Se’if 1א׳
חייבי מיתת ב"ד היאך דנים אותן בזמן הזה. ובו ה סעיפים: הגה כל חייבי מיתות ב"ד בזמן הזה אין בידינו להלקותן או להגלותן או להרגן או לחבטן אלא מנדין אותן ומבדילין אותן מן הקהל (טור ס"א בשם רב נטרונאי גאון) וכל זה מצד הדין אבל אם רואין ב"ד שהוא צורך שעה ומגדר מילתא יכולין לענוש במה שירצו (שם ובשם תשו' הגאון) כמו שנתבאר לעיל סי' ב': ודוקא בדיני נפשות הצריכין ב"ד אבל הנהרגין בלא ב"ד נידונין גם עתה כמו שיתבאר (טור שם) : הרודף אחר חבירו להרגו והזהירוהו והרי הוא רודף אחריו אפי' היה הרודף קטן הרי כל ישראל מצויים להצילו באבר מאברי הרודף ואם אינם יכולים לכוין ולא להצילו אלא א"כ יהרגו לרודף הרי אלו הורגים אותו אע"פ שעדיין לא הרג: הגה (טור ס"ז) הבא במחתרת לגנוב ג"כ דינו כרודף ואם ידוע שלא בא רק על עסק ממון ואף אם יעמוד בעל הממון נגדו לא יהרגהו אסור להרגו ועיין בדברי הטור בסי' זה מי שמסכן רבים כגון שעוסק בזיופים במקום שהמלכיות מקפידות דינו כרודף ומותר למסרו למלכות (נימוקי מהר"ם מריזבורק] כמו שנתבאר לעיל סימן שפ"ח סי"ב:
Rema: Regarding those guilty of the death penalty in our days, we have no power to give them lashes, exile them, kill them, or beat them. Instead we censure them and distance them from the community (Tur 68 from Natronai Gaon). Thus far regarding [strictly Torah] law. However, if the beit din sees a necessity for a preventative measure, it has the authority to institue whatever punishment they see fit (ibid., from the Responsa of the Natronai Gaon), as explained above in Siman 2. This regards those instances involving capital punishment which necessitates a beit din. Cases in which the death penalty can be implemented even without a beit din, are still judged in our days, as will be explained (ibid.). One who pursuses his fellow in order to kill him, and was warned, and continued in his pursuit: Even if the pursuer was a minor, every Jew is commanded to save the pursed, even at the cost of one maiming one of the pursuer's limbs. If it is impossible to save the pursued without killing the pursuer outright, then the pursuer should indeed be killed, even though he has not yet performed the act. Rema: (Tur 67) One who "tunnels [into a house] in order steal" has this rule of pursuer applied to him, however if it is understood that his only intent is monetary gain, and that he would not kill the owner in a confrontation, then it is forbidden to kill him. See further in the Tur in this paragraph regarding one who endangers the public, such as a Jew who engages in forgery in a land where the authorities take a strict approach to such action, such a person constitutes a "pursuer" and it is permitted to turn him over to the authorities (Nimukei Maharam MiRizburg), as explained above in 388:12.
Se’if 2ב׳
לפיכך העוברת שהיא מקשה לילד מותר לחתוך העובר במעיה בין בסם בין ביד מפני שהוא כרודף אחריה להרגה ואם הוציא ראשו אין נוגעין בו שאין דוחין נפש מפני נפש וזהו טבעו של עולם:
Therefore, a pregnant woman who is having difficulty in giving birth — it is permitted to cut up the foetus in her womb, whether with a drug or by hand, because it is like a pursuer pursuing her to kill her; but once it has put out its head, one does not touch it, for one does not set aside one life for another, and this is the nature of the world.
Se’if 3ג׳
וכן הרודף אחר הזכר או אחר אחת מכל העריות (לאנסה) חוץ מהבהמה מצילין אותו אפילו בנפש הרודף ואם רדף אחר ערוה ותפס ושכב עמה כיון שהערה בה אע"פ שלא גמר ביאתו אין ממיתין אותו עד עמדו בדין:
And likewise one who pursues a male, or one of all the women of the forbidden unions (to rape her) — except for an animal — they save the one pursued even at the cost of the pursuer's life. And if he pursued a forbidden woman and seized her and lay with her, once he has begun intercourse with her, even though he did not complete his act, they do not put him to death until he stands in judgment.
