נפקד שרצה לעכב בחובו שטרות הפקדון. ובו סעיף אחד: מי שהפקידו בידו שטרות ומת המפקיד וטוען הנפקד מחיים תפסתי אותם למשכון בשביל חוב שיש לי על המפקיד דאלו לגבותם לא היה מועיל בלא כתיבה אם יש עדים שתבעם ממנו מחיים ולא רצה להחזירם לו אז הויא תפיסה ואי לא לא ומיירי שיש עדים שהפקידם בידו וגם יש עדים שראום עתה בידו שאם לא כן היה נאמן במגו דנאנסו או לא היו דברים מעולם וכל זה לדינא דגמרא אבל למאי דתקון רבנן שגובין מטלטלי דיתמי גובין משטרותיהם אפי' לא תפס מחיים: הגה ואע"פ שאין לו מיגו ואינו יכול לומר לקוחין הם בידי מ"מ אם תפסם מחיים יוכל לומר למשכון תפסתים (תוס' והרא"ש פ' הכותב) דלא כיש מי שאומר דלא יוכל לומר למשכון תפסתים אלא בידוע שהיה חייב לו מאחר שאין לו מגו (ב"י בשם הרשב"א):
A bailee who wished to hold back deposited documents for his debt; it contains one se'if. One in whose hand documents were deposited, and the depositor died, and the bailee claims: in his lifetime I seized them as a pledge for a debt that I have against the depositor (for to collect them would not avail without writing) — if there are witnesses that he claimed them from him in his lifetime and he did not wish to return them to him, then it is a seizure; and if not, not. And this speaks where there are witnesses that he deposited them in his hand, and there are also witnesses who saw them now in his hand; for if not so, he would be believed by a migo (a plea he could have made in which he would have been believed) that they were taken from him by force, or that those things never happened. And all this is according to the law of the Gemara; but according to what the Rabbis enacted, that they collect from the movables of orphans, they collect from their documents even if he did not seize them in the lifetime. Hagah [Rema]: And even though he has no migo and cannot say: they are bought, in my hand — nevertheless, if he seized them in the lifetime, he can say: I seized them as a pledge (the Tosafot and the Rosh, chapter "One who writes"); not like the one who says that he cannot say: I seized them as a pledge, except where it is known that he owed him, since he has no migo (Beit Yosef in the name of the Rashba).
