דין אשה הנושאת ונותנת בתוך הבית. ובו סעיף אחד: אשה הנושאת ונותנת בתוך הבית והיו שטרות מקניית הקרקעות ועבדים או שטרי חובות כתובים על שמה והיא אומרת שלי הם (אפי' השטרות תחת ידה) עליה להביא ראיה בעדים שהוא כדבריה שהיה לה ממון מיוחד וא"צ שיעידו על אלו השטרות שהם שלה וה"ה אם נמצאו לה מטלטלים ברשותה עליה להביא ראיה: הגה ואפי' אלמנה ואפי' היו השטרות בידה (מרדכי ר"פ הספינה) לא היתה נושאת ונותנת תוך הבית והיו שטרות כתובים על שמה הם שלה. היו כתובים על שמה ועל שם בעלה הם שותפות של שניהם (טור אבן העזר סוף סי' פ"ו) וסתם אשה נושאת ונותנת תוך הבית (מרדכי פ' חזקת הבתים והרשב"א שם) אשה שכתבה לאחרים שמה שתחת ידיה הוא של אחרים אם ידוע שהיה לה ממון שאינו של בעלה נאמנת ואין הבעל יכול לומר שהוא שלו ב"י בטור אה"ע סי' פ"ו בשם הרשב"א יש מי שאומר שאם היו השטרות כתובים על שמה אע"פ שהיא אינה נאמנת מאחר שנושאת ונותנת תוך הבית מ"מ אם מתה טוענין ליורשיה שהיא שלה וכמו שיתבאר בסמוך לענין האחין (תשו' רשב"א סי' תתע"ט וריב"ש סי' קס"ט) וכן נ"ל ועיין עוד מדינין אלו באה"ע סי' פ"ו וכן א' מהאחים שנושא ונותן בתוך הבית ושטרות עשוים על שמו ואומר שלי הם שנפלו לי מבית אמי או מציאה מצאתי או מתנה ניתנה לי עליו להביא ראיה בעדים ואם מת והניח יתומים אז צריכים האחים להביא ראיה בעדים: הגה ודוקא בדבר שאינו ידוע שהיה של אחין אבל בדבר ידוע שהיה של אחין על היתומים להביא ראיה (מרדכי ר"פ חזקת הבתים) ואם היו חלוקין בעיסתן או בשום דבר על האחים להביא ראיה ואפי' בחייו משום דאימור מעיסתו קימץ ואפי' אומר מבית אבי אמי נפלו נאמן במגו: הגה ודוקא שהשטרות כתובין על שמו אבל כתוב על שם האחין או על שם אביהם לא יוכל לומר ששלו הוא ואפי' מת על היתומים להביא ראיה בעדים (ב"י בשם התרומות ורמב"ם פ"ט מה' נחלות והרא"ש כלל פ"ה) וכל זה באשה או אחין אבל בן בית שנושא ונותן בשל בעל הבית כל מה שהפקיד או שנמצא תחת ידו הוא בחזקה שהוא שלו זולתי אם נודע שהוא בעה"ב אפי' אינו אמוד וידוע שלא היה לו שום דבר חוץ משל בעה"ב ואם מת נותנין ליורשיו (רבי ירוחם נ"ל):
The law of a woman who conducts the business of the household; it contains one se'if. A woman who conducts the business of the household, and there were documents of purchase of lands and slaves, or documents of debt, written in her name, and she says: they are mine (even if the documents are under her hand) — it is upon her to bring proof by witnesses that it is as she says, that she had money of her own; and they need not testify concerning these documents that they are hers. And likewise, if movables were found in her possession, it is upon her to bring proof. Hagah [Rema]: And even a widow, and even if the documents were in her hand (Mordechai, the beginning of chapter "One who sells the ship"). If she did not conduct the business of the household, and there were documents written in her name, they are hers. If they were written in her name and in her husband's name, they are a partnership of the two of them (Tur Even HaEzer, the end of siman 86). And an ordinary woman conducts the business of the household (Mordechai, chapter "The presumption of houses", and the Rashba there). A woman who wrote to others that what is under her hands belongs to others — if it is known that she had money that was not her husband's, she is believed, and the husband cannot say that it is his: Beit Yosef on Tur Even HaEzer, siman 86, in the name of the Rashba. There is one who says that if the documents were written in her name, although she is not believed, since she conducts the business of the household, nevertheless if she died they plead on behalf of her heirs that it is hers, and as will be explained shortly concerning the brothers (a responsum of the Rashba, siman 879, and Rivash, siman 169); and so it seems to me. And see further on these laws in Even HaEzer, siman 86. And likewise one of the brothers who conducts the business of the household, and documents are made out in his name, and he says: they are mine, they fell to me from my mother's house, or I found a find, or a gift was given to me — it is upon him to bring proof by witnesses; and if he died and left orphans, then the brothers must bring proof by witnesses. Hagah [Rema]: And specifically in a thing that is not known to have been the brothers'; but in a thing known to have been the brothers', it is upon the orphans to bring proof (Mordechai, the beginning of chapter "The presumption of houses"). And if they were divided in their dough or in anything, it is upon the brothers to bring proof, and even in his lifetime, because one may say: he scraped it together from his own dough; and even if he says: they fell to me from my mother's father's house, he is believed by a migo (a plea he could have made in which he would have been believed). Hagah [Rema]: And specifically where the documents are written in his name; but if they are written in the name of the brothers or in the name of their father, he cannot say that it is his, and even if he died, it is upon the orphans to bring proof by witnesses (Beit Yosef in the name of the Terumot, and the Rambam, chapter 9 of the Laws of Inheritance, and the Rosh, klal 85). And all this is with a woman or brothers; but a member of the household who conducts business with the householder's property — whatever he deposited or is found under his hand is in the presumption that it is his, unless it is known that it is the householder's, even if he is not wealthy and it is known that he had nothing except what was the householder's; and if he died, they give it to his heirs (Rabbeinu Yerucham, netiv 30).
