Se’if 1א׳

כיצד נפרעים לנזקים מהמזיק ומיורשיו. ובו ג סעיפים: כשב"ד נזקקים לגבות לניזק מנכסי המזיק גובין מהמטלטלין תחלה ואם לא היו (לו) מטלטלין כלל או שלא היו לו מטלטלין כנגד כל הנזק גובין השאר מהקרקע המעולה שבנכסי המזיק וכל זמן שימצא מטלטלין ואפי' סובין אין נזקקין לקרקע ואפי' שיש לו כסף יכול לפורעו בסובין דכל מטלטלים מיטב נינהו ושמין אותה כמו שיכול למוכרה מיד ובמקומו וכשמשלם מהקרקע אפי' היתה זבורית של מזיק טובה כעידית של ניזק אינו מקבל ממנו אלא מגבין לו מעידית שבנכסי המזיק:

How damages are paid from the one who damaged and from his heirs; it contains three se'ifim. When the court undertakes to collect for the one damaged from the property of the one who damaged, they collect from the movables first; and if there were no movables (of his) at all, or he did not have movables to cover the whole damage, they collect the rest from the finest land among the property of the one who damaged. And so long as movables are found — even bran — they do not have recourse to land; and even if he has silver, he can pay him in bran, for all movables count as "the best"; and they value it at what it can be sold for immediately and in its place. And when he pays from land, even if the poorest land of the one who damaged is as good as the choice land of the one damaged, he does not receive it from him; rather they collect for him from the choice land among the property of the one who damaged.

Se’if 2ב׳

אם יש למזיק שני עידית אין הניזק יכול לומר לו תן לי מעידית פלוני אלא תלוי ברצון המזיק לתת לו איזה שירצה אבל אם המזיק חפץ לתת לו העידית שבקש אלא שהיא עתה בזול וממתין עד שתתייקר ואומר אם תרצה אותה קח אותה כפי מה שהיא עתידה להתייקר אין שומעין לו אלא צריך ליתנה לו כפי מה ששוה עתה:

If the one who damaged has two pieces of choice land, the one damaged cannot say to him, "Give me from such-and-such choice land"; rather, it depends on the will of the one who damaged to give him whichever he wishes. But if the one who damaged is willing to give him the choice land that he asked for, only that it is now cheap and he waits until it grows dear, and says, "If you want it, take it according to what it is going to rise to", they do not listen to him; rather he must give it to him according to what it is worth now.

Se’if 3ג׳

מת המזיק קודם שיפרע מגבין לניזק מהמטלטלין של יתומים ואם לא הניח מטלטלין מגבין לו מזיבורית שבקרקעותיו שכל הבא ליפרע מנכסי יתומים לא יפרע אלא מהזיבורית:

If the one who damaged died before he paid, they collect for the one damaged from the movables of the orphans; and if he left no movables, they collect for him from the poorest land among his lands; for whoever comes to be paid from the property of orphans is paid only from the poorest land.
