Se’if 1א׳
נגף אשה ויצאו ילדיה וכיצד שמין דמי ולדות. ובו ד סעיפים: הנוגף את האשה ויצאו ילדיה אע"פ שלא נתכוין חייב לשלם דמי ולדות לבעלה ונזק וצער לאשה וכיצד משערין דמי ולדות שמין את האשה כמה היתה יפה עד שלא ילדה וכמה היא יפה משילדה ונותנים לבעל (וצער ונזק משערין כמה תפחת האשה ונכחשת יותר כשהיא מפלת ע"י הכאה משילדה כדרכה וכן בשבת וריפוי אם צריכה לכך) (טור ס"ד) (ועיין באבן העזר סי' פ"ג) ואם מת הבעל נותנים ליורשיו (שם ברמב"ם ד"ב) ואם נגפה אחר מיתת הבעל נותנים אף דמי ולדות לאשה (וי"א דהוא של יורשיו) (טור בשם הראב"ד והרא"ש):
One who struck a woman and her offspring came out, and how the value of the offspring is assessed; it contains four se'ifim. One who strikes a woman and her offspring came out, even though he did not intend it, must pay the value of the offspring to her husband, and damage and pain to the woman. And how is the value of the offspring assessed? They value the woman: how much she was worth before she gave birth and how much she is worth after she has given birth, and they give it to the husband (and pain and damage: they assess how much more the woman will depreciate and grow thin when she miscarries through a blow than when she gives birth in the normal way; and likewise with loss of time and healing, if she needs them) (Tur, se'if 4) (and see Even HaEzer, siman 83). And if the husband died, they give it to his heirs (there, in the Rambam, law 2). And if he struck her after the husband's death, they give even the value of the offspring to the woman (and some say that it belongs to his heirs) (Tur, in the name of the Raavad and the Rosh).
Se’if 2ב׳
היתה נשואה לגר וחבל בה בחיי הגר נותן דמי ולדות לבעל מת הגר פטור ואם חבל בה אחר מיתת הגר זכתה היא בדמי ולדות (וי"א דהוא פטור) (טור ס"ג בשם הרא"ש):
If she was married to a convert, and he wounded her in the convert's lifetime, he gives the value of the offspring to the husband; if the convert died, he is exempt; and if he wounded her after the convert's death, she has acquired the value of the offspring (and some say that he is exempt) (Tur, se'if 3, in the name of the Rosh).
Se’if 3ג׳
היתה שפחה או עכו"ם בשעת הריון ובשעת נגיפה נשתחררה או נתגיירה הרי דמי ולדות שלה (וי"א דאם בעלה קיים הרי הן של בעל ואם לאו הוא פטור) (טור ס"ד בשם הרא"ש):
If she was a maidservant or a gentile at the time of conception, and at the time of the blow she had been freed or had converted, the value of the offspring is hers (and some say that if her husband is alive, it is the husband's, and if not, he is exempt) (Tur, se'if 4, in the name of the Rosh).
