Se’if 1א׳
החובל בחבירו חייב בה' דברים וכיצד משערין אותם והמבייש בדברים ת"ח וע"ה. ובו מד סעיפים: אסור לאדם להכו' חבירו ואם הכהו עובר בלאו שנא' פן יוסיף ואם הקפידה תורה בהכאת רשע שלא להכותו יותר על רשעו קל וחומר בהכאת צדיק והמרים יד על חבירו להכותו אע"פ שלא הכהו נקרא רשע: הגה וע"ל סי' תכ"א סעיף י"ג ודין הכאת איש לאשתו עיין בא"ה סי' קנ"ד די"א דיש חרם קדמונים באדם המכה לחבירו וצריכין להתיר לו כדי לצרפו למנין עשרה ומיד שמקבל עליו לעשות דין מתירין לו אע"פ שאין [ המוכה] מתרצה (מהר"ם מריזבורק והג"מ פ' החובל):
One who wounds his fellow is liable for five things, and how they assess them; and one who shames with words, a Torah scholar and an am ha-aretz (one unlearned in the Torah); it contains forty-four se'ifim. It is forbidden for a person to strike his fellow; and if he struck him, he transgresses a negative commandment, as it is said, "lest he exceed". And if the Torah was particular about the striking of a wicked man, that he not be struck beyond his wickedness, all the more so about the striking of a righteous man. And one who raises a hand against his fellow to strike him, even though he did not strike him, is called wicked. Some say that there is an ancient cherem (the severer form of the ban) upon a person who strikes his fellow, and they must release him from it in order to join him to the count of ten; and as soon as he accepts upon himself to abide by the judgment, they release him, even though the one struck is not appeased (Maharam of Merseburg, and Hagahot Mordechai, chapter "One who wounds").
Se’if 2ב׳
הכהו מכה שאין בה שוה פרוטה לוקה כיון שאין בה חיוב ממון ואפי' הכה עבד כנעני לוקה הוא שהרי חייב במצות:
If he struck him a blow in which there is not a perutah's worth, he is flogged, since there is no monetary liability in it; and even if he struck a Canaanite slave he is flogged, for the slave is obliged in the commandments.
Se’if 3ג׳
החובל בחבירו חייב בחמשה דברים נזק צער רפוי שבת בושת אם החבלה בענין שיש בה כל החמש: הגה י"א דצריך ליתן ג"כ תוספות מזונות הצריכין בחליו ממה שהיה אוכל כשהיה בריא (נ"י פ' החובל) ונ"ל דבכלל ריפוי יחשב: ואם אין בה אלא ד' משלם ד' ואם ג' ג' ואם ב' ב' ואם א' א':
One who wounds his fellow is liable for five things — damage, pain, healing, loss of time and shame — if the wound is such that it has all five in it. Hagah [Rema]: Some say that he must also give the additional food needed in his illness beyond what he used to eat when he was healthy (Nimukei Yosef, chapter "One who wounds"); and it seems to me that it is reckoned within healing. And if it has only four, he pays four; if three, three; if two, two; if one, one.
