Se’if 1א׳
מי מי שהועד עליו שמחזיר אחר זיוף. ובו ב סעיפים: המוציא שט"ח על חבירו ובאו שנים ואמרו ממנו שאל לזייף לו שטר זה אע"פ שנתקיים השטר בחותמיו אין גובין בו לעולם אא"כ עידי השטר מעידים שראו ההלואה או אחרים מעידים עליהם שראו שחתמו ואם עידי השטר מעידים שזו היא חתימתן גובין בו (ויש חולקין וס"ל דהכרת החתימה לא מהני) (טור בשם הרמ"ה ור"ן פ' אלו נערות):
One against whom it was testified that he goes about seeking forgery; it contains two se'ifim. One who produces a document of debt against his fellow, and two came and said: he asked us to forge this document for him — even though the document was confirmed through its signatories, they never collect with it, unless the witnesses of the document testify that they saw the loan, or others testify concerning them that they saw them sign. And if the witnesses of the document testify that this is their signature, they collect with it (and there are those who disagree and hold that recognition of the signature does not avail) (Tur in the name of the Ramah, and the Ran, chapter "These are the young girls").
Se’if 2ב׳
כשאמרו אין גובין בו לא משהינן ליה בידיה אלא מוקמינן ליה ביד שליש: הגה ואם לא אמרו העדים ששאל להם לזייף שטר זה אלא שטר סתם כל שטרותיו של זה שבקש לזייף אתרעו ולא גבינן בהו (טור):
When they said that they do not collect with it, we do not leave it in his hand, but place it in the hand of a trustee. Hagah [Rema]: And if the witnesses did not say that he asked them to forge this document, but an unspecified document — all the documents of this one who sought to forge are impaired, and we do not collect with them (Tur).
