הכותל והאילן שהיו רעועים ונפלו והזיקו. ובו סעיף אחד: הכותל והאילן שנפלו לרשות הרבים והזיקו פטור מלשלם אע"פ שהפקירם לפי שאינם דומים לבור שהרי אין תחילתן להזיק (וי"א דאם היה לו פנאי לסלקן ולא הפקירן חייב) (טור ס"א) ואם היו רעועין ב"ד קובעין לו זמן ודוקא שהתרו בו ב"ד אבל בלא ב"ד אע"פ שהתרו בו חביריו אינו כלום מיהו אם חפר בכותל וגרם להפילו חייב בניזקין דהוה ליה חציו ממש (ב"י בשם רשב"א) לקוץ את האילן ולסתור את הכותל וכמה הזמן ל' יום (ואם הדבר נחוץ ויש לחוש שיזיק לאחרים אין נותנין לו זמן רק כופין אותו לסלק היזיקו מיד) (ב"י בשם ריטב"א) נפלו בתוך הזמן פטור לאחר הזמן חייב מפני שהשהה אותם: הגה וכ"ז כשבנאה מתחילתו כראוי אבל אם לא בנאה כראוי ומחמת זה נפל הכותל חייב בנזקה (תוס' המגיד פי"ג דנזקי ממון וב"י בשם רבי' ירוחם נל"א ח"א):
The wall and the tree that were tottering and fell and did damage; it contains one se'if. The wall and the tree that fell into the public domain and did damage — he is exempt from paying, even though he declared them ownerless, because they are not like a pit, for their beginning is not to damage (and some say that if he had time to remove them and did not declare them ownerless, he is liable) (Tur, se'if 1). And if they were tottering, the court fixes him a time — and specifically where the court warned him; but without the court, even though his fellows warned him, it is nothing; however, if he dug in the wall and caused it to fall, he is liable for the damages, for it is his arrows proper (Beit Yosef in the name of the Rashba) — to cut down the tree and to pull down the wall. And how long is the time? Thirty days (and if the matter is urgent and there is to fear that it will damage others, they do not give him time, but compel him to remove his damage at once) (Beit Yosef in the name of the Ritva). If they fell within the time, he is exempt; after the time, he is liable, because he delayed them. Hagah [Rema]: And all this is where he built it properly at the outset; but if he did not build it properly and because of this the wall fell, he is liable for its damages (Tosafot; the Maggid, chapter 13 of the Laws of Damage to Property; and Beit Yosef in the name of Rabbeinu Yerucham, netiv 31, part 1).
