Se’if 1א׳

דין הקדרים שהולכין זה אחר זה ונתקלו ונפלו. ובו ג סעיפים: שני קדרים שהיו מהלכים בדרך זה אחר זה ונתקל הראשון ונפל ונתקל השני בראשון אם היה לראשון לעמוד ולא עמד חייב הראשון בנזקי שני שאע"פ שהוא אנוס בשעת נפילה אינו אנוס בהיותו מוטל לדרך והרי הוא יכול לעמוד ואם לא היה לו לעמוד פטור ואע"פ שלא הזהיר לזה שנתקל בו מפני שהוא טרוד בנפשו (וי"א דחייב אם היה לו פנאי להזהירו ולא הזהיר) (טור ס"א בשם הרא"ש) בד"א שהוא חייב בנזקיו של שני כשהוזק גופו של שני אבל אם הוזקו כליו פטור שאינו חייב על הכלי' בבור וכל תקלה תולדו' בור הוא כמו שנתבאר:

The law of potters who walk one behind the other and stumbled and fell; it contains three se'ifim. Two potters who were walking on the road one behind the other, and the first stumbled and fell, and the second stumbled on the first: if the first could have got up and did not get up, the first is liable for the damages of the second; for even though he was overtaken by mishap at the time of falling, he is not overtaken by mishap while he lies on the road, and he is able to get up. And if he could not get up, he is exempt, even though he did not warn this one who stumbled on him, because he is preoccupied with himself (and some say that he is liable if he had time to warn him and did not warn him) (Tur, se'if 1, in the name of the Rosh). When is it said that he is liable for the damages of the second? When the second's body was injured; but if his vessels were damaged, he is exempt, for one is not liable for vessels in a pit, and every obstacle is a toladah (derivative category) of the pit, as was explained.

Se’if 2ב׳

הקדרים והזגגים (פי' מוכרים כלי זכוכית) וכיוצא בהם שהיו מהלכים זא"ז ונתקל הראשון ונפל ונתקל השני בראשון והשלישי בשני וכל אחד מהם יש לו לעמוד ולא עמד הראשון חייב בנזקי גופו של שני בין שהוזק בגופו של ראשון המוטל לארץ בין שהוזק במשאו (ויש חולקין וסבירא להו דאם הוזק במשאו אפי' גופו של שני פטור) (טור שם בשם הרא"ש) והשני חייב בנזקי גופו של שלישי אם הוזק בגופו של שני אבל אם הוזק במשאו של שני שנפל פטור שהרי אומר לו השני בור זה שהוא משאו אין אני הכורה אותו שהרי הראשון הפיל השני עם משאו ואם הזהירו זא"ז כלם פטורין:

Potters and glaziers (that is, sellers of glass vessels) and the like who were walking one behind the other, and the first stumbled and fell, and the second stumbled on the first, and the third on the second, and each of them could have got up and did not get up: the first is liable for the damages to the second's body, whether he was injured by the body of the first lying on the ground or whether he was injured by his burden (and some disagree and hold that if he was injured by his burden, even for the second's body the first is exempt) (Tur there, in the name of the Rosh). And the second is liable for the damages to the third's body if he was injured by the second's body; but if he was injured by the burden of the second that fell, he is exempt, for the second says to him: "This pit, which is my burden — I am not the one who dug it, for the first knocked down the second with his burden." Se’if 3ג׳

נפל הראשון והיה מוטל לרוחב הדרך ונתקל אחד בראשו ואחד ברגליו ואחד בבטנו הרי הוא חייב בנזקי כולם הואיל והיה לו לעמוד ולא עמד: הגה וי"א דדוקא אם מונח הראשון באלכסון (טור שם בשם הרא"ש):

If the first fell and lay across the width of the road, and one stumbled on his head, and one on his feet, and one on his belly, he is liable for the damages of all of them, since he could have got up and did not. Hagah [Rema]: And some say this is specifically where the first lies diagonally (Tur there, in the name of the Rosh).
