Se’if 1א׳

הגודר גדרו בקוצים והוזק בהם והמצניע קוצים בכותל חבירו. ובו ג סעיפים: המצניע את הקוץ ואת הזכוכית והגודר גדרו בקוצים והפריחו לרה"ר והוזק בהם אחר חייב נזק שלם ואם גדר בקוצים בצמצום בתוך רשותו פטור לפי שאין דרך בני אדם להתחכך בכותלים:

One who fences his fence with thorns and one was injured by them, and one who hides thorns in his fellow's wall; it contains three se'ifim. One who hides a thorn or glass, or fences his fence with thorns, and they spread out into the public domain, and another was injured by them, is liable for full damage. And if he fenced with thorns exactly within his own domain, he is exempt, because it is not the way of people to rub against walls.

Se’if 2ב׳

המצניע קוציו וזכוכיותיו בתוך כותלו של חבירו ובא בעל הכותל וסתר כותלו ונפל לרה"ר והזיק אם כותל רעוע הוא המצניע חייב ואם כותל בריא הוא בעל הכותל חייב: הגה ואם הזיקו בשעת נפילה י"א דבעל כותל חייב בכל ענין (טור ס"ב) ואם נפלה הכותל מאיליו אם היתה בריא פטורים ואם היתה רעוע המצניע חייב ואם סתרה אינש דעלמא הסותר חייב והמצניע פטור (נ"י פ' המניח) (וע' לעיל סי' שצ"ו):

One who hides his thorns and his pieces of glass inside his fellow's wall, and the owner of the wall came and pulled down his wall, and it fell into the public domain and did damage: if it is a tottering wall, the one who hid them is liable; and if it is a sound wall, the owner of the wall is liable. Hagah [Rema]: And if they did damage at the time of falling, some say that the owner of the wall is liable in every case (Tur, se'if 2). And if the wall fell of itself: if it was sound, they are exempt; and if it was tottering, the one who hid them is liable; and if an outsider pulled it down, the one who pulled it down is liable and the one who hid them is exempt (Nimukei Yosef, chapter "One who places") (and see above, siman 396).

מדת חסידות הוא שיצניע אדם קוציו ושאר כל דבר המזיק במקום שלא יבא מהם תקלה כגון שישליכם לנהר או ישרפם:

It is a trait of piety that a person should hide away his thorns and every other damaging thing in a place from which no obstacle will come of them — for example, he throws them into the river or burns them.
