanta, but he designated a field for him for his loan, it does not release it. And some say that these words apply in a place where they do not remove him; and wherever he cannot remove him even for one day, it is called a place where they do not remove him.
