Se’if 1א׳
המבייש חבירו שלא בכוונה והחובל בחבירו שלא בכוונה. ובו יד סעיפים: אינו חייב על הבושת עד שיתכוון לביישו והמבייש את חבירו שלא בכוונה פטור לפיכך ישן שבייש פטור: הגה וכן מי שקובל על חבירו שמסרו או גנב לו וכיוצא בזה אע"פ שלא יכול לברר עליו מ"מ פטור דהרי לא כוון לביישו (מהרי"ו סי' קס"ח):
One who shames his fellow without intention, and one who wounds his fellow without intention; it contains fourteen se'ifim. He is not liable for shame unless he intends to shame him; and one who shames his fellow without intention is exempt. Therefore one asleep who shamed is exempt. Hagah [Rema]: And likewise one who complains against his fellow that he informed on him, or stole from him, and the like — even though he could not make it clear against him, he is nevertheless exempt, for he did not intend to shame him (Maharyu, siman 168).
Se’if 2ב׳
המתכוין לבייש את הקטן ובייש את הגדול נותן לגדול דמי בושתו של קטן נתכוין לבייש העבד ובייש בן חורין נותן לבן חורין דמי בושתו של עבד:
One who intends to shame a minor and shamed an adult gives the adult the value of the minor's shame; if he intended to shame the slave and shamed a free man, he gives the free man the value of the slave's shame.
Se’if 3ג׳
יש אומרים דצער ריפוי ושבת חייב אפי' שלא בכוונה ובלבד שלא יהא אנוס אלא שוגג קרוב למזיד אבל בנזק חייב אפי' אנוס דאדם מועד לעול' בין שוגג בין במזיד בין ער בין ישן:
Some say that for pain, healing and loss of time he is liable even without intention, provided it was not by mishap but unwitting close to wilful; but for damage he is liable even by mishap, for a man is always forewarned — whether unwitting or wilful, whether awake or asleep.
