Se’if 1א׳

אימתי אדם רשאי להוציא זבלים לרשות הרבים. ובו ב סעיפים: לא יוציא אדם תבנו וקשו לרשות הרבים כדי שידושו ויעשו זבל ואם הוציאם קנסוהו חכמים שיהיו כהפקר וכל הקודם בהם זכה מעת שנידושו והשביחו (מיהו יש אומרים דאין מורין לו לכתחלה להחזיק רק בשבח אבל לא בגופו ואם התרו בבעלים ולא סלקו מפקירין אותו לכל (טור ס"ד) ואם קדם אדם וזכה בהם משעת הוצאה לרשות הרבים אין מוציאין מידו (וי"א דלא מהני תפיסה) (ר"י ורא"ש וטור שם) (וע"ל סי' שפ"ח) ואע"פ שהם כהפקר אם הוזק בהם אדם או בהמה הרי זה המוציא חייב לשלם:

When a person may take out dung into the public domain; it contains two se'ifim. A person shall not take out his straw and his stubble into the public domain so that they be trodden and become dung; and if he took them out, the Sages fined him that they be as ownerless, and whoever comes first to them acquires them — from the time they have been trodden and improved (nevertheless, some say that one does not instruct him in the first instance to take hold of anything but the improvement, and not of the thing itself; and if they warned the owners and they did not remove it, they declare it ownerless to all) (Tur, se'if 4). And if a person came first and acquired them from the time they were taken out into the public domain, they do not take them out of his hand (and some say that seizing does not avail) (the Ri and the Rosh, and Tur there) (and see above, siman 388). And even though they are as ownerless, if a man or an animal was injured by them, the one who took them out is liable to pay.

יש לכל אדם להוציא את הזבל והגללים לרשות הרבים בשעת הוצאת זבלים (אבל שלא בשעת הוצאת זבלים אסור להוציאו כדי להניחו שם אבל מוציאו כדי לפנותו לאלתר (טור ס"א) וכל שכן מים נקיים ושופכין שלו שאין שוהין ומתעכבים ברשות הרבים שמותר לשפכן אפי' בימות החמה ואפי' מים סרוחין כל שדעתו לפנותו לאלתר ואפילו מתקן בור פחות משלשה טפחים אין בני רשות הרבים יכולים לעכב) (מרדכי סוף ב"מ בשם מהר"מ) ולצבור אותם שם שלשים יום כדי שיהיה נשוף ברגלי אדם ואעפ"כ אם הזיק חייב לשלם וחייבים על זה הגלל משום גזל כיון שאין בו שבח אם נדוש לא קנסו בו: הגה וי"א דלאחר שהוזק כל הקודם בהם זכה (טור ס"ב):

Every person may take out manure and dung into the public domain at the time of taking out manure (but when it is not the time of taking out manure, it is forbidden to take it out in order to leave it there; but he may take it out in order to clear it away at once) (Tur, se'if 1) (and all the more so clean water and his waste water, which do not stay and linger in the public domain, which it is permitted to pour out even in the summer — and even foul water, so long as he means to clear it away at once; and even if he makes a pit less than three handbreadths, the people of the public domain cannot prevent him) (Mordechai, the end of Bava Metzia, in the name of the Maharam); and to pile them there thirty days, so that it be crushed under the feet of people. Yet even so, if it did damage he must pay; and one is liable for this dung on account of robbery; since there is no improvement in it if it is trodden, they did not fine him in it. Hagah [Rema]: And some say that after one was injured, whoever comes first to them acquires them (Tur, se'if 2).
