Se’if 1א׳
נזקי האש פטורו וחיובו וטמון באש וכל דיניו. ובו יח סעיפים: אש הוא אב דכתיב כי תצא אש ומצאה קוצים והוא ממונו שהולך למרחוק ומזיק ע"י הרוח שמוליכו לפיכך כל הדומה לו שהוא ממונו והולך ומזיק הוא תולדתו ויש לו דין אש לפטור בו טמון:
Damage by fire: its exemption and its liability, and things hidden in fire, and all its laws; it contains eighteen se'ifim. Fire is an av (primary category), as it is written: "If fire break out and catch in thorns"; and it is his property that goes far off and damages by means of the wind that carries it. Therefore, anything like it — which is his property and goes and damages — is its toladah (derivative category) and has the law of fire: to be exempt for hidden things in it.
Se’if 2ב׳
כתיב כי תצא אש אפילו מעצמה שהדליק בתוך שלו והלך ודלק בתוך של חבירו אפי' לא שרפה אלא עציו ואבניו או שליחכה נירו חייב לשלם הכל אא"כ הרחיק כשיעור אבל אם הרחיק כשיעור ויצא והזיק פטור: הגה וכל זה במדליק בתוך שלו אבל במדליק בתוך חבירו אפי' עברה כמה מילין חייב (טור ס"א):
It is written, "If fire break out" — even of itself: if he kindled within his own and it went and burned within his fellow's, even if it burned only his wood and his stones, or licked up his ploughed land, he must pay for all, unless he kept it at the proper distance; but if he kept it at the proper distance and it went out and did damage, he is exempt. Hagah [Rema]: And all this is in one who kindles within his own; but in one who kindles within his fellow's, even if it passed several mil, he is liable (Tur, se'if 1).
Se’if 3ג׳
וכמה שיעור הרחקה הכל לפי גובה הדליקה ואם לא הרחיק כראוי ועברה האש והזיקה חייב לשלם נזק שלם:
And what is the measure of the distance? All is according to the height of the blaze; and if he did not keep it at the proper distance, and the fire passed and did damage, he must pay full damage.
