דין חזרת השטר בשטה אחרונה וכיצד מקיימים המחק והתלוים. ובו יא סעיפים: צריך להחזיר מעניינו של שטר בשטה אחרונה מפני (שאין למדין משטה אחרונה) (טור) מפני שאין העדים יכולים לצמצם שיחתמו מיד סמוך לכתב ויש לחוש שמא הניחו שם כדי שיטה וכתב המזייף שם מה שרצה ואם לא החזיר אין השטר נפסל בכך אלא שאין למדים משטה אחרונה: הגה ודלא כי"א שהשטר כולו פסול דכל שטר שלא נעשה כתיקון חכמים פסול אע"פ שאין טעם לפוסלו (טור בשם הרא"ש ותוס' בפ' ג"פ דף קס"א ע"א) והא דאין למדין משטה אחרונה היינו במקום שיש חשש שמא זייף אבל אם השטה אחרונה לחובת מוציא השטר למדין ממנה דודאי לא זייף (נ"י פ' ג"פ בשם ריטב"א והר"א):

1. The Laws of Summarizing the Document On the Last Line and How We Verify Erased and Hanging Letters, 11 Seifim: When writing a document, one must repeat the content of the document in the last line because (we do not deduce anything from the last line - Tur) due to the fact that the witnesses are not capable of ensuring that their signatures are immediately juxtaposed to the text. Se’if 2ב׳

אם השטר כולו מכתיבת ידו של מי שנתחייב למדין משטה אחרונה אבל אם השטר מיד אחר והחייב חתום למטה אין למדין משטה אחרונה:

2. If the entire document was written in the handwriting of the party that is obligated, we would deduce from the last line. If, however, the document was in the hand of another person and the obligated party signed on bottom, we would not deduce from the last line.

Se’if 3ג׳

אם סיים השטר בסוף שטה והרחיקו העדים שטה שלימה וחתמו העדים באמצע שטה שנייה אין למדים מחצי שטה אחרונה ומשטה שלימה שלפניה: הגה (ע' ס"ק י') אם נמצא דבר כתוב בחצי שטה שלפניהם ובשטה שלפניה ודוקא שחתמו העדים זה תחת זה אבל אם חתמו זה אח"ז כל השטר פסול כדלקמן סימן מ"ה סעיף י':

3. If the document concluded at the end of a line and the witnesses distanced their signature a full line and signed in the middle of the second line, we would not deduce anything from half of the last line nor from the complete line before it. RAMA: [This is] if something was discovered to have been written in the half row before their signatures or the row before it. This is only where the witnesses signed one on top of the other. If, however, they signed one following the other, the entire document is invalid as will be written later in 45:10.
