1. Some Laws Regarding Legal Documents (Shtarot), in 16 Sections: A community that enacted a regulation stating that no legal document would be valid unless it was written by the city's official scribe — this does not include a case where Reuven forgave a debt owed to him by Shimon and signed the document himself. (It is obvious that the regulation refers only to documents that are signed by witnesses.) (Tur)
Se’if 2ב׳
2. A template of a legal document (shtar) that is in the possession of the scribe and has witnesses signed on it, but the actual document was not copied (i.e., the shtar itself was never formally written) — such a template does not have the status of a valid shtar unless it is the custom in that city to treat it as such. Rema: Any document in which the witnesses did not sign with the intent of delivering it to the parties, but merely as a memorandum, is not considered a valid shtar. Similarly, a document that was never meant to be written in the first place — and where it’s possible that the witnesses made a mistake — is not judged based on that document (Responsa of the Rashba, section 1011), for it is considered as if it were transmitted orally, as explained above in section 28, paragraphs 11 and 12. However, there are dissenting opinions that hold: If a template was written with the intention of later preparing a proper shtar — even if the final shtar was never written — this template has the status of a shtar (Tur in the name of the Rosh, Klal 68)
Se’if 3ג׳
3. A woman who is obligated to take an oath, according to the enactment of the Geonim — who instituted that a debtor must pay from their movable property if they possess any — and she refuses [to comply], she is excommunicated until she complies with the ruling of the court, just as is done with a man. (This is because a woman is equal to a man with regard to all punishments prescribed by the Torah.) (Tur)
