Se’if 1א׳
דין שטרות שנמצאו ודין שובר שנמצא ביד שליש. ובו כד סעיפים: המוצא שטר אצלו ואינו יודע מה טיבו אם המלוה הפקידו או הלוה או אם הפקידוהו בידו בתורת שלישות ומקצתו פרוע יהא מונח עד שיבא אליהו ואם החזירו לאותו שכתוב על שמו עבר על דברי חכמים ואם זה שהשטר עתה בידו מכחיש דברי אותו שנתנו לו היה יכול לגבות בו ואם הוא מודה לו שנתנו לידו צריך להחזירו לו ויהא מונח עד שיבא אליהו ובסי' זה יתבאר עוד (וע' סעיף ט"ז) ואם שטר משכונא נמצא בידו ואינו יודע מה טיבו אף ע"פ שבעל משכונא מוחזק בקרקע אינו מועיל לו כלום שום טענה ויהא השטר מונח עד שיבא אליהו ומחזיר הקרקע לבעליה: הגה וכל זה דוקא במי שאין לו שייכות עם המפקיד או הנפקד אבל בן שמוצא שטרות של אביו בידו ואינו יודע מה טיבן או האב שמוצא שטרות בנו והוא סומך על שלחנו וה"ה כל אלו שאין להן חזקה זה על זה כמו שיתבאר לקמן סי' קמ"ט כל אלו כאדם אחר הן והוי כאלו נמצא תחת ידי עצמו (תשו' רשב"א אלף ל"ה):
The law of documents that were found, and the law of a receipt found in the hand of a trustee; it contains twenty-four se'ifim. One who finds a document with him and does not know what its nature is — whether the lender deposited it or the borrower, or whether they deposited it in his hand as a trustee and part of it is paid — it shall lie until Elijah comes. And if he returned it to the one in whose name it is written, he has transgressed the words of the Sages. And if this one in whose hand the document now is contradicts the words of the one who gave it to him, he could have collected with it; and if he admits to him that he gave it into his hand, he must return it to him — and it shall lie until Elijah comes; and in this siman it will be explained further (and see se'if 16). And if a document of mashkanta (a mortgage in which the lender eats the produce of the land) is found in his hand and he does not know what its nature is, although the holder of the mashkanta is in possession of the land, no claim avails him anything; and the document shall lie until Elijah comes, and he returns the land to its owners. Hagah [Rema]: And all this is specifically with one who has no connection with the depositor or the bailee; but a son who finds his father's documents in his hand and does not know what their nature is, or the father who finds the documents of his son, and he is supported at his table — and likewise all those who have no presumption over one another, as will be explained below, siman 149 — all of these are as another person, and it is as though it were found under his own hand (a responsum of the Rashba, 1035).
Se’if 2ב׳
וכן יורשי הנפקד לא יחזירו שום שטר שנמצא ברשות אביהם אא"כ יודעים מה טיבו ויש מי שאומר שאם המלוה בעצמו לקחו קודם שבא ליד אחר לא אמרי' ביה יהא מונח ואפי' לקחו מבית היורש קודם שבא ליד היורש ומיהו אם היורש מוציא [שטר] כתובת אשה הנפקד אצלו יחזירנו לאשה ולא חיישי' שהיא פרועה (ב"י בשם הריטב"א):
And likewise the heirs of the bailee shall not return any document found in their father's possession unless they know what its nature is. And there is one who says that if the lender himself took it before it came into the hand of another, we do not say of it: let it lie; and even if he took it from the heir's house before it came into the heir's hand. However, if the heir produces the ketubah document of a woman that was deposited with him, he shall return it to the woman, and we are not concerned that it is paid (Beit Yosef in the name of the Ritva).
Se’if 3ג׳
י"א שאפי' שניהם רוצים לא יוציאם מתחת ידו אלא קרוע דחיישינן לקנוניא ויש מי שאומר דלא חיישי' ואם שניהם רוצים יעשה כמאמרם:
Some say that even if both of them wish it, he shall not bring them out from under his hand except torn, for we are concerned for collusion; and there is one who says that we are not concerned, and if both of them wish it, he shall do as they say.
